Thiele, City Attorney Subject: Special Elections related to Charter Amendments There has been some confusion concerning the question of whether citizens, through the petition process, can mandate that the City Commission call a Special Election on a Charter change item. There are two provisions of law that may be applicable to Charter amendments within the City of Delray Beach. One is Article VI of our Charter and the other is Section 166.031 of the Florida State Statutes. Article VI of the Charter, which deals primarily with an ordinance, as being enacted or repealed, through the initiative or referendum procedures, requires that) upon certification, that the petition contains the requisite number of signatures, the City Commission must call a II Special Election to pass on the proposed ordinance no sooner than thirty (30) days from the date of certification and no later than sixty (60) days from that date. Section 166.31 of the Florida Statutes contains no such provision, rather it indicates that the City Commission may call a Special Election and may have the Special Election held during the next general election within the municipality. It is our office's opinion that depending on the question presented, Article VI may be applicable as in the case where the City Commission could amend the Charter by ordinance as could the voters through that procedure, but in the case where Special Election is mandated and the Commission could not change the Charter without referendum, such as in the instant case, the provisions of FS. §l66. 031 prevail, and the City Commission cannot be mandated to call a Special Election prior to the next general election within the municipality. In this case then there would be no legal necessity for the City to expend any monies for a Special Election assuming the requisite number of signatures were attained, but rather the election could be held in March of 1990. KOVACS, ECTOR DEPARTMENT OF PLANNING AND ZONING SUBJECT: SPECIAL MEETING OF JANUARY 31, 1989 BARWICK RANCH FINAL PLAT Attached are the following: a) reduction of the proposed subdivision layout b) copy of assessor's map which shows parcel relationships (please note that what appears to be a road is only the approximate location of an easement) c) an air photograph of the area. The issue is whether or not provisions should be made for a road to extend from Barwick Road westerly. into the Northwest quarter section 12. And if so, where should the road be located? Current Proposal: The proposal set forth via the plat is that this property dedicate twenty-five feet (25') along its south boundary. This dedication includes area which is already covered by a twenty foot (20') easement. If there is future subdivision activity west of Barwick Road and it is along what is shown on the assessor's. map as the easement road, it will be necessary that right-of-way is obtained and a street constructed from Barwick Road to the development site. Additional right-of-way would be sought equally from both sides of the common property line which extends westerly of the current south boundary of this development site. Need for an east / west street: There is a need for an east / west street in this quarter section. At present there are several lots which are provided access only by an easement. One is the use of Palm Ridge Road; the other is the current proposal. The use of Palm Ridge Road has not been incorporated, with this project because of the following: a) The junction of Palm Ridge Road is offset, at Barwick Road, with the junction of Sabal Lakes Road (entry to Sabal Lakes and the Banyan Creek Elementary School) . This is a very poor situation and thus Palm Ridge Road should not carry significant traffic and should be cul-de-saced in the future. b) There are single family homes fronting on Palm Ridge Road. It is not good practice to carry significant traffic in front of homes where vehicles will be backing across travel lanes in order to get into the traffic flow. c) The developer did not desire to access the property off Palm Ridge Road. In order to properly have Palm Ridge Road serve as the major street for this quarter section, the following would be required: 1. Dedications from the Barwick Ranch parcel to accommodate an extension of Sabal Lakes Road; 2. Rea~ignment of Palm Ridge Road to the south; 3. Abandonment of a portion of the existing Palm Ridge Road and the construction of turnarounds on the lots which front that street (an alternative to the turnarounds would be a frontage road - further study is needed). Development of those properties would require a north / south street to intersect with Palm Ridge Road. Walker: The subject project is adjacent to an offset intersection - Barwick Road at Palm Ridge Bou1evard/Sabal Lakes Drive. The proposed plat of Barwick Ranch will be dedicating 10' of additional right-of-way for Palm Ridge Boulevard. However, this additional right-of-way does not establish an alignment of the east and west roads as they are existing roadways. In order to correct this offset the Engineering Department required additional right-of-way from Barwick Ranch. This request has caused the project to lose a lot and the develop- er has pleaded a hardship. The Engineering Department met with Chris Mora of your office to field inspect the alignment. He explained that if the intersection was ever warranted to require a signal that the signals for the east and west approach could be phased in order to provide a safe manuever. Palm Ridge Boulevard is presently a 12' paved roadway offset in a 40' R/W servicing 10 homes and a landscape nursery to the west. This roadway dead ends at nursery and the City would like to maintain this roadway at its present, 1 imi ted service, proposing it to remain a dead end. We very often require home- owners or property owners to give dedications for future rights-of-way, whether it benefits them or not. Here is a road that will have abso- lutely no impact or benefit to this property owner and you are expecting then to take, for the public domain, a reservation for a road that may never get built. It is a dilemma, and more properly, this item should have been workshopped and we are going to workshop it as we do need to discuss it a little further. I