Commissioner Alson Jacquet was absent SPECIAL MEETING AGENDA Pursuant to Section 3.12 of the Charter of the City of Delray Beach the Mayor has instructed me to announce a Special Meeting of the City Commission to be held for the following purposes. 1. Public Comments (It was the consensus of the Commission to combine Items SP. 2 and SP. 2.A) 2. DISCUSSION OF THE INVESTIGATIVE REPORT OF THE OFFICE OF THE INSPECTOR GENERAL#2014-0005 DATED MAY 5, 2014 A. DISCUSSION OF THE MEMORANDUM OF CORRECTIVE ACTION FROM THE OFFICE OF THE INSPECTOR GENERAL DATED MAY 6, 2014, INCLUDING DISCUSSION OF PARAGRAPH 1. "TAKE CORRECTIVE PERSONNEL ACTION DEEMED APPROPRIATE." THIS DISCUSSION SHALL INCLUDE DISCUSSION ABOUT THE CONTINUED EMPLOYMENT OF THE CITY MANAGER PER SECTION 4.02(B) "REMOVAL" OF THE CITY'S CHARTER. (First motion to terminate Louie Chapman, Jr., City Manager, effective immediately for just cause for the criteria as laid out in his employment agreement, Subsection 12.C.1., "Misfeasance, Malfeasance and/or Nonfeasance in Performance of his City Duties and Responsibilities", Subsection 12.C.4., "Violation of Any Substantive City Policy, Rule,or Regulation, which would Subject any City Employee to Termination", Subsection 12.C.5., "The Commission of any Fraudulent Act Against the Interest of the City" and Subsection 12.C.7.,"Violation of State or Local Ethics Laws and Codes";Approved, 3-1. Commissioner Frankel dissenting. Second motion to suspend Mr. Chapman for just cause for ninety (90) days with pay effective immediately and direct the Office of the Inspector General (OIG) to conduct a report as to Mr. Chapman's other actions for violations of just cause pursuant to his employment agreement Subsection 12.C.1., "Misfeasance, Malfeasance and/or Nonfeasance in Performance of his City Duties and Responsibilities", Subsection 12.C.4., "Violation of Any Substantive City Policy, Rule, or Regulation, which would subject any City Employee to Termination", Subsection 12.C.5., "The Commission of Any Fraudulent Act Against the Interest of the City", Subsection 12.C.7., "Violation of State or Local Ethics Laws and Codes" and Subsection 12.C.8., "Any Other Act of Similar Nature of the Same or Greater Seriousness";Approved,3-1. DISCUSSION REGARDING THE ENGAGEMENT OF A CONSULTANT TO PREPARE PROCUREMENT DOCUMENTS FOR SOLID WASTE COLLECTION SERVICES: Commission discussion regarding the engagement of a consultant to prepare procurement documents for solid waste collection services. (It was the consensus of the Commission that this item be brought back to the May 20,2014 Regular Meeting with a recommendation from staf) 4. NOMINATION FOR APPOINTMENT TO THE DELRAY BEACH HOUSING AUTHORITY: Nominate one (1) regular member for appointment to the Delray Beach Housing Authority to serve a four year term ending March 6, 2018. Based upon the rotation system, the nomination/recommendation for appointment will be made by Commissioner Frankel (Seat #3).
