06-09-15 Workshop Meeting MinutesWORKSHOP MEETING JUNE 9, 2015 A Workshop Meeting of the City Commission of the City of Delray Beach, Florida, was called to order by Vice Mayor Shelly Petrolia in the Commission Chambers at City Hall at 6:00 p.m., on Tuesday, June 9, 2015 Roll call showed: Present - Vice -Mayor Shelly Pet folia Deputy Vice -Mayor Alson Jacquet Commissioner Mitch Katz Commissioner Jordan Jarjura Absent - Mayor Cary Glickstein Also present were - Donald B. Cooper, City Manager Noel Pfeffer, City Attorney Chevelle D. Nubin, City Clerk Vice Mayor Petroha called the Workshop meeting to order and announced that it had been called for the purpose of considering the following Items. WORKSHOP MEETING AGENDA 1. Public Comments Vice Mayor Petrolia opened the meeting for public comment on the workshop meeting items. Public: 1. Beth Johnston read a statement into record about the city changing. Ms. Johnston discussed special events and asked what is going to happen in the future. She stated she does not feel this needs to be pushed through so quickly. Ms. Johnston also commented regarding bed nights and street closures. 2. George Jahn spoke regarding a sober house bill being passed in the state of Florida and stated there is no funding accompanying that bill. 3. —Casey Cleveland stated they support the City Commission and spoke in support of special events. He commented regarding the logistics and stated serious thought and consideration need to go into this. Mr. Cleveland stated he feels events add to the depth of the City of Delray Beach and adds to the generosity of the City of Delray Beach. 4. Kevin Rouse stated he had a recent issue on Saturday: he was shut down by the Police Department regarding sound. Mr. Rouse stated he feels there is a different way of handling this. He stated as a solution maybe there should be a courtesy call before businesses are to be shut down. S. John Fisher thanked the City Commission for riding in the parade and also for the proclamation. He read a statement into record re parades, room nights, spectator count, nonprofit organizations in the parade and proceeds. Mr. Fisher stated community support is needed. 6. Stephanie ixnxxaelrnan provided background information regarding her move to Delray Beach. She spoke about special events and stated the events attract a diverse group of individuals from all over. 7. Donald Zager from Fairfield Inn read a statement into record regarding events. He feels the events add needed room inventory, bed tax revenue and incremental tax revenue for Delray Beach. Mr. Zager stated he has seen the benefits of events in town. S. Greg Weiss spoke regarding the special event data and stated the community partner aspect was missing and citizens were not represented. He also commented about room nights. Mr. Weiss reiterated that the report had data that was inaccurate and stated private events were included. He asked what criteria was used regarding special events. 9. Terra Spero spoke about choosing to live in Delray Beach and referenced the Mayor's comment regarding special events and their impact on businesses. Ms. Spero stated she sees how excited people are about the events. 10. Nancy Stewart read a statement into record. She stated this is her third time participating in a review of special events. Ms. Stewart requested that accurate data be gathered and presented. She stated the policy that is in place is not followed and made comments regarding the report. 11. Charlie Himmelrieh read statement into record and stated city should conduct an accurate study regarding this. He stated the report shows bias and subjection. Opinions from both staff and business owners should have been included. 12. Sarah Valle -read read a statement regarding the running of special events and discussed recognition she has received. She stated the special events are what she loves to do and they affect her livelihood. 13. Ross Vallely stated he supports events. 14. Dave Leonard spoke regarding valet queues/parking and stated events ran by Ms. Stewart have had a positive impact on his business and employees. 15. Karen Granger thanked the City Commission for this process of getting all the players to the table and stated she loves events. She stated her concern is that the tone is events were needed at one point in time but events are not needed anymore. Ms. Granger discussed people who come to town and the vibe that people feel. She asked if data could be refined regarding the economic impact and spoke about residual bonuses/businesses and quality of life as a result of the events. Ms. Granger stated she hopes the dialog continues. 16. Michele Monahan stated she is an educator and she loves her students and they need the Garlic Festival. Ms. Monahan stated her students participated in the "I'm Giving Back" campaign. The monies they receive from the Garlic Festival purchase cases of food for her students. 