CONSENT AGENDA
* 6. Ratification of South Central Re2ional Wastewater Treatment and
Disposal Board Action of Januarv 20. lQ88. Consider ratifi-
cation of SCRWTD Board action awarding contract to the low
bidder, Q&Q Contractors for air scrubbers in the amount of
$617,600 ($308,800 to be paid by the City).
Action Recommended: Motion to ratify the action taken by
SCRWTD Board awarding a contract for acquisition and install-
ation of odor control equipment to the low bid firm Q&Q
Contractors in the amount of $617,600 with the City funding
its $308,800 share from retained interest earnings on the 1987
Water and Sewer Bond Fund.

Nuisance Abatement. Resolution No. 6-88 assesses costs for abat-
ing nuisances by removing 14 junked and/or abandoned vehicles.
Action Recommended: Motion to adopt Resolution No. 6-88.

Temoorarv Office Trailer - Fire Department. Consider award of a
30 month agreement to Gelco Space of Delray Beach in the amount
of $20,239 for the rental of a temporary office trailer to be
located at Fire Department Headquarters to house the Fire
Prevention Bureau, Training Division and the Emergency Medical
Service Division, with funds to come from the 1987-88 budget.
Action Recommended: Motion to approve award of a lease agree-
ment for temporary office facility with Gelco Space in the
amount of $20,239, with funding to be provided from the Fire
Department 1987-88 budget.
* 10. Enclave Reoort. Request for authorization to proceed with imple-
mentation of the "Enclave Report" in the amount of $24,000.
Action Recommended: Motion to approve the creation of a
temporary, part time para legal position in the Planning De-
partment to process enclave annexations, allocating $24,000
from the Commission's contingency account for partial year
funding, and directing that Enclaves designated as "A" and
"B" in the Enclave Reoort be procured as soon as practicable.

Bids were received and opened this morning at 9:30 for the
installation of air scrubbers at the Regional WWTP. There were
eight plan holders with three bids being offered at the opening.
The bids were:

The bids will be evaluated by Hazen and Sawyer with presentation
to the Board for award at the next Board meeting. The funds for
this award requires approval by the Board plus ratification by

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRAY
BEACH, FLORIDA, PURSUANT TO CHAPTER 14 OF THE CODE OF
ORDINANCES OF THE CITY OF DELRAY BEACH, ASSESSING COSTS
FOR ABATING NUISANCES BY REMOVING JUNKED AND/OR ABANDONED
VEHICLES WITHIN THE CITY OF DELRAY BEACH; SETTING OUT
ACTUAL COSTS INCURRED BY THE CITY TO ACCOMPLISH SUCH
ABATEMENT AND LEVYING SAID COSTS; PROVIDING FOR AN
EFFECTIVE DATE AND FOR A DUE DATE AND INTEREST ON
ASSESSMENTS; PROVIDING FOR THE RECORDING OF THIS
RESOLUTION, AND DECLARING SAID LEVY TO BE A LIEN UPON THE
SUBJECT PROPERTY FOR UNPAID ASSESSMENTS; PROVIDING FOR
THE MAILING OF NOTICE OF LIEN.
WHEREAS, the City Manager or his designated representative
has, pursuant to Chapter 14 of the Code of Ordinances, removed junked
and/or abandoned vehicles owned by persons described in the list
attached hereto and made a part hereof, for violation of the provisions
of Chapter 14 of the Code of Ordinances; and,
WHEREAS, pursuant to Chapter 14 of the Code of Ordinances of
the City of Delray Beach, the City Manager or his designated
representative has determined that a nuisance existed in accordance
with the standards set forth in Chapter 14 of the Code of Ordinances,
and did furnish the respective owner(s) of the land(s) described in the
attached list with written notice of public nuisance pursuant to
Sections 14-2 and 14-3 of the Code of Ordinances; and,
WHEREAS, the property owner(s) named in the list attached
hereto and made a part hereof did fail and neglect to remove said
junked and/or abandoned vehicles, and thus failed to abate the nuis-
ance(s) or to properly request a hearing pursuant to Chapter 14 within
the time limits prescribed in Chapter 14 of the Code of Ordinances, or
if the property owner(s) did request and receive a hearing, said
property owner(s) failed and/or neglected to abate such nuisance(s) as
required by Chapter 14 of the Code of Ordinances; and,
WHEREAS, the City of Delray Beach, through the City Adminis-
trat~on or such agents or contractors hired by the City Administration
was ~herefore required to and did remove said junked and/or abandoned
vehi ,les owned by persons described in the list attached and made a
p~rt hereof and incurred costs in abating the subject nuisance(s); and,
WHEREAS, the City Manager of the City of Delray Beach has,
pursl'.ant to Chapter 14 of the Code of Ordinances of the City of Delray
Bead, submitted to the City Council a report of the costs incurred in
abat :.ng said nuisance (s) as aforesaid; and,
WHEREAS, the City Council of the City of

