RESOLUTION NO.03-14
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
DELRAY BEACH, FLORIDA, SUPPORTING LEGISLATION THAT
REQUIRES FEMA TO COMPLETE THE NATIONAL FLOOD
INSURANCE PROGRAM AFFORDABILITY STUDY AND
SUPPORTING ALL LEGAL ACTIONS FILED BY THE STATE

REGARDING SAME; PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Congress created the National Flood Insurance Program (NFIP) in 1968 to make
affordable flood insurance available to homeowners, renters, and business owners in exchange for using
Federal Emezgency Management Agency= (FEMA) generated and specified Flood Insurance Rate Maps
(FIRIAS) for floodplain management by a participating corx munity; and
WHEREAS, today, businesses and homeowners in 22,000 communities in all states and territories
have made plans and imTestia-tents based on the existence of affordable flood insurance with 5.6 nvllton NFIP
policies providing over$1.2 trillion in coverage; and
WHEREAS, in July 2012, the Biggert-Waters Flood Insuuance Reform Act of 2012 (BW-12) was
enacted (PL 112-141) in order to assure the solvency of the highly indebted NFIP; and
WHEREAS, BW-12 requites FEIvIA to adjust flood insurance premiums to reflect true flood risk and
phase out subsidies for properties built before the convnunityr adopted its frtst FIRM; and
WHEREAS, BW-12 requires FEMA to complete an affordability study and to establish an
affordability frame-work for the NFIP, vI ch is not yet complete;and
WHEREAS, the undersigned City/Town supports Legislation that requires FEIVL), to complete the
NFIP affordability study; and
WHEREAS on November 11 2013 Flolada Governor Rick Scott and Florida Attorney General,
Pamela Jo Bondi joined with other states 'in stung FEMA as a result of FEMA s failure to complete the
affordability study;and
WHEREAS, Florida accounts for the lazgest share of NFIP policies, with over 2 1.11llion properties
insured through the program; and
WHEREAS, at least 5,000 properties in Delray Beach, Florida are affected by the BW-12.

NOW, THEREFORE, BE IT RESOLVED, the City of Delray Beach supports legislation that
requites FBI\ V to complete the NFIP affordability study and supports all legal action regarding same and
further directs the City Manager and City Clerk to file this resolution with appropriate federal and state
governmental and othet authorities/entities in order to snake public dhe City's declaration as set forth
hereinabov e.
Section 1_ The-recitals are incorporated as if fLdly set forth herein.
Section 2. This resolution shall tape effect immediately upon adoption.

A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
DELRAY BEACH, FLORIDA, .AUTHORIZING THE CITY TO
TRANSFER TO PALM BEACH COUNTY CERTAIN REAL PROPERTY
IN PALM BEACH COUNTY, FLORIDA, AS DESCRIBED HEREIN,
HEREBY INCORPOI'.ATING THE CONTRACT STATING THE TERMS
BETWEEN THE CITY OF DELRAY BEACH AND PALM BEACH
COUNTY, FLORIDA, DATED NOVEMBER 12, 2002.
WHEREAS, the City of Delray Beach, Florida, wishes to transfer certain property located at 100 West
Atlantic Avenue, Delray Beach, to Palen Beach County pursuant to the Agreement between the parties dated
November 12, 2002 for the purpose of clearing tide; and

WHEREAS, it is in the best interest of the Ci"T of Delray Beach, Flozida, to transfer said property.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF
DELRAY BEACH, FLORIDA,AS FOLLOWS:
Section 1. That the City Commission of the City of Delray Beach, Florida, as Seller, hereby agrees to
transfer property to PaIrn Beach County, as Buyer, for the purchase pKice of Ten Dollars ($10,00), and odler
good and valuable consideration; said parcel being more particularly described as follows:
North eight feet (8') of South sixteen feet (16') of Tract "A", South County
Courthouse Complex Expansion Plat, as recorded ire Plat Book 117, Page 11,
Public Records of Palm Beach County, Florida.
Section 2. That the terms and conditions contained iil the Agreement between the City of Delray
Beach and Pahn Beach County dated November 12, 2002 are lrncorporated herein as Exl-.bit".A".
PASSED AND ADOPTED in regular session on the IS"' day of March, 2014.