17. Marty Harris stated she has been supporting events in Delray Beach for over 16 years and spoke about the Garlic Festival and Wine and Seafood Festivals. She stated that the events Delray Beach offers are different from what other cities in the South Florida area offer. 2 June 9, 2015 18. Rebecca Gosnell spoke about her Boy Scout Troop and stated they have been involved with Garlic Fest for 14 years. She stated the boys work very hard. Their summer camp is completely paid for because of the Garlic Fest. She asked City Commission to keep in mind that the Garlic Fest helps a lot of local longstanding charities. 19. Daniel Kellman Atlantic Community High School Band Leader, thanked Ms. Stewart and the Garlic Fest for their support of the band. He stated he is here to support Delray Beach. 20. Dan Castrillon stated people come to Delray Beach for the events; specifically rides at events. 21. Jennifer Aracri stated she has lived and worked in Delray Beach for over 18 years and spoke regarding events and the impact of certain events on non-profit organizations. She stated alot of children cannot afford a lot of things. 22. Don Wort stated he is in favor of special events. 23. Steve Siebert stated he volunteers at the Christmas parade and Garlic Fest. He stated he likes the vibe and events. Mr. Seibert stated he moved to Delray Beach from Boca Raton and stated it will be disappointing if the events change. 24. Zachary Siebert spoke regarding why Delray Beach needs events. He stated he has personally been involved in Garlic Fest for years and has benefitted from this. 25. Billy Himmelrich stated he is not in favor of the quantity of events held in Delray Beach. He stated he owns Old School Bakery and thinks the number of events can change. Mr. Him elrich stated he has been shut down because of events. He reiterated that he has benefitted from the relationships established at events but cannot get to his own property during events. He stated he is in favor of public events not private events. 26. David Cook thanked city staff for the research and stated he is glad they listened to them. Mr. Cook feels the events need tweaking and stated there needs to be better balance. 27. Michael Weiner spoke regarding Atlantic Avenue and special events. 28. Unknown stated events should be limited. 29. Bruce Gimmv stated events are an important part of why Delray Beach works and asked City Commission not to close Atlantic Avenue and to move events west. Mr. Gimmy provided a brief history regarding events in Delray Beach. 30. Jenny Diaz stated events are good for the city and urged City Commission to be careful regarding changes. 31. Mavis Benson stated events are wonderful and the city needs to re-evaluate some of them, re -invent some of them, and do them differently. She stated events can be moved to other areas of the city. Ms. Benson asked the City Commission to consider the merchants that are here every day. She stated the merchants do not need money being taken from their pockets. 32. Lois Brezinski stated she loves the city and has heard negative comments about events. 33. MatyMo�ausky-spoke regarding the Garlic Fest and stated this event has put Delray Beach on the map. She spoke about Nancy Stewart and the myriad of community members who benefit from this event. 3 June 9, 2015 34. Patrick Halliday stated events are important to Delray Beach and discussed other places for events instead of them being held at Delray Beach Centex for the Arts due to its landscape changing. He asked that the city looked at moving events to other areas or scale them down. 35. Bern Ryan read a statement into record stating that he feels staff that worked on this have been here long enough to go through one year of events. He asked the City Commission to work with event sponsors. 36. Cathy Balestriere spoke regarding special events and Crane's Beachouse. She stated the Delray Beach Marketing Cooperative is willing to work with the City Commission and stated no one asked them to help. 37. Jim Kni ht stated special events are positive for the city and suggested moving them to other areas of the city. 38. Vic Kitson stated people are not paying high prices for Atlantic Avenue because of events. He stated the events should be done correctly. He referenced the tennis event and its cost- out of the city's budget. He stated the city cannot afford to lose this kind of money. Mr. Kitson stated he would like to hear from the Parks and Recreation Director regarding this event losing money. 39. Chris ? stated his business has benefitted due to special events. 40. Tristan Giddings thanked the city for giving to the ACHS band. He stated the Garlic Fest helps with band fees. 41. Christina Morrison stated she read the report and stated a lot of it is true. She suggested looking at events and possibly scaling some of them back and moving them. She commented on the proposed staff person to run events and stated there should be a staff person like former assistant city manager Mr. Barcinski and spoke regarding bed nights. Ms. Morrison stated special events are the fabric of the community of Delray Beach and urged everyone to tread lightly. 