Pursuant to Section 3.07 of the City Charter of the City of Delray
Beach, Florida, Mayor Thomas E. Lynch has instructed me to advise you
of a Special Meeting of the Commission to be held in the Commission
Chambers at 6 P.M. on Wednesday, November 7, 1990.
This meeting has been called for the purpose of considering the
following:
SPECIAL MEETING AGENDA
1. Appointments to the Board of Construction Appeals. Mayor's
appointment of a member to the general contractors position to a term
ending August 31, 1992; and Seat 3 appointment of a member to the
master plumber position to a term ending August 31, 1991.
2 . Appointment to the Board of Adjustment. Seat 3 appointment of a
regular member to the Board of Adjustment to fill the unexpired term
of Anthony Veltri to a term ending August 31, 1992.

Referendum Election held on November 6, 1990, for the City of Delray
Beach's Charter Amendment, which showed:

SUBJECT: APPOINTMENTS OF GENERAL CONTRACTOR AND MASTER PLUMBER
TO THE BOARD OF CONSTRUCTION APPEALS
DATE: November 2. 1990
On August 28. 1990. October 9. 1990 and October 23. 1990. some
appointments were made to the reconstituted Board of Construction
Appeals. The appointment of a general contractor was deferred along
with other appointments to the Board on October 23. 1990. Some
applications have been received.
The following general contractors have submitted their names and
resumes for consideration and are attached: Dominick Sarlo and
William Stone. An application has been sent to John Gwynn who has
expressed an interest in appointment. The appointment would be made
by Mayor Thomas Lynch. (Seat #5). This appointment was deferred from
the Commission Meetings of October 9. 1990 and of October 23. 1990.
The following certified plumbing contractor has submitted his name and
resume for consideration and is attached: Carney L. Wilder. Jr. The
appointment would be made by Commissioner William Andrews. (Seat #3).
The Land Development Regulations. adopted on September 25. 1990.
states the following: "The composition of the Board shall be as
follows: two (2) general contractors; one (1) master plumber; one (1)
architect; one (1) master electrician; one (1) air conditioning
contractor; one (1) sign contractor; one (1) real estate broker or
insurance agent; and one (1J professional engineer.
In order to qualify for membership. "A member shall either be a
resident of or own property in the city/and or own a business within
the City except for appointees of the Board of Construction Appeals
who need not meet this qualification. Additional qualifications may
be established for individual boards. "

SUBJECT: APPOINTMENT OF A REGULAR MEMBER TO THE BOARD OF ADJUSTMENT
DATE: November 2, 1990
With the resignation of Anthony Veltri, there is an opening on the
Board of Adjustment for a regular member.
Robert Moore, an alternate, would like to be considered for the
position of regular member. Milford Ross would like to remain an
alternate. Other persons who have submitted their names and resumes
for consideration are as follows: John G, Baccari, currently serving
as a member of the Board of Construction Appeals, Scott Bechtle, ~ark
David, I II , Marc Shepard, Sidney Soloway and Horace Waldman.
The Board shall consist of five (5) regular members and two (2)
alternates.

DELRAY BEACH SCHOOLS/EDUCATION BOARD -
BACKGROUND:
The Education Board, in its advisory capacity to the City
Commission, has as one of it's major activities for Fiscal Year
90/91, the development and dissemination of a Marketing Brochure
for Delray Beach Schools. The City Commission has provided for a
$10,000 dollar budget allocation to assist in the cost of this
brochure and has further authorized the board to solict
additional funding required from private and public entities such
as the Board of Real tors and the Chamber of Commerce.
The Board has received complimentary services from Dean, Oliver
and Dustin Promotional Design Company on a proposed design and
theme for the Commission's consideration. Ms. Alison Oliver,
representing the company will assist in the presentation to the
Ci ty Commission.
RECOMMENDATION:
The Education Board is requesting that the City Commission
positively consider the proposed brochure design and theme as
presented by the Board and Promotional Company for the "Marketing
Brochure on Delray Beach Schools," provide direction to the Board
on any changes required and direct the Board to proceed with the
Development of the approved brochure within an established time
period.