would ask that with concurrence of the Commission, that we postpone this for a further review until next Tuesday. Ms. Horenburger moved to postpone the item for consideration on a vote in two weeks and we'll workshop it on Tuesday. Mayor Campbell suggested it then be put on the Consent Agenda after the workshop. Mr. Weatherspoon stated that hopefully Staff will have some input on the options we just talked about. Mayor Campbell stated we have never agreed on a road yet - that's the whole point. Applicant stated they have already proposed a southern entrance from that entrance and it was rejected through the City. We had pro- posed to come in through the south entrance and it was rejected. So we went through the center and asked to give an additional 5 feet for later use, we gave 5 feet, we gave 10 feet, we put in water and sewer, side- walks, landscape and costing us like $100,000 worth of improvements on the property and all to benefit the City - none for our property whatso- ever. Ms. Horenburger: Who rejected it? Applicant: The City Planners. ~l- .. Mr. Kovacs: You say you had an entry to the south that went along the common property line? Applicant: Mr. Kovacs, we proposed a south entry and Engineer- ing rejected it. Mr. Kovacs: That wasn't submitted as part of your sketch plan. Applicant: It was not on the first sketch plan. Þ1ayor: In otherwords, if you had done the main roadway en- trance into your subdivision that someday could be extended, you would solve both problems. Applicant: That was our initial plan, because we were going to buy the 5 acres next to us, but the deal went down, so we are not going to purchase it whatsoever. They were scared that we would have a major intersection at that point which would create a conflict with the entrance. Mr. Kovacs: If what I am hearing, is that he is willing to put a road along the south property line of his property, that is much in keeping with what we would want to see. Mayor: If it is the entrance into his project-- Applicant: I am losing 25 feet from the bottom--but now it has already been approved, already been platted, and we have already spent $100,000 for engineering, architectural and landscaping. Mayor: We will workshop it on Tuesday. City Manager: I understand there is some concern about getting this done before the first of February. Applicant: We need to know by today or tonight, because we have to close on the property. Mayor Campbell advised he is not going to know tonight. The applicant stated he must know by the end of the month. Mayor Campbell stated we will workshop it Tuesday. The City Manager asked if the Commission would be willing to call a Special Meeting for this particular item for the 31st of January. Thiele, City Attorney Subject: Follow-up to Meeting Concerning Review of City Board Consolidations and Divisions This mernorandurn is to reflect the substance of our \:onvcrsat.ions held in the Ci.ty Manager's Office on December 12, 1988 with regard to the Ci ty Commission'·s direction for input on the subject of the severance of the planning and z.oning function from t.he Planning and Zoning Board, as well as the consolidation of certain functions with regard to other Boards \,vi thin the City. it. was our general consensus that, with certain ordinance modifications to both the Code of Ordinances and the City Charter, that the following suggestion could be implemented. . That is that the current Planning and Zoning Board, the current Con~unity Appearance Board, and the current Board of Adjustment vlOuld all be modified by replacing same with two new Boards which would be named the Planning Board of the City of Delray Beach and the Building and Zoning Board of the City of Delray Beach. The Planning Board would be the Board which deals with planning functions and long ·range plans, as well as the review and implementation of the comprehensive plan. This Board would be designated as the local planning agency under the Florida Statutes, as well as being the designated Planning and Zoning Board for charter purposes. The second Building and Zoning Board would take over the functions of that which is currently handled by the Community Appearance Board and the Board of Adjustment, as well as the consideration of variances for the noise control ordinances and complete site plan review from application date to recommenda- tion to the City Commission. Given the redesignations of these two Boards, and the fact that we would not be necessarily modifying the vast majority of their functions, it ,.¡QuId be our opinion that the provisions set forth in Section 3.08 of the City Charter could be modified by ordinance only, without the necessity for sub1Ditting same to a referendum. As additional considerations, we have also discussed the subj ect of recommending that. both the Downtown Development Authori.ty and the Community Redevelopment Authority, although continuing to operate as separate agencies, combined to retain a single executive director ""ho would act on behalf of both Boards. It was further our recommendation that consideration be given to utilizing a format similar to that which occurs in the City of Orlando wherein the Downtown Development Authority does much of the planning functions and provides the n seed money" for projects, while the Community Redevelopment Agency would act in t.he. capacity of implementation and provide the vast majority of funding for certain projects. Finally, it 5.s our belief that the City Commission and the Downtown Development Authority ought to consider an expansion of the Dmyntown Development Authority boundaries, both north and south, as well as easterly to the ocean and westerly to perhaps include up to Congress Avenue. Sincø these items are in the early planning stages, it is suggested that these matters now be submitted to the City commission for their further consideration and direction to the City Administration so that if they wish to make any or all of these changes, that staff may begin to formulate the necessary ordinance amendments and develop the objective criteria neces- sary for the smooth administration of these modifications. First Avenue Delray Beach, FL 33444 Re: State Mandated Recycling of Solid Waste Materials Dear Mr. Barry: At the January 