AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF DELRAY BEACH, FLORIDA, ANNEXING TO THE
CITY OF DELRAY BEACH THAT PART OF THE NORTH
HALF (N 1/2) OF THE SOUTH HALF (S 1/2) OF THE
NORTHWEST QUARTER (NW 1/4) OF THE NORTHWEST
QUARTER (NW 1/4) OF SECTION 25, TOWNSHIP 46
SOUTH, RANGE 42 EAST, PALM BEACH COUNTY,
FLORIDA, WHICH LAND IS CONTIGUOUS TO EXISTING
MUNICIPAL LIMITS OF SAID CITY. SAID LAND IS
LOCATED ON THE EAST SIDE OF MILITARY TRAIL,
APPROXIMATELY 700 FEET SOUTH OF LINTON
BOULEVARD; REDEFINING THE BOUNDARIES OF SAID
CITY TO INCLUDE SAID LAND; PROVIDING FOR THE
RIGHTS AND OBLIGATIONS OF SAID LAND;
PROVIDING FOR THE ZONING THEREOF TO MOI
(MEDICAL OFFICE & INSTITUTIONAL) DISTRICT;
PROVIDING AN EFFECTIVE DATE.
WHEREAS, South County Foundation for Mental Health,
Inc., a Florida corporation, is the fee-simple owner of the
property hereinafter described; and,
WHEREAS, South County Foundation for Mental Health,
Inc., a Florida corporation, has requested pursuant to agreement
dated June 18, 1981, and recorded in Official Record Book 3579,
Page 1235, which agreement was a covenant for annexation running
with the property hereinafter described, to have the subject
property annexed into the municipal limits of the City of Delray
Beach; and,
WHEREAS, the subject property hereinafter described is
now contiguous to the corporate limits of the City of Delray
Beach, thus making said petition for annexation effective at this
time; and,
WHEREAS, the designation of a zoning classification is
part of the annexation proceeding, the City Council has
determined that the procedures set forth in Section 30-23 of the
Zoning Code, which applies to property already in the City
limits, shall not be applicable in annexation proceedings; and,
WHEREAS, the City of Delray Beach has heretofore been
authorized to annex lands in accordance with Section 171.044 of
the Florida Statutes,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. That the City Council of the
Beach, Palm Beach County, Florida, hereby annexes to said City
the following described land lo~ate~ in Palm ~ Cau~y,
Florida, which lies contiguous to said City to-wit:
That part of the North Half (N 1/2) of the
South Half (S 1/2) of the Northwest Quarter
(NW 1/4) of the Northwest Quarter (NW 1/4) of
Section 25, Township 46 South, Range 42 East,
Palm Beach County, Florida, being more
particularly described as follows:
Commence at the Northwest ~orner of said
Section 25; thence, South 0~04'59" East, a
distance of 672.22 feet on an assumed bearing
along the west line of said Section 25 to the
Northwest Corner of said North Half (N 1/2)
of the South Half (S 1/2) of the Northwest
Quarter (NW 1/4) of the Northwest Quarter (NW
1/4); thence, South 89v58'31'' East, a
distance of 50.00 feet, along the north line
of said North Half (N 1/2) of the South Half
(S 1/2) of the Northwest Quarter (NW 1/4) of
the Northwest Quarter (NW 1/4) to a point on
the east Right-of-Way line of Military Trail
an~ the point of beginning; thence, South
89v58'31'' East a distance of 646.14 feet;
continuing along said north line; thence,
South 0~06'01'' East a distance of 336.25 feet
along a line parallel to the east line of the
West Half (W 1/2) of the North Half (N 1/2)
of the South Half (S 1/2) of the Northwest
Quarter (NW 1/4) of the Northwest Quarter (NW
1/4); thence, North 89~57'48" West, a
distance of 661.24 feet; along the south line
of said North Half (N 1/2) of the South Half
(S 1/2) of the Northwest Quarter (NW 1/4) of
the Northwest Quarter (NW 1/4) to a point on
the east Right-ok-Way line of Military Trail;
thence, North 0 04'59" West, a distance of
102.21 feet along the east Right-of-Wa~ line
of Military Trail; thence, North 3 35'12"
East, a distance of 234.36 feet along the
east Right-of-Way of Military Trail, to the
point of beginning.
The subject property is located on the east
side of Military Trail, approximately 700
feet south of Linton Boulevard.
The above-described parcel contains a 5.07
acre parcel of land, more or less.
Section 2. That the Boundaries of the City of Delray
Beach, Florida, are hereby redefined to include therein the
above-described tract of land and said land is hereby declared to
be within the corporate limits of the City of Delra¥ Beach,
Florida.
Section 3. That Section 30-23 of the Zoning Code shall
not apply to the establishment of a zoning classification in this
ordinance.
Section 4. That the tract of land hereinabove

(Medical Office & Institutional) as defined b~ existing/
ordinances of the City of Delray Beach, Florida.
Section 5. That the land hereinabove described shall
immediately become subject to all of the franchises, privileges,
immunities, debts, obligations, liabilities, ordinances and laws
to which lands in the City of Delray Beach are now or may be
subjected and persons residing thereon shall be deemed citizens
of the City of Delray Beach.
Section 6. That this annexation of the subject
property, including adjacent roads, alleys, or the like, if any,
shall not be deemed acceptance by the City of any maintenance
responsibility for such roads, alleys, or the like, unless
otherwise specifically initiated by the City pursuant to current
requirements and conditions.

Section 7. That if any word, phrase, clause, sentence
or part of this ordinance shall be declared illegal by a Court of
competent jurisdiction, such record of illegality shall in no way
affect the remaining portion.
Section 8. That this ordinance shall become effective
immediately upon passage on second and final reading.
PASSED AND ADOPTED in regular session on second and