At your September 25th regular meeting the Commission, by consensus,
agreed to workshop this item and suggested that members of the Women's
Club attend that workshop meeting. Staff has contacted members of the
Women's Club and they will be present at your Wednesday evening
meeting to discuss the parking lot paving issue. As you are aware the
Women's Club had initially requested that the City assume the total
cost to pave the parking area adjacent to their building.
Subsequently, the Women's Club agreed to pay $2,500 of the estimated
$8,300 cost for resurfacing the parking area. A detailed staff
memorandum and the estimate for resurfacing is attached as backup
material for this item.

Commission is requested to reconsider approval of request from the
Womenls Club to resurface the parking lot at this site.
BACKGROUND
At the direction of City Commission staff contacted members of the
Womenls Club to ascertain whether they would be willing to give this
facility back to the City with the understanding that they could use
the building without charge whenever they needed it. They were not
willing to do this but still request that the City repave the parking
lot. Mrs. Zulla Cook indicated, however, that the Womenls Club would
pay $2,500.00 to offset the cost to the City. The bid for this
project was updated and the total cost is now estimated at
approximately $8,300 and can be contracted through a County
resurfacing contract with Charles S. Whiteside, Inc. City funding
needed for this project would be approximately $5,800 and is available
from account number 334-3162-541-60.53.
As previously discussed with Commission the City leased the land to
the Womenls Club in 1948 for $1.00 per year. The City does not own
the structure and by lease agreement we are responsible for grounds
maintenance.

I have met with Charles S. Whiteside, Inc. , who is paving
our golf course, at the above referenced project. We
measured the parking lot and verified the calculations
prepared by the engineering department.
The project includes the resurfacing of approximately 147
tons of asphalt. The estimated construction cost using the
Palm Beach contract price is $8,232.00. Whiteside will do ~"
the job under the current contract price with the County at
$56/ton. I have attached a copy of the contract for your
information. All additional work shall be compensated at
the rates listed in the bid #89-028/TE or by the approval of
the City Manager.
Please advise of approval so I can notify the contractor.

This item was discussed at your October 23rd regular meeting and by
consensus, deferred to a workshop meeting.
This proposed Ordinance amends the Land Development Regulations by
amending Section 4.6.13 uParking and Storage of Commercial Vehicles,
Boats, Trucks, and Similar Vehicles". This ordinance provides that
restrictions on truck parking shall be applicable in all residential
zoning districts. Panel, pickup, van and similar type trucks, not
over 3/4 ton rated capacity are allowable in all residential zone
districts. However, an exception has been made for R-1A (Single
Family Residential District) to permit vehicles with a rating up to
one ton capacity. An additional provision, that no more than two such
vehicles shall be parked on a plot, is also included.
The Planning and Zoning Board at their October 15th meeting
recommended approval, A detailed memorandum is attached as background
material for this item.

ACTION REQUESTED OF THE COMMISSION:
The action requested of the City Commission is that of
approval of a text amendment to the LDRs. The affected
Section is 4.6.13 and the subject is truck parkinq in
residential districts.
After first reading, the ordinance is set for a public
hearing and subsequent enactment.
BACKGROUND:
This subject was raised by the City Commission in response to
some specific complaints about truck parking in residential areas
and about an adverse situation with respect to truck parking on
lots in R-1-A zone district.
Initial direction was to examine the truck parking requirements.
Attached is a staff (Code Enforcement) memorandum which provides
a good background and analysis of the current requirements.
Additional input was received from the Neighborhoods Task Team
and from the Homeowners League of Chatelaine, Inc.
Please refer to the P&Z Staff Report for copies of those
documents and an analysis of the issue.
PLANNING AND ZONING BOARD CONSIDERATION
The Planning and Zoning Board formally reviewed this item at its
meeting of October 15, 1990. Following consideration of
additional public testimony, the Board (on a unanimous vote)
recommended that the existing regulations be amended to
accommodate the following:
* That in the R-1-A Zone District, the restrictions shall
apply to trucks of greater than one ton capacity.

