ORDINANCE NO. 31-86
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY
BEACH, FLORIDA, AMENDING CHAPTER 30, "ZONING", OF THE
CODE OF ORDINANCES OF THE CITY OF DELRAY BEACH, FLORIDA,
BY REPEALING SECTION 30-16 "SPECIAL SETBACK PROVISIONS",
SUBSECTION (P) "SETBACKS FOR SCREEN PORCHES" IN ITS
ENTIRETY; AMENDING SECTION 30-17 "SUPPLEMENTARY REGULA-
TIONS'' (G) "STRUCTURES ALLOWED IN SETBACKS" BY ADDING A
SUBSECTION (14) TO PROVIDE THAT NO SCREENED ENCLOSURES
MAY EXTEND CLOSER THAN TEN (10) FEET TO ANY REAR OR SIDE
(INTERIOR) PROPERTY LINE; PROVIDING A GENERAL REPEALER
CLAUSE; PROVIDING A SAVING CLAUSE; PROVIDING AN EFFECTIVE
DATE.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. That Section 30-16 "Special Setback Provisions",
Subsection (P) "Setbacks for Screen Porches" (1) (2) and (3) of the Code
of Ordinances of the City of Delray Beach, Florida, be and the same is
hereby repealed in its entirety.
Section 2. That Section 30-17 "Supplementary Regulations" (G)
"Structures Allowed in Setbacks" of the Code of Ordinances of the City
of Delray Beach, Florida, be and the same is hereby amended by adding
the following:
(14) Screened enclosures, as defined at Sec. 30-1(104),
may extend into the rear or side (interior) setback
area, but not closer than ten (10) feet to any rear
or side (interior) property line, or as otherwise
permitted in the zoning district.
Section 3. That all ordinances or parts of ordinances in
conflict herewith be and the same are hereby repealed.
Section 4. That should any section or provision of this
ordinance or any portion thereof, any paragraph, sentence, or word be
declared by a Court of competent jurisdiction to be invalid, such
decision shall not affect the validity of the remainder hereof as a
whole-or part thereof other than the part declared to be invalid.
Section 5. That this ordinance.shall become effective immedi-
ately upon passage on second and final reading.
PASSED AND ADOPTED in regular session on second and final
