AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF DELRAY BEACH, FLORIDA, AMENDING CHAPTER
30, "ZONING", OF THE CODE OF ORDINANCES OF
THE CITY OF DELRAY BEACH, FLORIDA, BY
AMENDING SECTION 30-12 "SC (SPECIALIZED
COMMERCIAL) DISTRICT", (B) "PERMITTED USES"
BY DELETING AS A'PERMITTED USE "BOAT SALES";
BY AMENDING SECTION 30-12 "SC (SPECIALIZED
COMMERCIAL) DISTRICT", (C) "CONDITIONAL USES"
BY ADDING AS A CONDITIONAL USE "BOAT SALES";
BY AMENDING SECTION 30-12 "SC (SPECIALIZED
COMMERCIAL) DISTRICT", (N) "SPECIAL
REGULATIONS" (1)(a) TO DELETE THE WORD
"BOATS"; PROVIDING A GENERAL REPEALER CLAUSE;
PROVIDING A SAVING CLAUSE; PROVIDING AN
EFFECTIVE DATE.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. That Chapter 30, "Zoning", Section 30-12
"SC (Specialized Commercial) District" (B) "Permitted Uses" of
the Code of Ordinances of the City of Delra¥ Beach, Florida, is
hereby amended by deleting the following as a permitted use:
Boat sales
Section 2. That Chapter 30, "Zoning", Section 30-12
"SC (Specialized Commercial) District" (C) "Conditional Uses" of
the Code of Ordinances of the City of Delray Beach, Florida, is
hereby amended by adding the following as a conditional use:
Boat sales
Section 3. That Chapter 30, "Zoning", Section 30-12
"SC (Specialized Commercial) District" (N) "Special Regulations"
(1)(a) of the Code of Ordinances of the City of Delray Beach,
Florida, is hereby amended to read as follows:
(N) Special Regulations
(1) It is the purpose of this commercial zoning
district to provide for commercial uses that
are permanent rather than transitory in
nature, that are conducted within a
completely enclosed building rather than
outside except as follows:
(a) Off-street parking, outdoor dining
facilities, storage and display of
nursery plants~ display of automobiles,
b~a~s? recreational vehicles and trucks,
fruit and vegetable displays, and signs
may be conducted or used outside.
Section 4. That should any section or provision of
this ordinance or any portion thereof, any paragraph, sentence,
or word be declared by a Court of competent jurisdiction to be
invalid, such decision shall not affect the validity of the
remainder hereof as a whole or part thereof other than the part
declared to be invalid.
Section 5. That all ordinances or parts of ordinances
in conflict herewith be and the same are hereby repealed.
Section 6. That this ordinance shall become effective
immediately upon passage on second and final reading.
PASSED AND ADOPTED in regular session on second and
final reading on this the 24th day of March , 1987.
