09-03-15 Special Meeting MinutesSPECIAL MEETING SEPTEMBER 3, 2015 A Special Meeting of the City Commission of the City of Delray Beach, Florida, was called to order by Mayor Cary Glickstein in the Comnaission Chambers at City Hall at 4:30 p.m., on Thursday, September 3, 2015. Roll call showed: Present - Vice Mayor Shelly Petrolia Deputy Vice Mayor Alson Jacquet Commissioner Mitch Katz Commissioner Jordana Jarjura Mayor Cary Glickstein Absent - None Also present were - Donald B. Cooper, City Manager Noel Pfeffer, City Attorney Chevelle D. Nubin, City Clerk Mayor Glickstein called the Special meeting to order and announced that it had been called for the purpose of considering the following Items. SPECIAL MEETING AGENDA 1. CLOSED ATTORNEY/CLIENT SESSION pursuant to F.S. 286.011(8) re: Edwards CDS, LLC v. City of Delray Beach, Florida, Case No. 502015CA007155XXXXMB AE. Attendees: Mayor Cary D. Glickstein Vice Mayor Shelly Petrolia Deputy Vice -Mayor Al Jacquet Commissioner Jordana Jarjura Commissioner Mitchell Katz City Manager Donald Cooper City Attorney Noel Pfeffer Jamie Alan Cole, Special Counsel Steve Rubin, Special Counsel A certified court reporter Purpose: Discuss settlement negotiations and strategy related to the above case. 2. SETTLEMENT OF_EDWARDS CDS, _.._LLC V. CITY OF DELRAY BEACH, FLORIDA. Mayor Glickstein gave a brief overview regarding the Closed Attorney/Client Session. He explained that the meeting would include the list of attendees as outlined above. The session would last about thirty (30) minutes. Mayor read a statement into record regarding the Florida Statutes that govern Closed Door Meetings. Mr. Pfeffer indicated why he requested the meeting. All Attendees met in the First Floor Conference Room for the Closed Door Attorney/Client Session.. Mayor Eckstein reconvened the Special Meeting at 4:55 p.m. and stated the Closed Session is terminated. City Attorney Pfeffer stated he sent a letter to the counsel of the developer and outlined what was in the letter regarding process and discussed a motion. Mr. Jamie Cole stated this is neither a settlement communication nor a settlement of any lawsuits and stated this is public. Mayor Glickstein spoke regarding the site plan review process and asked Mr. Cole and Mr. Pfeffer if they are in support. Ms. Jarjura moved to accept the process as outlined in the August 13, 2015 Letter and give the developer no later than close of business Friday, September 11, 2015 to accept the process, seconded by Mr. Jacquet. Upon roll call the Commission voted as follows: Mr. Jacquet — Yes; Mr. Katz — Yes; Ms. Jarjura — Yes; Mayor Glickstein — Yes; Mrs. Petrolia — Yes. Said motion passed with. a 5 to 0 vote.