Thus, Section 4.6,13(B)(1) would be amended as follows:

ITEM BEFORE THE BOARD:
The action requested of the Board is that of forwarding a
recommendation to the City Commission on proposed changes to
the LDRs. The specific Section.s 4.6.13 and the subject
matter deals with parking of trucks on private property.
Section 1.1.6(A) provides that prior to action on a proposed
amendment to the LDR~ a recommendation is obtained from the
Planning and Zoning Board.
BACKGROUND:
The City of Delray Beach has similar parking restrictions for
trucks on private property as do,; , other communities. In July,
1985, the Delray Beach Code was amended to exclude such parking
restrictions in the R-1-A zone district. Due to complaints of
truck parking being brought to the attention of the City
Commission, it directed that the truck parking regulations be
examined.
Attached is a memorandum from Richard Bauer, Code Enforcement
Administrator, which provides more information on the subject.
Also attached is a letter from the Homeowners League of
Chatelaine, Inc. and a memo (via Lula Butler) from the
Neighborhoods Task Team on this subject.
SUMMARY OF POSITIONS:
The Administration initially recommended that the text be changed
by deleting the exception for R-1-A property.

throuqh a hardship determination process.
The Homeowners League of Chatelaine requested that their
subdivision, by virtue of its R-I-AB zoning, have more strinqent
requirements.
ANALYSIS AND COMMENTS:
The positions which call for modifying the R-1-A exception from
being total to allowing trucks up to one ton can be readily
accommodated; in that, they simply apply an existing regulation
more equally throughout the City.
Accommodating a relief process presents concerns. First, it has
not been needed in the past (albeit, in the area where one might
be sought the restriction didnlt apply). Second, if applied, it
should be available in all zoning districts; thus, creating
opportunities and potential problems which donlt presently exist.
Third, it should have specific criteria established. These
criteria could range from:
a) economic hardship of the truck owner
b) imposition of buffering requirements which exist for
boats and recreational vehicles [Subsection (B)(3)]
c) circumstances under which an exception would be made.
It is the Directorls position that if a change is to be made;
that it be made; and that if it presents problems, the reason for
the problems should either be corrected or the exception
reinstated.
The subject of imposinq more restrictions also raises concerns.
The definition of what constitutes "open" storage and how this
additional restriction pertains to other regulations dealing with
recreational vehicles, boats, etc. must be addressed. The
request also included motorcycles which, while noisy, do not
present the same visual impact situation which is being regulated
by the code. Whether or not a complete prohibition of all
vehicles other than standard automobiles can be applied (through
zoning regulations) in selective subdivisions is a concept which
is administratively workable but its legality needs review.
The key concept, I believe, is that of general applicability.
Thus, I support bro&,.d regulations which apply to all zoning
districts.

(B) Pe~..ible Parkinq:
( l) Trucks: Restrictions on truck parking shall be
applicable in all residential zoning districts other than R-IA
and shall permit only panel, pickup, van, and similar type
trucks, not over 3/4 ton rated capacity. Such vehicles may only
be parked on a plot improved with a residence, and must be used
by a resident of the premises.
(2 ) One boat, one boat trailer, and one recreational
vehicle may be parked in a garage or carport which 1s effectively
screened on three sides, provided no portion of the boat, boat
trailer, or recreational vehicle extends beyond the roof line.
( 3) One boat, one boat trailer, and one recreational
vehicle may be parked in the side or rear yard provided the plot
is occupied by a permitted structure. Such boat, boat trailer,
or recreational vehicle shall be effectively screened against
direct view from abutting properties in the following manner: by
a masonry wall, ornamental fence, or dense hedge, six feet high
or equal to the height of the vehicle if the vehicle is less than
six feet high. If a hedge is used as the method of screening,
the hedge should be three feet at the time of planting and should
be of a variety which can reasonably be expected to reach the
required height within two years. This regulation is not to be
construed as requiring screening from direct view from the street
in front of the plot.
(4 ) Such boat, boat trailer, or recreational vehicle
must be owned and used by a resident of the premises.
( 5 ) No boat or recreational vehicle which is parked in
a residential district shall be occupied or used for living,
sleeping, or housekeeping purposes, nor shall it be connected to
any utility service.
( 6 ) A boat, boat trailer, or recreational vehicle may
be parked only if it is currently registered as required by state
or federal law, and if the transportation of the vehicle is in
compliance with F.S. Chapter 317.
(7 ) One boat, one boat trailer, or one recreational
vehicle may be parked in the front driveway for a 24-hour period
for the purpose of loading or unloading.
( 8 ) No boat, boat trailer, or recreational vehicle
shall be parked in the area between the street and the structure,

