A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DELRAY
BEACH, FLORIDA, REQUESTING THAT THE FLORIDA STATE
LEGISLATU1LE APPROVE AND ADOPT THE BUII.DING OFFICIALS
ASSOCIATION OF FLORIDA'S POSITION ON THE FLORIDA BUILDING
CODE, WHICH POSITION IS SET FORTH IN EXHIBIT "A" ATTACHED
HERETO; PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Board of Dtrectors of the Building Officials Association of Florida has unanimously
adopted and published a posmon paper on the proposed Florida Budding Code; and
WHE1LEAS, the Budding Officials representing the munidpalifies and counties of the State of
Florida are sworn to provide protecuon for the safety and welfare of the residents and have taken an oath to protect
the persons and property within the State of Florida; and
WHEREAS, the Florida Budding Commission has submitted to the Florida State Legislature a
proposed statewide minimum bmldmg code that will dmunish the ab~ty and authority of local bmldmg officials to
formulate and enforce bmldmg codes and thus anpaxr the health, safety and welfare of all the residents of the State of
Honda.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF
DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. That the Delray Beach C~ty Commission does hereby adopt the position on the Florida
Building Code of the Budding Officials Associauon of Florida as pubhshed and as set forth m Exhibxt "A" attached
hereto.
Section 2. That the Delray Beach C~ty Comrmssion hereby respectfully requests that the Florida
State Legislature support the recommendauons of the Building Officmls Associauon of Florida as set forth in Exbabit
"A" attached hereto.
Section 3. That the City Clerk is directed to forward a copy of this Resolution to the Honda State
Legislature, the Governor, the Secretary of the Department of Community Affaars, the Florida League of C~fies, the
Palm Beach County League of Cities, the Palm Beach County Legislative Delegation, the Palm Beach County Board

The Palm Beach County League of Cities is asking municipalities to adopt a resolution in support of
the Building Officials Associauon of Florida's position on the Florida Building Code. The Building
Officials Association believes that the proposed statewide minimum building code that has been
submitted to the State Legislature by the Florida Building Cornmassion will adversely impact the
health, safety and well being of Florida residents as it will diminish the ability and authority of local
building officials to formulate and enforce building codes.
Resolution No. 33-00 is provided for your consideration.
Approval is recommended.

In th= early stages of thc ctcvclopment of e tmi.iled statcwidc building code, the Building
Officials AssociaTion of Florida was a lead supporter. The association understood that
thc Florida Building Code would be built on a simple model for statewide adoption of a
nationally recognized model code, with modifications sele,~tcd for th~ needs of Florida.
The Building Officials Association of Florida is the only professional organization in the
State that has the experience and true sianding to conunem effectively on building codes
and the building code change process.
Ts, Florida Building Commission has struggled with creating the Florida Building
Code. It has become evident that some of the goals s~ by thc legislature cannot be
achieved within the parameters of the legislation, and within the timeframe sci by the
legislature. Additionally the process of fitting together all of thc present rcgulat~ons
affecting construction, including code enforcement, has crcaxcd issues unknown to thc
legislature at the time Chapter 9g-287 was crcat~.
The legislature should ll~tttk and acknowlcdg~ *he Flolida Building Commission for the
difficult task they undertook. Tixe legislature should take advantage of what waz learned
during thc codes review p~ocess. In consideration ofthe current ~cumstances, and
based on adopted policy of the Building Officials Association of Florida, the following
recommendations should be considered.
The Icsislamr¢ should look for opporlv~ities durin~ tho 2000 L~islafivc Session to
adopt a min_i__rntun s~cwidc code for Florida which contains thc followins elcmc, nts:
Require the Florida Building Commission to adopt thc Iut~marional Building,
Electrical, Administrative, Oa~, Mechanical, Plumbing, and Residential Codes.
Require the Florida Building Commission to modify the Intemalional Codes for
Florida specific conditions.
Provide an opportunity for Broward and Dadc Counties, duc to theft historic local
methods of dealing with building cod~s, to join the statewide building code system.
Delete ~he creation of a new statewldc product approval system and restore the
current system which is integrated throughout the Slate and has no fiscal impact. We
believe there is no compelling cvideI~ce to crcalc a new system
