32-87 F A I L E D - 4/28/87 ORDINANCE NO. 32-87 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AMENDING CHAPTER 29, "WATER AND SEWERS", OF THE CODE OF ORDINANCES OF THE CITY OF DELRAY BEACH, FLORIDA, BY AMENDING ARTICLE III, "SEWERS AND SEWAGE DISPOSAL", BY AMENDING DIVISION 1, "GENERALLY", BY AMENDING SECTION 29-63, "SERVICE RATES AND CHARGES IMPOSED", TO ELIMINATE THE LISTING OF SPECIFIC RATES FOR RESIDENTIAL AND NONRESIDENTIAL SEWER SERVICE AS ASSESSED BY THE SOUTH CENTRAL REGIONAL WASTEWATER TREATMENT. DISPOSAL BOARD; TO PROVIDE THAT SPECIFIC RATES, UPON RATIFICATION BY THE CITY COUNCIL, SHALL BE POSTED IN A CONSPICUOUS LOCATION IN CITY HALL; PROVIDING A GENERAL REPEALER CLAUSE; PROVIDING A SAVINGS CLAUSE; PROVIDING AN EFFECTIVE DATE. WHEREAS, the South Central Regional Wastewater Treatment and Disposal Board periodically increases its rates. WHEREAS, the City of Delray Beach, Florida seeks to implement such rate increases in a timely fashion. WHEREAS, the City of Delray Beach, Florida, wishes to provide notice of the rates and charges to the citizens and residents of the City of Delray Beach, Florida; and, WHEREAS, the City of Delray Beach, Florida wishes to give prompt notice of any such increase in sewage disposal rates as estab- lished by the South Central Regional Wastewater Treatment and Disposal Board to the citizens and residents of Delray Beach, Florida. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA AS FOLLOWS: ~. That Chapter 29, "Water and Sewers", Article III "Sewers and Sewage Disposal", Division 1, "Generally", of the Code of Ordinances of the City of Delray Beach, Florida, be, and the same is, hereby amended by amending Section 29-63, "Service rates and charges imposed", as follows: Sec. 29-63. Service rates and charges imposed. The following ~ rates and charges shall be collected from the users of the City sewage system: (a) Residential dwelling units. A residential dwelling unit is herein defined to be any family living unit, and, where two (2) or more families are living on the same premises, each shall be considered as a separate residential dwelling unit. In apartment buildings, condo- miniums, cooperatives, duplexes, resort dwelling units, and the like, and per each trailer space in a trailer park, each living unit shall be considered a separate residential dwelling unit. A monthly sanitary sewerage service charge is hereby imposed upon each residential dwelling unit, ~s--m~z~-~e~~--se~--f~-he~e~a~e~, to which sanitary sewerage service is available through the facilities afforded by the municipally owned sewerage system, aee~~-~-e~e-{~l~w~i~3-~~. Note: Where no water service is provided, there shall be a monthly customer charge of two dollars and sixteen cents ($2.16) per residential dwelling unit, and the commodity charge shall be based on the maximum of ten thousand (10,000) gallons. (b) Nonresidential/commercial units. Note: For those nonresidential/commercial units where water service is not available, the capacity and commodity charges shall be determined by unit classification standards for water usage. (c) Definitions. As used in this chapter, unless otherwise defined or required by contents, the following words and phrases shall have the meaning indicated: (1) Residential dwelling unit means any family living unit, and, where two (2) or more families are living on the same premises, each shall be considered as a separate residential dwelling unit. ORD. NO. 32-87 (2) Customer charge means the charges calculated to cover the costs incurred in the billing system, which shall include, but not be limited to costs of meter reading, recording, data processing, billing and collecting. (3) Capacity charge means the charges calculated to cover costs incurred to have the system available and in good operating condition without regard to use, which shall include, but not be limited to, costs of minimum personnel, capital outlay, debt service, insurance, transfers, reserve requirements and debt service coverage. (4) Commodity charge means the charges calculated to cover the costs which vary with the level of service provided, the amount of water produced or sewage processed, which shall include, but not be limited to, costs of personnel to operate the system, electricity, repairs and main- tenance, and operating supplies. (d) Sewerage flow determination. The numbe~ of gallons of monthly sewerage flow for residential and nonresidential/ commercial units shall be based upon the water usage for those units as indicated by a water meter, unless a customer installs at no cost to the city a separate meter to measure the actual sewerage flow from the subject unit. A separate meter may be used to measure actual sewerage flow for the calculation of charges only when the location, installation, and type of meter have been approved by the city manager or his designee. (e) When effective. The initial rates for charges shall be effective the first day of the month following the date when the system is constructed, certified for use by the consulting engineer, and accepted by the City. ~. That all ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed. ~. That should any section or provision of this ordinance or any .portion thereof, any paragraph, sentence, or word be declared by a court of competent jurisdiction to be invalid such decision shall not affect the validity of the remainder hereof as a whole or part thereof other than the part declared to be invalid. ~9_Q~.
