AN O.~DINANCE OF ~ C!~"~f COMMISSION OF THE CITY OF
DELRAY BEACH, FLORIDA, AMENDING ORDINANCE NO. 3-84,
PERTAINING TO A ¢0.73 ACRE PARCEL OF LAND, PRESENTLY
ZONED TO THE "SPECIAL ACTIVITIES DISTRICT" (S.k~) AND
LOCATED NORT~ CF LAKE IDA ROAD, BETWEEN- THE E-4
CANAL AND N.W. STH AVENUE, SAID LAND BEING IN
SECTION 8, TOWNSHIP 46 SOUTH, RANGE. 43 EAST, TO
PROVIDE FOR EXTENSION OF CONDITIONAL USE AND SITE
AND DEVELOPMENT PLAN APPROVAL, AND PROVIDING FORT HE
REQUIREMENT OF AM ODIFIE~TRAFPIC STUDY: PROVIDING A
SAVING CLAUSE; PROVIDING A GENERAL REPE~.RH CLAUSE;
PROVIDING .kN EFFECTIVE DATE.
WHEREAS, the City Commission in Ordinance No. 3-84, zunm~ the
property to the "Special Activities District" (SAD) and approved a
conditional use and site and development plan subject to conditions;
and,
%~q{EREAS, the Ordinance No. 3-84 provided that the approval was
l~nited to twenty-four months C24) from the date when all other
approvals for required City bui3a~ng permits .have been receive~; and.
%%~EREAS, the conditional use and site and development plan
granted purs,,a-= to Ordinance No. 3-84 have-expired; and,
W~--/~EAS, the City Commission, purs,~ant to City ordinances,
wishes to extend the time for expiration of the conditional use and site
and development plan approval and to provide for a modified traffic
study.
NOW, THEREFORE, BE iT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF DELRAY BEACH, FLORIDA AS FOLLOWS:
Section 1. That OrdiD~nce No. 3-84 is hereby amended by
repealing Section 4 of Ordinance No. 3-84, and enacting a new time limit
~n the conditional use and site and development plan approval as
follows:
The site and development plan and conditional use granted
pursuant to Ordinance No. 3-84 is here~extende~ for' 18 m~nths from
effective date of this Ordinanc~ No. 150-88, s,abject to the fo!!cwing
additional condition:
The property shall pay its p~o rata share if signalization is
required at the entrance to the development.
Section 2. That Ordinance No. 3-84 is herebF ~mended
repealing Section 2(g) of Ordinance' N~. 3-84-and enacting a new' Sec=ion
2(g~ to read as follows:
The developer shall prepare and-- submit a modified traffic
study related to intersection geometrics simul~ane~ly with
the s,~hmittal of the application for plat approval.
Section 3. All other terms and conditions contained in
Ordinance No. 3-84, not in conflict herewith, remain in full force and
effect.
Section 4. That this ordinance shall becom~ ef fectiv~
immediately upon its passage on second and final reading.
