Res 05-00RESOLUTION NO. 5-00 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DELRAY BEACH, FLORIDA, SETTING A PUBLIC HEARING DATE FOR THE PUBLIC HEARING REGARDING THE CONSIDERATION OF THE SEACREST/DEL-IDA SPECIAL ASSESSMENT DISTRICT; PROVIDNG FOR THE MAILING AND PUBLICATION OF NOTICE REGARDING THE PUBLIC HEARING; PROVIDING AN EFFECTIVE DATE. WHEREAS, at the January 4, 2000 meeting, the City Commission declared a necessity for the improvement of the Seacrest/Del-Ida Neighborhoods through the adoption of Resolution 1-00; and WHEREAS, at the April 18,2000 meeting, the City Commission further declared a necessity for the improvement of the Seacrest/Del4da Neighborhoods by amending the original Resolution of Necessity and adopting a revised Resolution of Necessity through the adoption of Resolution 34-00; and WHEREAS, pursuant to the requirements of the state law and the City's Land Development Regulations, a preliminary assessment roll was prepared showing the lots to be assessed and the amount of the assessments; and WHEREAS, the City Commission must provide notice of the assessments and hold a public hearing prior to the adoption of the preliminary assessment roll. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DELRAYBEACH, FLORDIA, AS FOLLOWS: Section 1. That a public hearing shall be holed on June 6, 2000 at 7:00 p.m. at the Delray Beach C~ty. Hall C~ty Commission Chambers, 100 N.W. 1st Avenue, Delray Beach, Florida 33444. At the public hearing, owners of the property to be assessed or any other persons interested therein may appear before said governing authority and be heard as to the propriety and advisability of making such improvements. Section 2. That the City Clerk shall mail notice of the public hearing to each property owner listed in the preliminary assessment roll. Section 3. That the City Clerk shall publish notice of the public hearing in a newspaper of general circulation within the county. Section 4. WHEREAS, the Cxty Commission of the City of Delray Beach is authorized to impose special assessments pursuant to Article 8.4 of the C~ty of Delray Beach Land Development Regulations and Chapter 170 of the Florida Statutes; and WHEREAS, the Cxty Commission finds that there is a need for the ~_rnprovement m the Seacrest/Del-Ida neighborhoods; and WHEREAS, the special assessment district will encompass the area as shown on Exhtbit "A" to tins resolution, a copy of which is on file in the Office of the City Clerk for the City of Delray Beach; and WHEREAS, the area in which the improvements wall be performed shall be known as the Seacrest/Del-Ida Special Assessment District ("Assessment District"); and WHEREAS, the owners of property w~thm the Assessment District requested the City perform these maprovements; and WHEREAS, the proposed improvements include water mare upgrades by the City; the purchase of land and construction of parking lots by the Community Redevelopment Agency ("CRA"); the installation of sxdewalks with driveway aprons on certain streets, the installatton or repaying of parking areas in certain areas, the installauon of roundabouts m certain areas, the installation of landscaping mechans on certain streets, the installation of general landscaping, the regradmg of swales in certain areas and other related ancillary improvements (referred to as Nmghborhood Improvements and shown on Exhibit "B") as generally in accordance with the Seacrest/Del-Ida Park Nmghborhood Plan adopted by the C~ty Cornmass~on on March 3, 1998 and on file in the C~ty Clerk's Office; and WHEREAS, the water main upgrades, as shown on Exl:nbit "B", which are reqtured at this time to minmuze the disruption of the right-of-way, shall be paid by the City in addition to its share of the Neighborhood Improvements; and WHEREAS, the cost of the purchase of land and the construction of parking lots on the land is a cost that shall be paid by the CRA; and WHEREAS, the total cost of the Neighborhood Improvements are esmmated not to exceed the amount of $1,543,900.50 and the total cost to be assessed to the property owners shall not exceed half of that amount or $771,950.24; and WHEREAS, the C~ty Commission directs City staff to place on file in the City Clerk's Office specifications and cost estimates for the improvements; and WHEREAS, the property owners may pay the special assessment m one lump sum no later than 60 days following final consideratmn of the special assessment after construction is completed or the property owners may pay the assessment in ten (10) annual installments at an mterest rate of 8%; and WHEREAS, the lands upon which the special assessment shall be levied are all lots and lands adjoining and contiguous or bounding and abutting upon the maprovements or specifically benefited thereby and further designated by the map attached hereto as Exhibit "A"; and WHEREAS, the City Manager shall prepare and present to the Commission an assessment roll showing the lots and lands t be assessed and the mount of the assessment as to each. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That the City Commission hereby declares a need for the public improvements within the special assessment chstrict m conformance wxth the above recxtals and for the imposition of a specxal assessment m conformance with thts resolution. Section 2. That this resolutton shall take effect Lmmediately upon passage.