18, 1989, regular monthly meeting of the Board of the Solid Waste Authority of Palm Beach County, an initial status report of the development of a county-wide recycling program was presented. As a follow-up the Board approved a motion to have this information disbursed to the Board of County Commissioners and all municipalities and special districts within the county. The 1988 Florida Legislature made comprehensive changes to the Solid Waste Management laws. The most substantial impact to municipalities resulting from these changes are the provisions for recycli~g. The statutory goal is to achieve a 30% county-wide reduction of the waste stream through recycling by the year 1994. In Palm Beach County the Solid Waste Authority of Palm Beach County is charged with the county-wide responsibility for recycling. Florida Statute 403.703(3) and 403.706(20) ( 1988 ) , Chapter 75-473, Laws of Florida, as amended. <Thus, wherever "County" appears in Chapter 403, Part IV, Florida Statutes, it means the Solid Waste Authority, in Palm Beach County.) Chapter 403 requires the Authority to initiate a recycling program by July 1, 1989. There is no such specific mandate as to municipalities. The Authority and municipalities are encouraged to form cooperative arrangements and to enter into interlocal agreements to carry out the county-wide recycling program. The statute directs the Authority to insure that municipalities participate either through interlocal agreements or otherwise. The Authority is currently developing this required county-wide recycling p I an . Pilot recycling programs are already in place which can easily be converted to permanent programs. It is the Authority~s interpretation that the requirement to "initiate" does not mean that the entire county must be "recycling" by July 1, 1989, but rather that the plan is prepared and implementation has begun by that date. Thus, the Statute allows for gradual implementation. At its public workshop on November 30, 1988, the Florida Department of Environmental Regulation interpreted "initiate" to mean having "minimum recycling activity by July" with some sort of plan outlined at that time for a county-wide program. We would encourage all municipalities to deter taking any final action on recycling programs until the Authority~s county-wide plan is completed. In the meantime, the Authority will continue to answer questions and assist municipalities as needed. In Apri 1 19:37, New Jersey became the first state to enact a mandatory rec:yd ing law. Cities were quick to comply with the mandate, although the private sector warned of potential market gluts. Today, some municipalities in New Jersey pay to get rid of their newspaper, and some local paper yards have mountair:1s of paper they can "t sell and wi 11 no longer accept it from cities, let alone provide revenue for it. By statutory definition, recycling has not occurred until the material retrieved has been processed for re-use. Florida Statute 403.703(6) ( 1'?88) . Thus, merely collecting and stockpiling materials as in New Jersey will not contribute to the required 30% reduction in the solid waste stream due to recycling. In order to avoid saturating our existing markets, the Authority supports gradual implementation of recycling programs. By phasing in collections in manageable increments we will not overburden existing outlets for material and can provide time to establish new markets to accommodate a county-wide program. Steps have already been taken by the Authority t~ establish an interim materials reclamation facility. In accordance with the provisions of the Palm.Beac:h County Solid Waste Act (Chapter 75-473, Laws of Florida, as amended) and Chapter 403, Part IV, Florida Statutes, the Authority will establish flow controls of all recyclable materials in Palm Beach County to this materials rec:lamation facility for processing and marketing. The Authority is also investigating and developing plans for one or more permanent central facility(s) to receive and process all recyclable materials and provide for their marketing and resale. Strong emphasis is set out in the provisions of the recycling law for the Authority to plan for and regulate recycling in the most economically feasible. cost effectivey and environmentally saf~ manner. We believe that a comprehensive recycling program can be most economically achieved through a county-wide organized and centrally controlled program, rather than numerous individual fragmented programs. The Authority staff anticipated presenting to its Board, at the February 15, 1989, Board meeting, a draft plan and analysis for the facilities and methods for receiving, processing and marketing recyclable materials for the entire county. We would also like to caution municipalities against possible extraneous and false information being circulated by various persons or groups promising that when municipalities initiate their recycling programs the residents are going to receive money back from these programs. Pilot program studies have demonstrated that the revenues received from the sale of recyclables will not completely offset the cost of collecting, processing and marketing them so that it should be anticipated that recycling programs will operate at a net cost to the residents of the entire county. As Unisys has previously advised Chief Kilgore, Unisys was not a party to the D.M. Data contract providing the PLIMS software, disclaims liability for D.M. Data nonperformance and Unisys endeavors to provide support and assistance to the Delray Beach Police Department should not be construed as an admission of any liability. It was out of concern for a user of Unisys equipment and as a goodwill gesture to retain a valued customer that Unisys initiated its proposal to replace the Unisys B1900 with an A4 upgrade running APLIMS. The APLIMS application software package meets the standards of a Unisys product which is licensed under the terms of our Consolidated Agreement. The underlying premises of our very ~avorable proposal to the Delray Beach Police Department were: o APLIMS would meet the Unisys functional specifications and the Police Department would accept the APLIMS specifications as full substitution for those in the 1985 RFP and the D.M.