42. Cindi Freeburn stated she came here to live because of the vibe and commented regarding the special events process. She stated the task force was missing citizenry and there was a poor representation of merchants. She stated the report contained suspect data and there was a lack of complete constituency. Ms. Fteeburn suggested to spread events out and discussed the quality of events. She stated she has participated in large and small events. She stated events are integral to Delray Beach and the process needs to be reviewed. 43. John Franczak spoke about Nancy Stewart and thanked the City Commission for the opportunity to share this. He spoke regarding special events and read a statement into record. 44. Christine Najack spoke about Nancy Stewart and the Wine and Seafood Festival and stated it was a successful event. 45. Laura Reinas stated she works for another city in their special events department and knows that special events mean a lot to people. 46. Cory Nicholas stated events affect his business Johnnie Brown's) in a positive manner. 47. Winston Williams stated he is a caterer and in Delray Beach events have been great for his business. He supports events. 4 June 9, 2015 48. Nand Lierle stated she represents a lot of the merchants in the 400 block. She stated she appreciates events but wishes they can be trimmed back some. She asked that the city prune the events or move them to wrest Atlantic Avenue. Vice Mayor Petrolia then closed public comments as there were no other speakers. 2. DELRAY BEACH SPORTS DESTINATION COMMITTEE PRESENTATION Margie Walden conducted a Powerpoint presentation. She provided the background of the Committee and recognized some of the members who were present. Ms. Walden discussed their primary function, economic impact numbers, top sports impacts, upcoming sports highlights, room nights, recommendations and goals for 2015. She introduced two retired NBA All Stars and stated they are here this week serving youth at a basketball camp at Pompey Park. She thanked the City Commission and staff who helped get this off the ground. The retired NBA All Stars commended Delray Beach and stated it is great to come into the city and helped the children. Mr. Katz asked if the committee was working on the plan in coordination with the city. Ms. Walden stated the committee would like direction from the City Commission and to develop a working group. Vice Mayor Petrolia asked if the city has anyone in house who can assist us with grants. The City Manager discussed the lobbying contract. Ms. Jarjura asked in regards to the city's state lobbyist if the scope is limited to just sober houses or can it include funding for special events, infrastructure improvements or other things we need. The City Attorney stated the federal lobbyist contract is lirnited to sober homes. Ms. Jarjura inquired if money can be added for infrastructure, etc. Mt. Jacquet reiterated that it was limited especially to sober homes. Discussion continued between Commission, staff and Ms. Walden regarding federal and state lobbyists, facilities study, sports events and their impact and Tennis Center utilization. Ms. Walden thanked her committee for their hard work. 3. DISCUSSION REGARDING SPECIAL EVENTS Mr. Cooper, City Manager, conducted a presentation and commented about his cover memo. He spoke regarding goal setting and discussed recommendations. He stated he is looking for direction from the City Commission. 5 June 9, 2015 Ms. Jarjura thanked the City Manager for the presentation and state she feels he articulated what was discussed at the goal setting. Ms. Jarjura clarified why everyone is here. She also discussed the importance and impact of events, the city recovering its costs for events -the financial impact in total to the city, impact to businesses and the location of events. She stated the majority of events are concentrated in Central Business District. Ms. Jarjura stated the amount of events and the locations of some of the events have turned some people off. She asked why not use the tennis center for events. She mentioned that the city already has rules and procedures in place regarding major, intermediate and minor events. She stated we are not complying with that and asked how did the city get to a point where we are not utilizing what is in place. City Manager Cooper stated staff has to develop a policy that is cogent. Ms. Jarjura stated she would like a clear process and procedures with delineation of events. She also stated the city should be 100% reimbursed for the impact of events --have a memorialized agreement with the city for the event, promote other areas of the city -motivate events to go to other areas. Ms. Jarjura spoke regarding the report itself and provided comments regarding the name and title, overview and insight regarding