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY

Section 1. That assessments in the individual amounts as
shown by the report of the City Manager of the City of Delray Beach,
invo:.ving the City's cost of abating the aforesaid nuisances a copy of
whicb is attached hereto and made a part hereof, are hereby levied
against the parcel (s) of land described in said report and in the
amount(s) indicated thereon. Said assessments so levied shall, if not
paid withi.n thirty (30) days after mailing of the notice described in

Section 3, become a lien upon the respective lots and parcells) of land
described in said report, of the same nature and to the same extent as
the lien for general city taxes and shall be collectible in the same
manner and with the same penalties and under the same provisions as to
sale and foreclosure as City taxes are collectible.

nuisance by the City, and that said assessment is due and payable
within thirty (30) days after the mailing date of said notice of
assessment, after which a lien shall be placed on said property, and
interest will accrue at the rate of 8% per annum, plus reasonable
attorney's fees and other costs of collecting said sums.
Section 4. That this resolution shall become effective thirty
(30) days from the date of adoption and the assessment(s) contained
herein and shall become due and payable thirty (30) days after the
mailing date of the notice of said assessment (s), after which a lien
shall be placed on said property(s), and interest shall accrue at the
rate of eight (8) percent per annum plus, if collection proceedings are
necessary, the costs of such proceedings including a reasonable
attorney's fee.
Section 5. That in the event that payment has not been
received by the City Clerk within thirty (30) days after the mailing
date of the notice of assessment, the City Clerk is hereby directed to
record a certified copy of this resolution in the public records of
Palm Beach County, Florida, and upon the date and time of recording of
the certified copy of this resolution a lien shall become effective on
the subject property which shall secure the cost of abatement, interest
at the rat,; of 8%, and collection costs including a reasonable
attorney's fde.
SEction 6. That at the time the City Clerk sends the
certified~:C-py of this resolution for recording, a notice of lien, in
the form of prescribed in Section 14-5 of the Code of Ordinances, shall

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRAY
BEACH, FLORIDA, PURSUANT TO CHAPTER 13 OF THE CODE OF
ORDINANCES OF THE CITY OF DELRAY BEACH, ASSESSING COSTS
FOR ABATING NUISANCES UPON CERTAIN LAND(S) LOCATED WITHIN
THE CITY OF DELRAY BEACH; SETTING OUT ACTUAL COSTS
INCURRED BY THE CITY TO ACCOMPLISH SUCH ABATEMENT AND
LEVYING THE COST OF SUCH ABATEMENT OF NUISANCES;
PROVIDING FOR AN EFFECTIVE DATE AND FOR A DUE DATE AND
INTEREST ON ASSESSMENTS; PROVIDING FOR THE RECORDING OF
THIS RESOLUTION, AND DECLARING SAID LEVY TO BE A LIEN
UPON THE SUBJECT PROPERTY FOR UNPAID ASSESSMENTS;
PROVIDING FOR THE MAILING OF NOTICE OF LIEN.
WHEREAS, the City manager or his designated representative has,
pursuant to Chapter 13 of the Code of Ordinances, declared the existence
of a nuisance upon certain lots or parcels of land, described in the
list attached hereto and made a part hereof, for violation of the
provisions of Chapter 13 of the Code of Ordinances; and,
WHEREAS, pursuant to Section 13-16 of the Code of Ordinances of
the City of Delray Beach, the City Manager or his designated
representative has inspected said land (s) and has determined that a
nuisance existed in accordance with the standards set forth in Chapter
13 of the Code of Ordinances, and did furnish the respective owner(s) of
the land(s) described in the attached list with written notice of public
nuisance pursuant to Sections 13-16 and 13-17 of the Code of Ordinances
describing the nature of the nuisance(s) and sent notice that within ten
(10) days from the date of said notice forty-two (42) days in the case
of violation of Section 13-14 pertaining to seawalls) they must abate
said nuisance, or file a written request for a hearing to review the
decision that a nuisance existed within seven (7) days from the date of
said notice, failing in which the City of Delray Beach would proceed to
correct this condition by abating such nuisance, and that the cost
thereof would be levied as an assessment against said property; and,
WHEREAS, the proper4y owner(s) named in the list dttached
hereto and made a part her20f did fail and neglect to abate the
nuisance (s) existing upon the:,r respective lands or to properly request
a hearing pursuant to Section 13-16 within the time limits prescribed in
said notice and Chapter 13 of the Code of Ordinances, or if the property

