AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF
DELRAY BEACH, FLORIDA, AMENDING CHAPTER 117,
"LANDLORD PERMITS", OF THE CODE OF ORDINANCES, BY
AMENDING SECTION 117.02, "PERMIT FEES", TO PROVIDE FOR
AN INCREASE IN THE LANDLORD PERMIT FEE; PROVIDING A
SAVING CLAUSE, A GENERAL REPEALER CLAUSE, AND AN
EFFECTIVE DATE.
WHEREAS,the City wishes to increase the landlord permit fee.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF DELRAY BEACH,FLORIDA,AS FOLLOWS:
Section 1. That Chapter 117, "Landlord Permits", of the Code of Ordinances is amended
by amending subsection 117.02, "Permit Fees", to read as follows:
Sec. 117.02 PERMIT FEES.
Applications for a landlord permit shall be available through the Community
hnprovement Department. The annual permit fee shall be 4x-t7 seventy-fve dollars ($60
75.00) per unit. Such permit fee shall be for one year from the date of issue on November 1
of each year. This fee shall not be prorated.
Section 2. That should any section or provision of this ordinance or any portion thereof,
any paragraph, sentence, or word be declared by a court of competent jurisdiction to be invalid, such
decision shall not affect the validity of the remainder hereof as a whole or part thereof other than the
part declared to be invalid.
Section 3. That all ordinances or parts of ordinances in conflict herewith be, and the same
are hereby tepealed.
Section 4. That this ordinance shall became effective imt-nediately upon its passage on
second and final reading.

BACKGROUND
On June 3, 2014, the Commission approved Ordinance No. 20-14.
Legal Department Review: Ordinance No. 20-14 was published in the Palm Beach Post newspaper on
Friday, June 6, 2014 in compliance with advertisement requirements.
Finance Department Review: Finance recommends approval.
Discussion: This ordinance is before Commission for second reading to consider an amendment to
Chapter 117, "Landlord Permits", of the Code of Ordinances, by amending Section 117.02, "Permit
Fees", to provide for an increase in the landlord permit fee.
Operating Costs: If the Ordinance is approved, the City will realize an increase in revenue of
$100,000.
Timing of the Request: The timing of the Ordinance is coordinated with the annual renewal of the
Landlord Permits, which is November 1 st. The renewal notices are scheduled to be sent out on
September 2, 2014.
RECOMMENDATION
Staff recommends approval of Ordinance No. 20-14 on second and final reading.

BACKGROUND
A landlord permit is required for rental property owners. The annual permit fee is for one year
from the date of issue on November 11t of each year and is available through the Community
Improvement Department. This fee is not prorated.
The last increase in the City's Landlord Permit fee was in 2009. This ordinance modifies
Chapter 117, Section 117.02 by increasing the fee from $60.00 per unit to $75.00 per unit.
Staff surveyed other municipalities with similar programs to determine if our current fee was
within the norm. Our review indicated that the Delray Beach fee is one of the lowest charged,
In addition, we considered the new programs offered via the Rental Inspector position that are
made available to investor properties to assist in meeting the standards for rental properties as
desired by the community that far exceed what is being offered by others. Raising the fee will
bring the City of Delray Beach to a more equitable rate with other municipalities and ensure
we are able to continue providing the education and technical assistance programs designed
to achieve the City's goal of quality neighborhoods.
Legal Department Review:
This item complies with all applicable laws and ordinances.
