Ord 33-13ORDINANCE NO. 33 -13 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DELRAY BEACH, FLORIDA, AMENDING THE CODE OF ORDINANCES OF THE CITY OF DELRAY BEACH, BY REPEALING CHAPTER 119, "VEHICLES FOR HIRE" IN ITS ENTIRETY AND ENACTING A NEW CHAPTER 119, "VEHICLES FOR HIRE" IN ITS PLACE IN ORDER TO ADOPT BY REFERENCE THE PALM BEACH COUNTY CODE PROVISIONS REGARDING SAME; PROVIDING A GENERAL REPEALER CLAUSE; SAVING CLAUSE; AND AN EFFECTIVE DATE. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DELRAY BEACH AS FOLLOWS: Section 1. That should any section or provision of this ordinance or any portion thereof, any paragraph, sentence, or word be declared by a court of competent jurisdiction to be invalid, such division shall not affect the validity of the remainder hereof as a whole or part thereof other than the part declared to be invalid. By adopting this ordinance, the City Commission intends that each part shall be separate frow one another and any part declared to be invalid or unconstitational shall not affect the validity of any remaining portions of the ordinance. I � X-,J City Clerk First Reading t i 1 Second Reading 2 Ord No. 33 -13 ORDINANCE NO. 31 -13 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DELRAY BEACH, FLORIDA, AMENDING CHAPTER 113, "ALCOHOLIC BEVERAGES" OF THE CODE OF ORDINANCES BY AMENDING SECTION 113.15, "HOURS OF SALE AND CONSUMPTION; EXEMPTION ", TO REMOVE THE RESTRICTION OF SELLING ALCOHOLIC BEVERAGES ON SUNDAY MORNING, PROVIDING A SAVING CLAUSE, A GENERAL REPEALER CLAUSE, AND AN EFFECTIVE DATE. WHEREAS, the ordinances of the City of Delray Beach currently prohibits the sale of alcoholic beverages within the City of Delray Beach between the hours of 2:00 a.m. to 12:01 p.m. on Sunday morning.; WHEREAS, this proposed ordinance would allow the sale of alcohol on Sunday morning; WHEREAS, the City Commission of the City of Delray Beach desires to eliminate the current restriction for the sale of alcohol on Sunday morning. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That the recitations set forth above are incorporated herein. Section 2. That Chapter 113, "Alcoholic Beverages ", of the Code of Ordinances is amended by amending Section 113.15, "Hours of Sale and Consumption; Exemption", to read as follows: Sec. 113.15. HOURS OF SALE AND CONSUMPTION; EXEMPTION (A) Hours of Sale and Consumption. NO. 31 -13 ORDINANCE NO. 24-13 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DELRAY BEACH, FLORIDA, AMENDING CHAPTER 33 "POLICE AND FIRE- RESCUE DEPARTMENTS ", SECTION 33.65, "ADMINISTRATION "; TO CLARIFY THE MEMBERSHIP OF THE BOARD; PROVIDING A SAVING CLAUSE, A GENERAL REPEALER CLAUSE, AND AN EFFECTIVE DATE. WHEREAS, the City Commission desires to amend the City Police And Firefighters Retirement System as set forth in Chapter 33 of the City Code to provide that the Mayor, if the Mayor chooses not to sit on the Board, may nominate another person to take hiAer place on the Board, other than the Assistant City Manager; and WHEREAS, any person nominated by the Mayor must comply with Section 32.07, Membership Qualifications/Requirements of the Code of Ordinances. (A) The general administration and responsibility for the proper operation of the retirement system and for making effective the provisions of this subchapter are vested in a Board of Trustees consisting of nine (9) persons as follows: (1) The Mayor; or a Amon nominated by the Mayor who meets the requirements of Section 32.07 of the Code of Ordinances, and approved by the Commission upen &a Mayei (2) Two (2) public members, one of whom may be a City Commissioner, to be appointed by the City Commission as hereinafter provided; (3) The Fire Chief or a firefighter (with a minimum rank of Chief Officer) designated by the Fire Chief; Police Chicf; (5) Two (2) members of the Fire Department to be elected as hereinafter provided; (6) Two (2) memben of the Police Department to be elected as hereinafter provided (B) The term of office of each appointed and elected trustee shall be two (2) years except that the initial terms within each category above shall be for two (2) and three (3) years. The initial terms shall commence on the effective date of this system. Initially in each elective category, the trustee receiving the most votes shall serve a three -year term, the second most votes a two-year term. Section 2.
