AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF DELRAY BEACH, FLORIDA, AMENDING CHAPTER
30, "ZONING", OF THE CODE OF ORDINANCES OF
THE CITY OF DELRAY BEACH, FLORIDA, BY
AMENDING SECTION 30-18 "OFF-STREET PARKING
REGULATIONS", (C) "DESIGN AND LANDSCAPING",
(1) "DRIVEWAYS, PARKING ACCESS, BACKOUT
PARKING, DEAD-END PARKING", BY REPEALING
SUBPARAGRAPH (b) IN ITS ENTIRETY, AND
ENACTING A NEW SUBPARAGRAPH (b) TO PROVIDE
THAT EACH PARKING SPACE SHALL HAVE ACCESS TO
A STREET OR ALLEY, PROVIDING FOR MINIMUM
DESIGN STANDARDS FOR SAID ACCESS, PROVIDING
FOR EXCEPTIONS IN CERTAIN SITUATIONS,
PROVIDING FOR THE PROHIBITION OF PARKING
AREAS WHICH FORCE THE MOTORIST TO BACK ONTO A
THROUGH STREET, PROVIDING A DEFINITION OF
THROUGH STREET FOR PURPOSES OF THIS SECTION,
AND PROVIDING FOR EXCEPTIONS TO THE
APPLICATION OF THE DEFINITION OF A THROUGH
STREET UNDER THE ADMINISTRATIVE RELIEF
PROCESS; PROVIDING A GENERAL REPEALER CLAUSE;
PROVIDING A SAVING CLAUSE; PROVIDING AN
EFFECTIVE DATE.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. That Chapter 30, "Zoning", Section 30-18
"Off-Street Parking Regulations", (C) "Design and Landscaping",
(1) "Driveways, Parking Access, Backout Parking, Dead-End
Parking", subparagraph (b) of the Code of Ordinances of the City
of Delray Beach, Florida, be, and the same is hereby re~ealed in
its entirety, and a new subparagraph (b) is hereby enacted to
read as follows:
(b) Each parking space shall have access to a
street or alley. Said access must conform
with minimal aisle standards and shall
include maneuvering areas so that a vehicle
must be able to enter and exit the parking
area in a forward manner, except in the
following situations:
(1) When the land use is a single family
dwelling or a two-family (duplex)
dwelling;
(2) When the pa~king is adjacent to an alley
and the pa~king space has a minimum
depth of twenty-five (25) feet and a
minimum width of ten (10) feet and the
location of parked vehicles does not
impair sight distance of pedestrians or
vehicles utilizing the alley.
This subparagraph is intended to prohibit the
design of parking areas Which force the
motorist to back onto a through street in
order to leave. For the purpose of this
section, a through street is defined as a
one-way or two-way road having one or more of
the following characteristics:
(1) Is contained within a right-of-way;
(2) Can be distinguished from an area used
exclusively for parking in that it
serves as a conductor of traffic for a
significant number of through vehicles;
(3) Carries a majority of the traffic of a
development; this includes, but is not
limited to, entrance and exit ways, and
primary networks for internal
circulation of traffic;
(4) Allows traffic to travel through the
development from one public or private
street to another;
(5) Is not an alley.
In specific instances, exceptions to the
application of the above definition of a
through street may be approved under Sec.
30-18(F) "Administrative Relief."
Section 2. That all ordinances or parts of ordinances
in..conflict herewith be, and the same are hereby repealed.
Section 3. That should any section or provision of
this ordinance or any portion thereof, any paragraph, sentence,
or word be declared by a Court of competent jurisdiction to be
invalid, such decision shall not affect the validity of the
remainder hereof as a whole or part thereof other than the part
declared to be invalid.
Section 4. That this ordinance shall become effective
immediately upon passage on second and final reading.
PASSED AND ADOPTED in regular session on second and