events, citizens/merchant representation, data collection, trying to encourage events that do not have a negative toll on city or not held at peak hours, and diversity of types of events. She stated this is not going to be overnight. She spoke regarding comments to organizers, closing off of businesses, quality of events, honoring local events, road closures -look at what time the road closures are happening, being respectful to local communities and businesses. Mr. Jacquet stated his problem is not with events but with the street closures. He stated events are integral to Delray Beach -it is why people come to our town. He stated the quality of events have gone down. He commented regarding merchants who spoke and stated he does not think the city needs a moratorium. Mr. Jacquet stated events should be reviewed as to what is Delray Beach and what is not. He also reiterated that the events should be diversified and the city needs more cultural events. He stated it is not about the number of events -the problem is people not knowing how to get around during events. He stated staff should go west regarding events. Mr. Jacquet suggested that the city clean up the events we have downtown. He stated tough decisions will have to be made and the City Commission will have to review the list. Mr. Jacquet asked about the busy season: October through April. He asked how can the events be spread out versus all crammed into a short period of time. Ms. Jarjura referenced the report i.e. carnival rides and asked does that include the carousel and skating rink for Christmas. She stated maybe this is distinguishing between public and private events. City Manager Cooper stated staff will clarify what that means. Mr. Katz stated the City Commission appreciates Nancy Stewart and also thanked staff. He stated the name suggested in the report was not that great. The Chamber gala is not an event. He stated everyone should look at what is good with the report that can be used. He discussed the recommendations and stated no one is after any particular events. He stated the Garlic best has evolved. He asked Nancy Stewart about her budget and about the rides. Ms. Stewart stated the event is modeled after Gilroy, California. Mr. Katz spoke regarding recommendations: #1 makes a lot of sense and is a good start. He stated event organizers and others should come in and work with staff. He stated everyone including the City Commission needs to have an open mind. He reiterated that no one has said the city needs to get rid of events and stated people want to see the events toned down a bit. Mr. Katz stated staff is going into the right direction. 6 June 9, 2015 Mr. Katz stated regarding Recommendation #2 (Moratorium on events in the Central Business District), this is a great recommendation. because it will require events to be held somewhere else. Mr. Katz also stated there are other areas where the city can continue to grow events without impacting the same area over and over. Regarding #3, he mentioned Christmas tree lighting and for #4, he stated he is waiting for the upcoming presentation. He reiterated that Stephanie Immelman still has Jazz on the Avenue and that amusement rides are not needed. Mr. Katz also spoke regarding road closings, an events coordinator or another person in Parks and Recreation. The City Manager stated that the city will need a single office where this will be coordinated. Ms. Jarjura stated that a new department is not necessarily needed; just a person i.e. possibly the Assistant City Manager. Mr. Katz stated he did see not where the report included the impact on the Police Department regarding overtime for special events. He stated he has watched the goal setting video twice and staff has done a good job. Vice Mayor Petrolia gave kudos to everyone involved in this report. She stated it was refreshing to have all of the department directors there. She stated everyone needs to remember the impact the events are having on our town. She read a statement into record regarding events. Mrs. Petrolia stated events are integral and the city is not here to get rid of events. She stated an understanding of events must grow as the city grows. She asked about event impacts, suggested that the city takes a moment to reevaluate events and determine whether to leave space open for new events. She stated that the effects of current events regarding fundraising for non -profits should be reviewed. Mrs. Petrolia stated each event should be reviewed in regards to what they bring: culture, patriotism, etc. She stated she feels that staff captured what the City Commission stated in the goal setting about events. Mrs. Petrolia stated she does not agree with another department or layer of bureaucracy. She mentioned Donna Beldowicz's special event expertise and possibly the new assistant city manager doing special events if Ms. Francine Ramaglia does not want to. Vice Mayor Petrolia suggested looking at outsourcing i.e. staff, diversification of events, quality versus the quantity of events. She mentioned tightening up the Delray Affair regarding booths/display of tents, etc. feels businesses are being affected financially. Vice Mayor Petrolia stated that the City Manager is headed in the right direction. Mr. Katz stated he has met with the chairman of the Chamber regarding the Delray Affair. He asked the Chamber to work with the businesses so that it works out for everyone. He stated the businesses must be incorporated in these events and it is possible to get them involved. Vice Mayor Petrolia discussed the submittal time regarding events and stated something should be accomplished in 2016 so that in 2017 it can be in place. 