The suggested language for the recommendation is:
To amend Section 4.6.13(B)(1) by adding a new second
sentence which reads - "In the R-1-A Zone District, the
restrictions shall apply to trucks of one ton, or greater,
capacity" .
RECOMMENDED ACTION:
Review and comment, as deemed appropriate, and then provide a
recommendation to the City Commission.

zoning districts was reviewed by the Neighborhood Task Team on
Thursday, October 4th. They have requested that P & Z consider
the following as possible amendments to the language that is
before them at your October 8th meeting:
For all R-1A districts, the truck rated capacity be
increased from 3/4 ton to one (1) ton, and
Consideration be provided for a "hardship determination"
within the ordinance. They further recommend that the
"hardship determinations" be heard by the City Commission
and that City staff be responsible for providing the
Commission with factual information to establish such
hardships.

answer any questions the Board members may have regarding the
Neighborhood Task Team recommendations.

SUBJECT: NUISANCE ABATEMENT NOTICE MAILING PROCEDURES AND COSTS
DATE: September 25, 1990
For the period October 1, 1989 to September 25, 1990, the Code Enforcement
Division has issued 4,072 Notices of Nuisance Abatement violations. As we mail
the above notices by first class at $.25/each, the total mailing cost amounted
to $1,018.
The current cost to mail certified, return receipt is $2.00 for the first ounce,
If we had to mail the above 4,072 notices by certified mail, the cost would have
been $8,144.
In addition to the increased cost, if we changed to certified mailing, there
would be increased clerical processing time for each file:
. Green certified return tickets have to be completed (hand written)
with names, addresses and case numbers.
. Incoming green tickets will need to be sorted, matched and attached to
file documents.
In addition to the above, do we measure the compliance period from the date of
mailing, the date the green ticket is signed or the date the green ticket is
received in the office? How long do we wait for a green ticket to be returned
before proceeding?
Code Enforcement staff responsible for processing Nuisance Abatements estimate
that no more than 10 property owners claimed to have not received initial notices
during the past fiscal year. The aforementioned 10 claims represent .2% of the
total notices mailed. Roughly half of those claiming non-receipt indicated they
moved but we then checked with Palm Beach County and found that these owners did
not change their address on the Palm Beach County tax records.
SUMMARY
1. Cost analysis to change mailing from First Class to Certified, return
receipt, based on past fiscal year volume:
Cost to mail 4,072 notices First Class = $1,018
Cost to mail 4,072 notices Certified, Return Receipt = $8,144
Cost Increase = $7,126

SUBJECT: NUISANCE ABATEMENT PROCEDURES
DATE: September 13, 1990
Recently, two property owners appeared before the City Commission to request
waiver or reduction in nuisance abatement charges. In one case, the property
owner denied receiving the initial notice (but did receive the invoice which our
records indicate was mailed to the same address as the original notice). In the
other case, the property owner acknowledged receiving the notice but claimed the
matter was under discussion with another City employee outside the Code
Enforcement Division. In neither of the above cases were there any errors
committed in the processing of the cases by the Code Enforcement Division. Both
of the above cases were referred to the City Attorneyls office because the
property owners threatened law suits against the City.
I have heard that some allegations have been made that Code Enforcement has
performed Nuisance Abatements without first notifying the appropriate property
owners. This allegation, if made, is simply not true. For the period October
1, 1989 to September 30, 1990, I estimate that Code Enforcement will have issued
between 3500 and 4000 Nuisance Abatement Violations. No more than 8 - 10
property owners have contacted Code Enforcement about not receiving the initial
notice. In most of the cases where the property claims not to have received the
initial notice, the problem turns out to be a change of residence by the
property owner without a corresponding change in the Palm Beach County property
records. There is no apparent significant trend or pattern of property owners
claiming that initial notices were not received.
I am attaching a copy of the DivisionIs Notice of Public Nuisance form. The
attached Notice is the only notice sent to a property owner prior to abatement
by the City - and the notice so states in bold red type on the top of the form,
The Notice indicates in two separate locations that information is contained on
the reverse side. The reverse side clearly indicates, in red type, the property
ownerls right to request a hearing. During the past year, I recall only 6
requests for hearings, 3 of which were withdrawn by the property owners who
complied with the notice requirements. In the other 3 cases, hearings were
held - however, the property owners complied after the hearing.
Examining the attached Notice, one will see 5 telephone numbers on the front
side and 2 on the reverse side. We encourage property owners to call if they
have any problem with the notice, One will also notice that code sections and
corrective actions are enumerated as are reinspections, Reinspections is used
in the plural because if there is any indication the property owner is
attempting to perform the required work, the file is pended for another
inspection.

