AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY
BEACH, FLORIDA, REZONING AND PLACING LAND PRESENTLY ZONED
R-lA (SINGLE FAMILY DWELLING) DISTRICT, IN PART, AND RM-6
(MULTIPLE FAMILY DWELLING) DISTRICT, IN PART, IN RO
(RESIDENTIAL OFFICE) DISTRICT PARCELS OF LAND LYING AND
BEING IN SECTIONS 16 AND 17, TOWNSHIP 46 SOUTH, RANGE 43
EAST. SAID LANDS ARE LOCATED NORTH OF ATLANTIC AVENUE,
SOUTH OF N.W. 4TH STREET/N.E. 4TH STREET, BETWEEN N.E.
2ND AVENUE AND N.W. 1ST AVENUE, AND AMENDING "ZONING MAP
OF DELRAY BEACH, FLORIDA, 1983".
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. That the following described property in the City
of Delray Beach, Florida, is hereby rezoned and placed in the RO
(Residential Office) District as defined in Chapter 30 of the Code of
Ordinances of the City of Delray Beach to-wit:
Lots 8-16, inclusive, plus all of the North one-half and the East
131 feet of the North 250 feet of the South 352.75 feet of Block
57; Lots 1-24, inclusive, of Block 58; Lots 1-16, inclusive, of
Block 59; and Lots 1-12, inclusive, of Block 60, all of which are a
part of the Town of Linton Plat in Section 17, Township 46 South,
Range 43 East, as recorded in Plat Book 1, Page 3 in Palm Beach
County records. Together with Lots 1-28, inclusive, of Block 65;
Lots 1-16, inclusive, along with the West 139 feet of the North 50
feet of the South 200 feet along with the West 100 feet of the
North 50 feet of the South 150 feet, all of which are a part of
Block 66; Lots 1-3, inclusive, of the John B. Currie Subdivision,
as recorded in Plat Book 2, Page 81, in Palm Beach County records;
Lots 19 and 20 of the Resubdivision of the South 150 feet of the
West half of Block 66, as recorded in Plat Book 21, Page 48 in Palm
Beach County records; Lots 1-16, inclusive, of Block 67; Lots 1-12,
inclusive, of Block 74; and Lots 1-6, inclusive, of Block 75, all
of which are a part of the Town of Linton Plat in Section 16,
Township 46 South, Range 43 East as recorded in Plat Book 1, Page 3
in Palm Beach County records.
The subject property is located north of Atlantic Avenue, south of
N.W. 4th Street/N.E. 4th Street, between N.E. 2nd Avenue and N.W.
1st Avenue.
The above-described parcel contains a 40.25 acre parcel of land,
more or less.
Section 2. That the Planning Director of said City shall, upon
the effective date of this ordinance change the Zoning Map of Delray
Beach, Florida, to conform with the provisions of Section 1 hereof.
Section 3. That the above rezoning notwithstanding, pursuant
to the provisions of Section 30-8.4(N) (6), in the geographic area
bounded on the east by Swinton Avenue, on the west by N.W. 1st Avenue,
on the south by the south line of Lots 6 and 12, Block 60, and on the
north by the north line of Lots 5 and 11, Block 60, the regulations
contained in the POC Planned Office Center District shall apply, except
for building height, lot dimensions and site area, and quantity of
parking, which shall be governed by the RO (Residential Office) District
provisions.
Section 4. That this Ordinance shall become effective immedi-
ately upon passage on second and final reading.
PASSED AND ADOPTED in regular session on second and final
reading on this the 27th day of May , 1986.