7 June 9, 2015 4. DISCUSSION REGARDING FOOD TRUCK ORDINANCE Janet Meeks conducted this presentation and provided background information regarding the pilot program. Fourteen (14) food trucks have been permitted on a temporary basis and operating out of Saltwater Brewery. She discussed the stakeholder committee meeting regarding food trucks and highlighted some of the recommendations: they felt the application fee of $300 was not enough and they did not want food trucks in the Central Business District. Also, at the food track stakeholder meeting, they felt $500 was too much for the application fee and wanted to see more areas allowed. Ms. Meeks discussed the permit fee and the hours and days of operation. She stated staff would like direction on how to proceed. Mr. Katz stated the city needs to keep the food trucks going and utilize them. He asked if the City Commission has to change it or can the city keep it going. Ms. Jarjura stated this is the only area where it is allowed right now. Mr. Katz suggested that it can be expanded in areas outside of the Central Business District. Ms. Joura stated she is ok with expanding it as suggested in the staff report, as well as Planned Commercial (PC) and General Commercial (GC) areas. She stated the permit fees ($500) are an excessive amount and the amount should be more in line with what other cities are doing. Regarding hours of operation, she stated the city can allow for expanded hours of operation where appropriate. Mr. Katz suggested whatever hour the business closes. Mr. Jacquet stated this it is a good idea to have food trucks where there are late hours. He stated the pilot program speaks for itself and it has been a great success. Mr. Jacquet suggested that it be kept as a rotation. He also discussed bines and costs; he stated the fines need more teeth. Vice Mayor Petrolia suggested looking at other areas and what they are doing regarding food trucks. She stated staff has done a great job. Vice Mayor Petrolia stated the city should lower the processing fee and raise the fine. She mentioned other possible areas and it being also done as a special event. Mr. Katz stated businesses in the Central Business District are looking to have their own food trucks. 5. COMMISSION COMMENTS Mr. Katz stated he attended the Institute for Elected Municipal Officials this weekend sponsored by the Florida League of Cities (FLC), spoke regarding budget and what the City Commission receives. He stated they received variance reports every month (one pager). Mr. Cooper, City Manager, stated the reports can be done by fund or by department. Mr. Katz referenced the Government in the Sunshine Booklet and discussed workshops being held around town. He commented regarding technology. June 9, 2015 Mr. Jacquet spoke of bringing the City Commission Meetings to the people and asked staff to figure out a way to do this. Ms. Jarjura commented on sober house legislation and stated she hopes someone is following up on this. She inquired as to whether a state lobbyist is handling this or the city. Mr. Pfeffer, City Attorney, stated he will call tomorrow morning and follow up on this. Mr. Jacquet commented about Osceola Paxk and thanked the City Manager for working on this. He asked that the city finds a way to recognize people who have made contributions to the town. He stated he was recently appointed to the Palin Beach County Tourist Development Council and he commented regarding employees who are doing well. He commended the new code officer. Vice Mayor Petroha inquired about the garbage pickup and what areas were missed. She also commented on the Mango best and stated it was a great event. She asked everyone to take into consideration what it will entail to have the City Commission Meetings in different areas around town. Ms. Jarjura spoke about having town hall meetings, each Commissioner having a pre -agenda meeting and roving meetings. She suggested having a quarterly meeting at another location. Mr. Jacquet discussed noticing of meetings and the Sunshine Law. Mr. Katz stated this is in reference to workshops meetings. Vice Mayor Petrolia stated the Commission has to gain consensus as to how to proceed regarding the meetings. Mr. Jacquet inquired about the towing contract.