The "estimated cost" section on the attached form was added to accommodate
ordinance revisions, In the past, two separate forms had to be mailed for each
Nuisance Abatement - the original notice and a subsequent job cost letter, By
combining the cost with the initial Notice of Public Nuisance, at least seven
days were saved from the initial notice expiration date to the abatement action.
Obvious, we do make mistakes - and when we do, I make the appropriate
adjustment. Mistakes, although infrequent, fall into two categories:
1. A recent transfer of property to a new owner not reflected on the
property records. Although we try to check real estate data records
for ownership changes, it is not feasible to entirely eliminate this
category of mistakes.
2. An error made by the Code Enforcement Officer, who prepared the Notice
of Public Nuisance, with respect to an incorrect or incomplete legal
description, incorrect address, etc. Few of these errors occur.
So everyone understands the Nuisance Abatement process, the following is
offered:
1. A Notice is prepared in the office and mailed first class to the
person whose name appears on the Palm Beach County property tax roll.
The owner is given 10 days to correct the problem or to appeal. Ifa
property owner contacts our office and requests additional time to
comply, we gladly grant extensions.
2. If the original Notice is returned by the Postal System as
undeliverable, a copy of the Notice is posted on the appropriate
property and the time periods start again (i.e" another 10 day period
is allowed for compliance).
3, If the property owner requests a hearing, a hearing panel is
established and a hearing date is set, All action on the case is
halted until after the hearing transpires. If the Hearing Panel
decides for the City, the property owner is given another 7-10 days to
comply.
4. After the compliance period expires, a reinspection of the property is
made. One of 3 conditions will be noted:
- Total non-compliance, in which case the file is marked for
vendor assignment
- Partial compliance, in which case the property owner is
given more time to fully comply
- Total compliance, in which case the file is closed,

5, As needed, a vendor is assigned to abate uncorrected violations. The
vendor first inspects the property and submits a price. The price
submitted is compared to the original Violation Notice estimated price
and to contract price schedules. If prices are accepted by the
Division, the vendor is given a job authorization to perform the work,
6. When the vendor completes the job, the property is reinspected and the
job is either approved or disapproved. If disapproved, the vendor is
contacted and instructed to finish the job to our standards. When the
job is approved, the case file is marked for invoicing.
7. When the job is finished and approved, an invoice is prepared by the
Code Enforcement Division and mailed first class to the property
owner. Code Enforcement adds $35.00 to the vendor invoice amount as
an administrative fee. (We are recommending increasing the $35.00
charge,) The property owner is given 30 days to pay the invoice
amount. (In addition, Code Enforcement prepares payment requests for
accounts payable to pay the vendor for his work.)
8. If the invoice is paid, the file is closed. If the invoice is not
paid, the Code Enforcement Division prepares a lien list for the City
Clerk's office. Before the list is submitted to the Clerk's office,
ownership and property legal description information are double
checked.
9. The City Clerkls office schedules lien lists for a commission agenda,
subsequently liens the applicable properties and mails the property
owner another invoice, to which an other administrative fee is added
along with a recording charge (and potentially, an interest charge).
Multiply the above steps by the thousands of Notices we mail and it is apparent
that the process is labor intensive. It is also my opinion that the few
complaints received hardly justify changing a system that works and produces
results,

