AN ORDINANCE OF THE CITY COMMISSION OF THE CITY
OF DELRAY BEACH, FLORIDA, AMENDING CHAPTER 150,
"BUILDING REGULATIONS", OF THE CODE OF ORDINANCES
OF THE CITY OF DELRAY BEACH, FLORIDA. BY AMEND-
ING, SECTION 150.062, "PERMIT FEE", TO PROVIDE
FOR AN INCREASE IN THE PERMIT FEE FOR MOVING
BUILDINGS; BY AMENDING SECTION 150. 016, "AMEND-
MENTS AND ADDITIONS TO CODE, SUBSECTION 107.4,
· "SCHEDULE OF PERMIT FEES", SUBPARAGRAPHS (c) ( I ),
(II), (III), (IV), (V), (VI), AND (IX), TO MODIFY
PERMIT FEES FOR NEW BUILDINGS AND ADDITIONS,
MI SCELLANEOUS PERMITS, SUB TRADE PERMITS, PERMIT
FEES FOR LONG-TERM PERMITTING, PERMIT FOR MOVING

TO CODE", SUBSECTION 113.4, "SCHEDULE OF PERMIT
FEES", SUBPARAGRAPHS (a) AND (c), TO PROVIDE FOR
AN INCREASE IN THE PERMIT FEES; BY AMENDING
CHAPTER 164, "WELLS; SPRINKLER SYSTEMS", SECTION
164.19, "PERMIT FEES", TO PROVIDE FOR AN INCREASE
IN T~E PERMIT FEES FOR DRILLING OR DRIVING A
POTABLE WELL; BY AMENDING CHAPTER 164, "WELLS;
SPRINKLER SYSTEMS", SECTION 164.36, "PERMIT
FEES", TO PROVIDE FOR AN INCREASE IN THE PERMIT
FEES FOR DRILLING OR DRIVING A NONPOTABLE WELL
AND SPRINKLER SYSTEM; AND BY AMENDING CHAPTER
155, "ELECTRICITY", SECTION 155.18, "PERMIT
FEES", SUBSECTIONS (A) AND (C), TO PROVIDE FOR AN
INCREASE IN PERMIT FEES; PROVIDING A SAVING
CLAUSE..- PROVIDING AN EFFECTIVE DATE.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF
THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. That Chapter 150, "Building Regulations",
Section 150.062, "Permit fees", of the Code of Ordinances of the City
of Delray Beach, Florida, be, and the same is hereby, amended to read
as follows:
The application for a moving permit shall be accompanied by
~ fee in the amount of SR~ $302.50, which fee shall be
nonrefundable.
Section 2. That Chapter 150, "Building Regulation",
Section 150. 016, "Amendments and Additions to Code", Subsection
107.4, "Schedule of Permit Fees", Subparagraphs (c)(I%, (II),(III),
(IV), (V), (VI), AND (IX) of the Code of Ordinances of the City of
De]ray Beach, Florida, be, and the same is hereby amended to read as
follows:
I. Permits for new buildings and additions.
A. Permit fees include:
1. Building
2. Electric
3. Plumbing
4. Mechanical
5. Roof
Single permit fee for the above will be:
1.Minimum fee: $~=~ $36.30 plus
$17.60 per required inspection.
Total valuation: $1,000.00 or less.
2. Construction over $1,000.00 of value: The
fee ' shall be $~B788 $36.30 plus
$12.10 for each additional $1,000.00 of
value over $1,000.00 or portion thereof.
II. Miscellaneous permits. Miscellaneous permits include
driveways, fences, reroofs, pools, utility sheds,
patios, sidewalks.
A. Single miscellaneous building permit fee will be:
1. Minimum fee: $~B=gg $25.30 plus
17.60 per required inspection.
Total valuation: $1,000.00 or less.
2. Construction over $1,000.00 of value: The
fee shall be $~9~ $25.30 plus $~?~ $8.80
for each additional $1,000.00 ef value over
$1,000.00 or portion thereof.
III. Sub trade permit.
A. Sub trades for, but not limited to: 1. Sitework
Structuzal pest control
3. Undergrou3~d. fuel tanks
4. General construction
5. Subcontracts for general construction
B. Minimum fee: $~g~ $36.30 plus
$17.60 per required inspection.
Total valuation: $1,000.00 or less.
C. Construction over $1,000.00 of value: The
fee shall be $B~789 $36.30 plus $Z~=9~ $24.20
for each additional $1,000.00 of value over
$1,000.00 or portion thereof.
IV. Permit for long-term permitting.
The permit fee shall be based on $}}~99 $12.10 per $1,000.00
construction cost and shall be paid at the beginning of the
yearly period. Wi'thin 45 days after the end of the yearly

actual costs and shall remit to the city, or receive a credit

long-term permit shall comply with section 108.2(c) regarding
inspections for general construction work and shall call for

