SPECIAL MEETING
AUGUST 26, 2015
A Special Meeting of the City Commission of the City of Delray Beach, Florida, was called to order
by Mayor Cary Glickstein in the City Commission Chambers at City Hall at 4:00 p.m., on
Wednesday, August 26, 2015.
Roll call showed:
Present -- Vice Mayor Shelly Petrolia
Deputy Vice Mayor Alson Jacquet
Commissioner Mitch Katz
Mayor Cary Eckstein
Absent -- Commissioner Jordana Jarjura
Also present were - Donald B. Cooper, City Manager
Noel Pfeffer, City Attorney
Chevelle D. Nubin, City Clerk
Mayor Glickstein called the Special meeting to order and announced that it had been called for the
purpose of considering the following Item.
SPECIAL MEETING AGENDA
Mayor Glickstein opened the meeting for public comment on the special meeting item.
1. Public Comments:
Bob Ganger, Florida Coalition - spoke regarding the Atlantic Crossing Project and
previous public hearings i.e. the entrance and exit from Federal Highway and modification
of plan.
Mayor Glickstein then closed public comments as there were no other speakers.
2. Atlantic Crossing Project: Letter from Mike Covelli dated August 21, 2015. Motion
to Exercise the Ci 's reconve ance rights pqrsuant to the "Declaration of Reserved
Rights And Agreement Not To Encumber The Abandoned Alley" executed by the
City on February 24, 2009.
Mr. Noel Pfeffer, City Attorney, introduced this item and explained why the meeting was
requested. He discussed the letter received from Michael Covelli on behalf of the developer of
Atlantic Crossing. He stated the City Commission must take action prior to the five (5) day
requirement. Mr. Pfeffer stated he will request a subsequent shade meeting for continued
discussion in greater detail regarding the settlement issues.
Discussion ensued between the City Commission and the City Attorney.
Mr. Katz moved motion for the city to exercise its reconveyance rights pursuant to the
Declaration of Reserved Rights And Agreement Not To Encumber The Abandoned Alley; and
authorize the City Manager to execute and send notice letter (which must be sent prior to 5:00
p.m. today), seconded by Mrs. Petrolia. Upon roll call the Commission voted as follows: Mr.
Jacquet — Yes; Mr. Katz — Yes; Mayor Eckstein — Yes; Mrs. Petrolia — Yes. Said motion
passed with a 4 to 0 vote.
Mayor Glickstein adjourned the Special Meeting at 4:11 p.m.