Ra t i ng errors are judgment errors that occur when an indivudal observes and evaluates
another. Frequently rates are unaware that they are making them.' You should thoroug~ly
understand and guard against the most common rating errors: 1) contrast effect; 2)
first linpression; 3) halo effect; 4) similar-to-me effect; 5) central tendency error; 6)
leniency errors; 7) expecting the llnpossible; 8) bias and prej~~ce errors.
1) Contrast effect error - This is the tendency to evaluate a person
relative to other individuals rather than the requirements of the- job.
For example, one employee in your area appears to be doing outstanding
in comparison to the other employees. On this basis you give hUn/her a
high. rating and recommend a promotion. When the individual fails in
the new job you wonder why. What has occurred is a contrast error.
You were linpressed with how well the employee was doing relative to
other poor performers and you promoted hUn/her into a position for
which he/she was incompetent.
Another instance of contrast effect error is the attempt to rate on a
normal or bell-shaped curve so that a pre-set percentage of all
employees are given high, average, and low ratings. To automatically
rate on a curve is unfair. If, because of unusual circumstances all of
the employees in an area are doing very well, it would be unethical to
give some low ratings to satisfy the requirements of a frequency curve.
To avoid contrast effect errors you must always rate employees on the
degree to which they fulfill the requirements of the job, as formulated
in the performance appraisal manuals, not on how they compare to
others. '
2) First-i~ression error - This refers to a tendency for an initial
favorab e or unfavorable linpression of an employee to distort your
judgment so that all subsequent behavior is interpreted in light of the
initial linpression. If the initial linpression is inaccurate, all
subsequent observations can be inaccurate.
To avoid first-linpression error, always observe carefully bow the
employee is actually perfonning, not how you believe he/she ought to be
per fonning. ' " ' ,
3) Halo effect - This refers to an inappropriate generalization fran one
aspect of a person's on-the-job performance to all aspects of a
person's performance. For example, a person may have 'a significant
problem in one job area but be doing well in all other job areas, yet
be rated as poor in these other areas. People generally have both
strengths and weaknesses that require independent appraisal.
Be careful not to generalize about an employee's performance or allow
your reaction to one quality color your entire opinion of the
employee's work. One or two positive or negative factors might cause
you to rate the employee disproportionately high or low in all
categories. To avoid this you might rate all employees in each factor
separately. After you have rated all employees on one factor, move on
to the next factor.

4) SUnilar-to-me effect - Research has show that there is a tendency for
raters to rate people they believe to be simdlar to themselves more
favorably. We tend to like people with backgrounds, families, belief
systems, etc., similar to our own. It is reasonable to choose friends
on this basis, but when it affects our judgment on job performance, it
can.lead to poor judgment.
S) Central tendency error - This is a tendency for evaluators to want, to
play it safe and rate close to the midpoint of the scale. Central
tendency problems occur when evaluators rate all employees in the high
average range, in this case "4" (exceeds expectations; significantly
exceeds performance standards in this category). No distinction is
made aIrong employees whose performance varies fran outstanding, to
exceeding expectations, falling below expectations, or to
unsatisfactory. To avoid this problem, be realistic in your appraisals
and force yourself to make appropriate distinctions on the scales.
, 6) Guard against being too lenient - To avoid problems that might reflect
badly on them, evaluators sometimes fail to be totally honest in their
evaluations. If you find yourself leaning over backward to give an
employee a good rating, ranember you are devaluing the performance of
the superior employee.
7) Don't expect the ~ssible - Lrnposing superhuman performance standards
on employees--Wi create tension and discontent. if none of the
employees meets your top standard, reevaluate your attitude to see if
your standards are unrealistic. By refusing to give a top rating when
it is deserved you effecitvely lUnit the scale range. This will result
in the employees you rate appearing to be less effective than other
employees rated by evaluators using the full rating scale.
8) Keep bias out of performance aPrraisal - Evaluators inevitably bring
personar--feelings into the eva uation proCess and these feelings
sanetimes get in the way of an objective review. Know your biases and
safeguard the principle of fairness in job related perfo~nce
appraisal.

PROCEDURES TO FILL CITY COMMISSION VACANCY
DATE: November 2, 1990
With the upcoming election in November, a vacancy may be created on
the City Commission. Therefore, I have attached a copy of City
Charter Section 3.06, which provides for the filling of vacancies,
for your information.
By Charter, the Mayor and remaining Commissioners, by a majority vote,
shall appoint a qualified person to fill the vacancy. The individual
appointed to fill the vacancy will serve until the last Thursday in
March following the next regular city election, provided that the
vacancy occurs at least sixty calendar days or more preceding the date
of the city election.
If a majority of the Commission cannot agree upon the appointment of
an individual to fill the vacancy after two regular meetings have been
held, then the Commission shall call a special election for that
purpose, to be held within 60 calendar days following the second
regular meeting.