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DELRAY BEACH, FLORIDA, AS FOLLOWS:

Section 3. That the City Clerk of the City of Delray Beach is
hereby directed to immediately mail by first class mail to the owner(s)
of the property, as such ownership appears upon the records of the
County Tax Assessor, notice (s) that the City Council of the City of
Delray Beach on the has levied an
assessment against said property for the cost of abatement of said
nuisance by the City, and that said assessment is due and payable within
thirty (30) days after the mailing date of said notice of assessment,
after which a lien shall be placed on said property, and interest will

Section 4. That this resolution shall become effective thirty

As part of our effort to provide additional temporary office
space the purchasing department solicited proposals from eight
(8) firms in the State of Florida to furnish quotations and
delivery information. Based on that research, the proposal from
Gelco Space of Delray Beach, Florida, is the lowest and best bid.
The lease of this space will extend over a thirty (30) month
period, therefore, approval by the City Commission is required.
Accordingly, we are submitting the agenda request, supporting
documentation from the purchasing department and a copy of the
initial approval to proceed from the Acting City Manager.
The funding for the first year's start up costs and deposit,
as well as the increase in the monthly lease amount will come
from internal budget transfers (Lines 001-2311-522-33-48 and
001-2315-526-33-48 - Uniform and Linen Service) due to a decrease
in the estimated purchase price of uniform components.
Appropriate budget transfers will be made prior to contract
execution.

As you are aware, last budget year we received approval from
the City Manager to add a construction trailer (12 x 60 feet) on
site at Fire Department Headquarters to house the Fire Prevention
Bureau. This permitted us to partially alleviate overcrowded
conditions experienced by the Bureau and at the same time permit
us to reconfigure some staff offices for a more efficient
internal operation. This was intended to be a temporary solution
for a longer term problem which would only be addressed by the
construction of a new headquarters facility. As you know the
time frame for this replacement facility is probably two ~ears
away.
You are also aware the City Commission authorized an
additional Assistant F~re Chief position, an additional clerical
position and an additional Fire Inspector in the current year's
operating budget. We must now provide office space for these
staff positions. Accordingly, my staff has investigated the
possibility of returning the present "single-wide" trailer and
leasing a "double-wide" unit (28 x 60 feet). This would permit
us to move the Training Officer and the Paramedic Coordinator to
the larger trailer, provide additional space for increased
staffing in the Fire Prevention Bureau, and at the same time
permit us to make further adjustments on the second floor of
headquarters to provide suitable space adjustments for the new
Assistant Fire Chief and the additional clerical position.
Our estimates indicate the following will be required to
make this transition:

