AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY
BEACH, FLORIDA, REPEALING ORDINANCE NO. 91-86 IN ITS
ENTIRETY; REZONING AND PLACING LAND PRESENTLY ZONED RM-10
(MULTIPLE FAMILY DWELLING) DISTRICT IN SC (SPECIALIZED
COMMERCIAL) DISTRICT, A PORTION OF THE PLAT OF TROPIC
PALMS NO. 1, AS RECORDED IN PLAT BOOK 25, PAGE 99 OF THE
PUBLIC RECORDS OF PALM BEACH COUNTY FLORIDA, TOGETHER
WITH A PORTION OF BLOCK 7 OF DEL RATON PARK, ACCORDING TO
THE PLAT THEREOF AS RECORDED IN PLAT BOOK 14,PAGES 9 AND
10 OF THE PUBLIC RECORDS OF PALM BEACH COUNTY, FLORIDA.
SAID LAND IS LOCATED ON THE SOUTH SIDE OF LINDELL BOULE-
VARD, BETWEEN U.S. HIGHWAY NO. 1 AND DIXIE HIGHWAY, AND
AMENDING "ZONING MAP OF DELRAY BEACH, FLORIDA, 1983".
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF DELRAY BEACH, FLORIDA, AS FOLLOWS:
SECTION 1. That Ordinance No. 91-86 is hereby repealed in its
entirety.
Section 2. That the following described property in the City
of Delray Beach, Florida, is hereby rezoned and placed in the SC
(Specialized Commercial) District as defined in Chapter 30 of the Code
of Ordinances of the City of Delray Beach, Florida, to-wit:
All that portion of the Plat of Tropic Palms Plat No. 1,
as recorded in Plat Book 25, Page 99 of the Public
Records of Palm Beach County, Florida, lying South of
Lindell Boulevard, together with a portion of Block 7 of
DEL RATON PARK according to the Plat thereof as recorded
in Plat Book 14, Pages 9 & 10 of the Public Records of
Palm Beach County, Florida, all being more particularly
described as follows:
COMMENCING at the Northeast corner of the Nort~heast
one-quarter (N.E. 1/4) of Section 32; thence S 89v 44'
35" W., along the North line thereof, a distance of
788.86 feet to a Point of Intersection with the Easterly
Right-of-Way line of Del Raton Boulevard as shown on said
TROPIC PALMS PLAT NO 1 and to the POINT OF BEGINNING;
thence continue S. 890 44' 35" W., continuing along said
North line, a distance of 125.08 feet to a Point of
Intersection with the WesterlYoRight-of-Way of said Del
Raton Boulevard; thence S. 49 59' 00" W., along said
Westerly Right-of-Way, a distance of 121.59 feet to a
Point of Curvature; thence along the arc of a curve to
the right whose radius point bears N. 40° 01' 00" W.
having a radius of 30.00 feet, a central angle of 1376
46' 05", and an arc length of 72.14 feet to a Point of
Tangency; thence N. 07° 45' 05" E., along the Easterly
Right-of-Way of Dixie Boulevard as shown on said plat, a
distance of 51.02 feet to a Point of Intersection with
the North line of said Section 32; thence S 89~ 44' 35"
W., along said North line, a distance of 80.79 feet to a
Point of Intersection with the Westerly Right-of-Way of
said Dixie Boulevard; thence N. 07v 45' 05" E., along
said Westerly Right-of-Way line, a distance of 63.43 feet
to the Southeast corner of said Lot J; thence N. 82° 14'
55" W., along the South line thereof, a distance of
115.00 feet to a Point of Intersection with the Easterly
Right-of-Way line of Old Dixie Highway as shown on said
plat; thence N. 07° 45' 05" E. along said Easterly
Right-of-Way line, a distance of 149.60 feet to a Point
of Intersection with the Southerly Right-of-Way line of
Lindell Boulevard as shown on said plat; thence S. 82°
14' 55" E. along a line parallel with and 50.00 feet
South of the centerline of said Lindell Boulevard, a
distance of 603.04 feet to a Point of Intersection with
the Easterly Right-of-Way li~e extension of said Del
Raton Boulevard; thence S. 49v 59' 00" W., along said
Easterly Right-of-Way line, a distance of 223.53 feet to
the POINT OF BEGINNING.
The subject property is located on the south side of
Lindell Boulevard, between U.S. Highway No. 1 and Dixie
Highway.
The above-described parcel contains a 2.317 acre parcel
of land, more or less.
Section 3. That the Planning Director of said City shall, upon
the effective date of this ordinance, change the Zoning Map of Delray
Beach, Florida, to conform with the provisions of Section 2, hereof.
Section 4. That this ordinance shall become effective
immediately upon passage on second and final reading.
