Item Before City Commission:
The Kids and Cops Program Committee is requesting approval
to conduct their second annual bicycle auction on Saturday,
January 26, 1991, at the De1ray Beach Police Department
complex. The time for the auction has not been established
and will be announced at a later date.
This auction will be part of several activities that will be
setup to allow positive interaction between the youth of
this community and the Police Department.
The auction will be conducted by volunteer Police Officers
and Members of the Kids and Cops Committee.
Recommendation:
Staff recommends approval of the Kids and Cops bicycle
auction.

SUBJECT: SECOND ANNUAL KIDS AND COPS BICYCLE AUCTION
As you may recall, on February 17, 1990 we held our First Annual
Kids and Cops Bicycle Auction for local children throughout the
community. Bicycles that were auctioned came from our
Evidence/Property Section that were scheduled to be auctioned by
the City during their Annual Auction.
At the present time, we have approximately 100 bicycles on hand
available for auction. Due to the tremendous success of our
First Annual Kids and Cops Bicycle Auction, we are requesting
approval from the City to conduct another. During our first
auction, police officers and many of our local underprivileged
youth were brought together for a positive interaction. We
auctioned and gave away bicycles to kids that normally would not
have an opportunity to obtain one.
Since you were instrumental in helping us with the first bicycle
auction, I am soliciting your assistance in getting approval for
the second.
Your help will be greatly appreciated.

SUBJECT: REQUEST TO HOLD PLANT SALE ON PRIVATE PROPERTY
PROJECT GRADUATION r ATLANTICHIGH SCHOOL
JANUARY 3RD = 16TH, 1991

BACKGROUND:
The organizers of the Annual Project Graduation activity have
applied to the Ci ty for a Temporary Business License to hold an
outdoor plant sale to assist in the financing of this project.
The plant sale is scheduled to be held from January 3rd through
16th on the vacant land currently owned by Mr. Bill Wallace at
the corner of SE 10th Street and Federal Highway. The plants
will be housed by a semi tractor-trailor with aluminum frame and
share cloth for maximum protection of the plants.
Chapter 110.15 of the Code which governs occupational licenses
provides for Commission approval on Temporary Licenses for
special events that are held annually and in excess of three (3)
days. The Commission approved this activity in April 1990.
RECOMMENDATION:
Staff is recommending Commission approval of this special event
activity and authorize staff to issue a temporary business
license to the Project Graduation Parent Group.

Trial before Judge Fine on this matter was held on December 18,
1990. The Commission may recall that immediately prior to the
termination of Mr. Housets license, the City withdrew $50,000
from the letter ot credit securing perforllli;uH,;e in order to
correct certain deficiencies and in order to protect the City
from later discovered problems. The City has expended
$27,609.98 from the line of credit to make repairs that the
City Administration felt were the responsibility of Mr. House.
JUdge Fine ruled that only $13,625.82 were properly expended
and the City should return a total of $36,374.18 from the
letter of credit to Mr. House. The following represents items

The City was primarily relying on tha major maintenance provi-
sion of contract to support the proposition that Mr. House was
responsible for all the above repairs. A copy of said section
is attached for your perusal.
Our office is requesting direction from the City CommisBion at
their December 28th meeting as to whether to appeal the Judge's
decision. In the interim our office will be filing a Motion
for Rehearing in order to preserve all the City1s rights and
I options.
There remains outstanding the issue of sales taxes on
Mr. Housels license fees which were not collected during the
term of the agreement. There is potential liability in excess
of $42,000 relating to that matter, and our office has been
discussing the issue with the Department of Revenue and will
provide the Commission with an update at the December 28th
CommissIon meeting.

Assessments
Chapter 197 of the Florida Statutes provides that cities
imposing a stormwater assessment pursuant to Section 403.0893
of the Florida Statutes may use a uniform method of collecting
stormwater management assessments wherein the assessments will
be placed on the tax bill as a non-ad valorum assessment.
Chapter 197 requires that the City pass a resolution indicating
its intent to use the uniform method of collecting stormwater
management assessments at a public hearing, after duly
advertising a public hearing four consecutive weeks. The
resolution must also set forth the legal description of the
boundaries which will be included in the stormwater management
assessment, and the statute further imposes the requirement
that the City declare in the resolution that it is necessary to
levy a stormwater management assessment.
The statute requirements provide for adoption of the resolution
prior to January 1, 1998. After the resolution is adopted, the
resolution must be sent to the Property Appraiser, the Tax
Collector and the Department of Revenue by January 10, 1991.
The resolution is attached hereto for your review.
Our office is requesting that this resolution be placed on the
December 28, 1990 special meeting agenda and that a legal
description of the boundaries to be included in the stormwater
management assessment be affixed to this resolution as Exhibit

Section 3. This act, except for this section which shall
take effect upon- becoming a law, shall take effect only upon
approval - by- a majority vote of the electors of the area
described in Section 1 above voting in a referendum election
which sh&+l be called and held by the City of Delray Beach on
behalf of the Delray Beach Downtown Development Authority in
the City of Delray Beach at a special election occurring no
more than one (1) year after this act becomes a law. Any
elector of the county who resides in the present Delray Beach
Downtown Development Authority area or the area proposed to be
added to suoh area is eligible to vote in such referendwn
election. There shall be at least 30 days notice of the
election as provided by s. 100.342, Florida Statutes.
