by the City Commission with respect to any matter considered at this
meeting or hearing, such persons will need a record of these
proceedings, and for this purpose such persons may need to ensure that
a verbatim record of the proceedings is made, which record includes
the testimony and evidence upon which the appeal is to be based. The
City does not provide or prepare such record.
SPECIAL MEETING
Pursuant to Section 3.07 of the City Charter of the City of Delray
Beach, Florida, Mayor Doak S. Campbell has instructed me to advise you
,of a Special Meeting of the Commission to be held in the Commission
Chambers at 6:00 P.M., Wednesday, August 16, 1989
This meeting has been called for the purpose of considering:
1. Appointment of Four City Representatives to the Nine Member
Education Task Force established to evaluate the recommendations set
forth in the "Sharing for Excellence, 1990 School Plan".
2. Consideration of Settlement Offer in the amount of $30,000 in the
Serocki vs. the City of Delray Beach litigation. City Attorney's
Office and Risk Manager recommends approval.

SPECIAL TASK TEAM, PER THE 7/31/89 MEETING
At the meeting of the City Commission and Palm Beach County
School Board on July 31, 1989, a consensus direction was given to
establish a nine (9) member Task Force to evaluate the
recommendations as set forth in the "Sharing for Excellence, 1990
School Plan." The task force is expected to provide its formal
recommendation to the School Board for their consideration by the
end of September, 1989. The nine member task force is to be made
up of the fOllowing participants:
Two members of the City's Education Board
Two City Staff members
Two members of the Superintendent's Advisory Committee
Two members of the School Board's Staff
One mutual person appointed by the Mayor & School Board
Chairman, Dr. Anderson
The City's Education Board will be discussing this matter at it's
regular scheduled meeting on Monday, August 7, 1989, 5:30 PM,
and will be making a formal recommendation to the City Commission
regarding this Task Force including nominees for representatives
from the Education Board for consideration at the August 8th.

the organizational meeting of July 24th are attached for your
reference.

Serocki v. City of Delrav Beach Settlement Offer

The settlement offer of $45,000.00 was considered and rejected
by the City commission on August 1, 1989, and at that time the
Commission authorized our office to transmit an offer of
judgment to the plaint.iffs in the amount of $25,000.00. Trial
in the matter is presently scheduled for a three week docket
beginning August 28, 1989, and on August 15, 1989 Myron Dunay,
attorney for the plaintiffs contacted our office and trans-
mitted a settlement offer of $30,000.00 in exchange for a full
release of all the Serocki's claims against the City.
This case involves alleged back injuries suffered by Mrs.
Serocki as a result of a collision between the bicycle she was
riding and an unmarked vehicle driven by Officer Josh Hooper on
January 21, 1986. Her doctors have given her a disability
rating of between 3% and 10% on her whole body due to disc and
sciatic nerve problems. She has incurred medical bills
slightly in excess of $12,000.00, most of which were covered
and paid for by her PIP and medical insurance coverage. Her
. husba.nd , Wallace Serocki, also has a claim for loss of consor-
tium stemming from this incident.
This accident occurred in a car which the Police Department was
renting from Sheehan Rent-A-Car, and therefore Sheehan Rent-A-
Car was named as a defendant in the lawsuit and has filed a
crossclaim for indemnification against the City. Sheehan is
willing to contribute $2,500.00 towards the settlement of this
matter in order to avoid the cost of trial, and the remaining
$27,500.00 would be contributed by the City from the self-
insurance retention fund..
Our office and the Risk Manager would recommend that the
settlement offer of $30,000.00 be accepted, with funding of
$27,500.00 to come from the self-insurance retention fund and
$2,500.00 contributed by Sheehan Rent-A-Car.
