11-86 ORDINANCE NO. 11-86 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AMENDING CHAPTER 29, "WATER AND SEWERS", OF THE CODE OF ORDINANCES OF THE CITY OF DELRAY BEACH, FLORIDA, BY AMENDING ARTICLE II, "WATER SERVICE", DIVISION 1, "GENERALLY", SECTION 29-33, "TRANS- MISSION AND STORAGE FEES", SUBSECTION (a), TO INCREASE TRANSMISSION AND STORAGE FEE CHARGES; PROVIDING A SAVING CLAUSE; PROVIDING AN EFFECTIVE DATE. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL FOR THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That Chapter 29, "Water an¢l sewers", Article II, "Water service", Division 1, "Generally", Section 29-33, "Transmission and storage fees", of the Code of Ordinances of the City of Delray Beach, Florida, be and the same is hereby amended by amending subsection (a) to read as follows: (a) There shall be a transmission fee charge of ~$~9~r99) three hundred fifty dollars ($350.00) inside the city per residential dwelling unit or its' equivalent, and a storage fee of e~e--h~td~%,~t--ftfty-~lo~l~r~-{~-l~9~.4~ one hundred fifty-five ($155.00) inside the city per residential dwelling unit or its equiva- lent. A residential dwelling unit is herein defined to be any family living unit, and, where two (2) or more families are living on the same premises, each shall be considered as a separate residential dwelling unit. In apartment buildings, condo- miniums, cooperatives, duplexes, resort dwelling units and the like, and per each trailer space in a trailer park, each such living unit shall be considered a separate residential dwelling unit. For commercial, industrial and other non-residential users, said transmission fee and storage fee referred to herein shall be charged to users wholly outside the corporate limits of the city at a rate of twenty-five (25) per cent higher than for the applicable fee to users within the corporate limits of the city. Section 2. That should any section or provision of this ordinance or any portion thereof, any paragraph, sentence, or word be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or part thereof other than the part declared to be invalid. Section 3. That this ordinance shall become effective ten (10) days after its passage on second and final reading, and the increased fees set forth in Section 1, above, shall be applicable to all those applications filed with the City of Delray Beach for water service on or after February 12, 1986.