ITEM BEFORE THE COMMISSION:
The action being requested of the commission is to authorize
proceeding with initial steps in the implementation of the
Enclave Report. These first steps are:
1. Authorize the transfer of $24,000 from the commission's
contingency account to the planning Department. Said
amount to be for the salary for the balance of this
fiscal year for a part-time, temporary position to
process the enclave annexations (a job description is
found on pages III-5 and III-6 of the Enclave Report)
and for direct costs e.g. advertising, mailings, and
copying costs.
2. Direct that those enclaves identified as "A" and "B" in
the report be annexed as soon as is practical.
BACKGROUND:
The draft Enclave Report was reviewed with the Commission at a
previous workshop. Part III of the report set forth a
recommended sequence of annexations and administrative needs
which are necessary for expeditiously processing the annexations.
While it is probably desired that the full report be reviewed
further at another study session, there seemed to be agreement
that we should not lag in its implementation. Accordingly,
formal action is being sought to begin the administrative
procedures necessary for implementation. For example, with the
approval of funding of a temporary position now, we anticipate
having a person hired by March 1. After training we would
anticipate that person to begin processing so that the first
group of enclave annexations would be before the Planning and
Zoning Board in April and before the City Commission in May with
an effective date in June.
Other formal actions which must also be taken include:
1. Formal acceptance of the report and its forwarding to
the County commission.

The action being requested of the City Commission is approval of
a major modification to the site plan for the waterford Village
housing development. commission action on major site plan
modifications is required pursuant to Code Section 30-22-F.
BACKGROUND:
Attached is the Planning and Zoning Board's staff report which
locates and provides background data on the project. The
modification does not involve an increase in unit count or points
of access. It does involve the internal arrange of units, the
types of units, parking arrangements, the location of
recreational facilities, and the shoreline of the lake.
None of the individual modifications are major in and of
themselves. However collectively, they represent a project
change which warrants formal action. In addition, since this
project was initially approved as a part of a D.R.I. it was
deemed appropriate by the Planning and Zoning Board that it be
processed through the major modification procedures.
DUring review of the project only one significant area of
controversy arose. That dealt with the manner in which buffering
(wall and landscaping treatments) would be provided between the
development and the Bass Creek subdivision. This matter has been
resolved to the satisfaction of Bass Creek homeowners.

Item Before The Board:
The action before the Board is that of making a recommendation on
a major site plan modification to the existing site plan of
Waterford Village.
Backqround:
Please refer to the staff report prepared on this item for your
November 16, 1987 meeting, (copy attached) for complete
background material.
Concurrent with this proposal was a proposal to amend the DRI
allowing substitution of a revised plan for the original plan.
At the November 16th meeting, based on a determination that these
changes did not increase traffic count, a proposed unit count, or
intensity, the proposal to amend the DRI was recommended by the
Planning and Zoning Board for City Commission approval and
further recommended that City commission find these modification
not to constitute a substantial deviation to the approved DRI.
This major site plan modification was before the Board on
November 16th, when concerns involving wall treatments,
particularly along Audubon, landscape treatments along Dotteral
and Lindell and demographic mix were voiced. Concerns for
screening the -CLift station at Dotteral and Lindell, mail
collection and service areas were indicated and evaluation of
these concerns was requested. The item was continued to December
21, 1987 meeting. The proponent chose not to submit for the
December meeting but to complete work on a comprehensive
submittal thus requiring no additional minor site plan
modification submittals at a later time, as would have been
required with the conceptual submittal. The proponent reviewed
that comprehensive site plan, with the Board at a December work
session. At that time, neighbors and Board members expressed
satisfaction with the revisions. The formal submittal is now
before the Board for action.

SITE PLAN ANALYSIS:
Perimeter treatments:
As per the Board's request, the proponent has incorporated the
originally approved wall treatment (Waterford Village DRI) along
Audubon Boulevard. The proponent is proposing alternatives to
wall treatments along Dotteral and Lindell by incorporating low
level berms and enhanced landscaping. Staff recommends approval
of the proposed perimeter buffering treatment with the following
recommendations.