V. Permit for moving of Duilding or structure.
For moving of any building or structure, the fee shall be

VI. Permit for demolition of building of structure.
For the demolition of any building or structure, the fee shall
be $~%=0e $60.50.
IX. Certificate of occupancy.
(1) For the issua~tce of an additional certificate of occupancy,
the fee shall be $~=0e $60.50.
(2) For the issuance of a temporary certificate of occupancy,
the fee shall be ~4~=~ $599.50.
Section 3. That Chapter 157, "Gas Code", Section 157.02,
"Amendments and additions to code", Subsection 113.4, "Schedule of
permit fees~', Subparagraphs (a)and (c), of the Code of Ordinances of
the City of Delray Beach, Florida, be, and same is hereby amended to
read as follows:
(a) The shall be a minimum fee of $~=99 $36.60 for
$1,000.00 or less in construction value plus $~$?~0 $17.60 required
inspection. The fee shall be $~?~ $36.60 plus $R~9~ $24.20 for
each additional $1,000.00 of construction value over $1,000.00 or
portion thereof as determined by the building department or by
evidence of a signed contract between the owner or his agent and
contractor.

Section 4. That Chapter 160, "Mechanical Code", Section
160.02, "Amendments and additions to code", Subsection 106.3, "Sched-
ule of Permit Fees", Subparagraphs (a) and (c), of the Code of
Ordinances of the City of Delray Beach, Florida, be, and the same is
hereby amended to read as follows:

Ordinances of the City of Delray Beach, Florida, be, and same is
hereby amended to read as follows:
(a) There shall be a minimum fee of SBB?~9 $36.30 for
$1,000.00 or less in construction value plus $}G=99 $17.60 per
required inspection. The fee shall be $BB=89 $36.30 plus
$24.20 for each additional $1,000.00 of construction value over
$1,000.00 or portion thereof as determined by the building department
or by evidence of a signed contract between the owner or his agent
and contractor.
(c) Long-term permit fee. The permit fee shall be
based on $}}?~ $12.10 per $1,000.00 construction cost and shall be
paid at the beginning of the yearly period. Within forty-five (45)
days after the end of the yearly period, the business shall present
to the city a statement of actual costs and shall remit to the city,
or receive a credit for the difference between the projected fees due
and the actual fees due based on actual construction. The holder of

Section 6. That Chapter 164, "Wells; Sprinkler Systems",
Section 164.19, "Permit Fees", of the Code of Ordinances of the City
of Delray Beach, Florida, be, and the same is, hereby amended to read
as follows:
Permit fee to be charged by the City for drilling or
driving a potable well is $~?~ $60.50.
Section 7. That Chapter 164, "Wells; Sprinkler Systems",
Section 164.36, "Permit fees", of the Code of Ordinances of the City
of Delray Beach, Florida, be, and the same is amended to read as
follows:
Permit fees to be charged by the City are as follows:
Permit fee for drilling or driving a well shall be $~=~ $60.50;

and a permit fee for sprinkler, minimum, shall be $~00 $60.50;
plus $5%=99 $12.10 per $1,000.00 of construction cost above
$1,000.00.
Section 8. That Chapter 155, "Electricity", Section
155.18, "Permit fees", Subsections (A) and (C) of the Code of
Ordinances of the City of Delray Beach, Florida be, and the same is
hereby amended to read as follows:
(A) There shall be a minimum fee of $~B=0e $36.30 for
$1,000.00 or less in construction value plus $}&=99 $17.60 per
required-inspection. The fee shall be $B~70~ $36.30 plus
$24.20 for each additional $1,000.00 of construction value over
$1,000.00 or portion thereof as determined by the building department
or by evidence of a signed contract between the owner or his agent
and contractor.
(C) Long-term permit fees.
(l) The permit fee shall be based on $}}=99 $12.10 per
$1,000.00 construction cost and shall be paid at the beginning of the
yearly period. Within 45 days after the end of the yearly period,
the business shall present to the city a statement of actual costs
and shall remit to the city, or receive a credit for the difference
between the projected fees due and the actual fees due based on
actual construction. The holder of the long-term permit shall comply
with Section 108.2(c) regarding inspections for general construction
work and shall call for final inspections for electrical and mechani-
cal work for small projects.
(2) To secure an electrical permit for a state-approved
modular home, the for building the service shall be $~?~0 $36.30.
Section 9. That Chapter 174, "Historic Preservation",
Section 174.32, "Initiation and Procedure", Subparagraph (B), of the
Code of Ordinances of the City of Delray Beach, Florida, be, and the
same is hereby amended to read as follows:
(B) An application for certificate of appropriateness must
be filed no later than ten calendar days prior to any
meeting of the Historic Preservation Board at which
time such application is to be heard. The
applicant shall be filing
pay a fee?-~he -~me~
wh~eh-sha~-be-de~e~m~ed-by-~he-B~e~d-&nd-ap~eved-by
~he-eemm~ss~e~7 of $25.00, and no application will be
accepted by the Board unless it contains all required
and pertinent' information and is accompanied by the
required fee.
Section 10. That should any section or provision of this
ordinance or any portion thereof, any paragraph, sentence, or word be
declared by a court of competent jurisdiction to be invalid, such
decision shall not affect the validity of the remainder hereof as a
whole or part thereof other than the part declared to be invalid.
Section 11. That this ordinance shall become effective on
November 1, 1988.