PROJECT HISTORY:
The property was placed in the SAD zone district in May, 1985.
The project (Delint) was a D.R.I. Uses were permitted pursuant
to the SAD enacting ordinance and were classified as conditional
uses. A site plan was also approved for the project. Much work
has been done on the water system and installation of water and
sewer facilities for the entire project.
The residential portion of the property was not developed. In
June, 1987, a proposal was made to modify the site plan to
accommodate a housing product by Robertson Homes. That request
was later withdrawn. Subsequently, the current request for a
housing product by U.S. Shelter was submitted.
Concurrent with the processing of this site plan modification, an
amendment to the D.R.I. which would allow substitution of a
revised plan for the original site plan has been undertaken.
That action is preceding the site plan modification request.
SITE PLAN ANALYSIS:
The attached memorandum by Stan Weedon, Assistant Director,
documents a review of the files pertaining to review and approval
of the previous site plan. There apparently is no material in
record which _provides guidance to special treatment or
requirements for the project other than the location and type of
improvements shown on the approved site plan.

incorporated with the wall and the six foot portion of
the wall maintained a twenty-five foot setback from
the right-of-way line. A berm and and trees in
addition to the planters were in the setback area.
The modification shows a six foot C.B.S. wall with
off-sets every eighty feet. Tree lines (approximately
four trees per line) alternate exposure to the street
or to~the interior of the project per each off-set.
In addition to the above perimeter treatment there is another
area of encroachment of the perceived perimeter. This involves
the southwest corner of the project where a tennis court and
building #13 encroach visually upon the subdivision to the south.
This situation may be mitigated by reorientation of the building
and not allowing lighting for the tennis court.

Access / circulation system: Each project maintains the same
general access and circulation concept of a single access off
Lindell. The approved plan kept all parking off of the interior
spine (private street). The revised plan accommodates this
concept up to a point in the southwest corner at which a turn
around is provided. From then on, the road system also
accommodates parking movements. Although the concept of using
the road system for accommodating maneuvering area for parking
spaces, the Director of Planning and City Engineer support the
arrangement as proposed. Any use of the private street of
maneuvering purposes east of the turn-around is not acceptable.
There is only one means of access to the development. The
approved plan accommodates the potential for an emergency access
through the office complex. Such an arrangement may be
accommodated by uS1ny an emergency connection over the stabilized
sod area northeast of the lake. Another potential point of
emergency access is onto the interior road from Dotterel. Thes'e
potential points of access should be explored with review of tHe
more detailed site development plans.
A pedestrial trail system is provided in the modification. There
were no provisions for pedestrian traffic in the approved plan.
Parking spaces: The code allows that the spaces required for
visitor parking may D~ accommodated with stabilized sod instead
of asphalt paving. This concept has been used for seventy of the
provided parking spaces including an area by the lake which can
thus be used for multiple purposes (play and picnic area in
addition to overflow parking). Through the use of these spaces
the parking requirements for the project are met.

Department -- looping of the water system into Dotterel and
multiple ties through gravity mains into the existing sewer
system. Detailed plans must be approved through the Utility
Department and necessary utility easements reflected on the
detailed site plans when they are individually processed.

revised to reflect changes which have been made on the site

I have reviewed file number 6-121 and the D.R.I. file for
Waterford Place (aka Delint Center) and find no mention of five
of the six items noted below. Item five, the connection to the
office portion of the site was required primarily for
pedestrians. An emergency accessway is shown via a stabilized
sod cross-connection with a breakaway gate. This access does not
appear on recently submitted plans. I found no reference to
marketing or promotion connections. Please note that this search
is all-inclusive (plat, rezoning, D.R.I., and site plans).
A review of planning and Zoning Board meeting tapes for the
workshop of August 28, 1984, and regular meeting of September 17,
1984, contain no reference to these six issues:

On December 10, 1987, I submitted a memorandum to the
Commissioners to try to clarify current appointments to the
Code Enforcement Board and to explain past policy at the
request of Mrs. McCarty. Certain policy issues remain in
question. This item lS on the agenda to clarify these
policies as per Mrs. McCarty's request.
The following is a listing of policy statements which need
Commission concurrence or change:
1. Alternate members can serve more than 2 successive
terms.
2. Time served as an alternate does not count in calculat-
ing a regular members term if moved from alternate to
regular member.
3. Alternate members will be appointed to regular posi-
tions whenever possible.
4. Filling the unexpired term, of a regular member does
not count towards the two (2) three year term limit for
regular members.
If these policies apply then:
1. Mr. McDonald can be reappointed.
