51-86 ORDINANCE NO. 51-86 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY "ZONING", BEACH, FLORIDA, AMENDING CHAPTER 30, OF THE CODE OF ORDINANCES OF THE CITY OF DELRAY BEACH, BY REPEALING SECTION 30-1 "DEFINITIONS", (45) "HOTEL", AND ENACTING A NEW SECTION 30-1 "DEFINITIONS", (45) "HOTEL", DEFINING HOTELS AND INCLUDING ANCILLARY USES WHICH ARE TYPICALLY ACCESSORY TO HOTELS; BY REPEALING SECTION 30-17 "SUPPLEMENTARY REGULATIONS", (R) "HOTELS AND MOTELS", SUBSECTION (2) "LOCATION", AND ENACTING A NEW SECTION 30-17 "SUPPLEMENTARY REGULATIONS", (R) "HOTELS AND MOTELS" SUBSECTION (2) "LOCATION", REQUIRING ACCESSORY USES TO BE LOCATED WITHIN THE BUILDING UNLESS CONDITIONAL USE IS OBTAINED; BY AMENDING SECTION 30-17 "SUPPLEMENTARY REGULATIONS" (R) "HOTELS AND MOTELS" BY ADDING A NEW SUBSECTION (3) "SIGNS" TO PROHIBIT SIGNS DESIGNATING THE ACCESSORY USES ALLOWED IN CONJUNCTION WITH A HOTEL FROM BEING. ATTACHED TO THE OUTSIDE OF THE HOTEL UNLESS AP- PROVED AS PART OF ANY CONDITIONAL USE APPROVAL OR MODIFI- CATION FOR THE PRIMARY HOTEL USE; PROVIDING A SAVING CLAUSE; PROVIDING A REPEALER CLAUSE; PROVIDING AN EFFEC- TIVE DATE. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That Chapter 30 "Zoning", Section 30-1 "Defini- tions'', (45) "Hotel" of the Code of Ordinances of the City of Delray Beach, Florida, is hereby repealed and a new Section 30-1 "Definitions", (45) "Hotel" is hereby enacted to read as follows: (45) Hotel. A building containing ten (10) or more sleeping rooms in which transient guests are lodged with or without meals with no provision made for cooking in any individual room or suite and 'having or not having one (1) or more of the following accessory uses: dining rooms, restaurants or cafes, cocktail lounges or bars subject to Chapter 3 of the Code of Ordinances, package liquor store subject to Chapter 3, shoe shine parlor, ice cream shop, limo services or rental car counter used primarily for hotel business, airlines and travel agency counters, men's and women's boutique, gift shop and sundries, flower shop, hair dresser and barber shop, confec- tionery and chocolate shop, exercise facilities, conference and meeting facilities, laundry and dry cleaning, catering, secretarial service, baby- sitting service, and any other uses otherwise permitted within the District. Such building would structurally and for purpose of safety be obliged to conform to the laws of the State regulating hotels. Section 2. That Chapter 30 "Zoning", Section 30-17 "Supplemen- tary Regulations", (R) "Hotels and Motels", (2) "Location" of the Code of Ordinances of the City of Delray Beach, Florida, is hereby repealed and a new Section 30-17 "Supplementary Regulations", (R) "Hotels and Motels", (2) "Location" is hereby enacted to read as follows: (2) Location. If lounges, limo service or rental car counters are being provided as accessory uses, such uses shall be oriented primarily to hotel/motel guests and shall be located within the building so as to not be visible to the General Public, unless conditional use approval is obtained. Section 3. That Chapter 30 "Zoning", Section 30-17 "Supplemen- tary Regulations", (R) "Hotels and Motels" of the Code of Ordinances of the City of Delray Beach, Florida, is hereby amended by adding the following: (3) Signs. Signage designating those accessory uses allowed in conjunction with a hotel, as defined at Sec. 30-1(45), shall be prohibited from being attached to the outside of the hotel, unless such signage is approved as part of any conditional use approval, or modification thereof, for the primary hotel use. Section 4. That should any section or provision of this ordinance or any portion thereof, any paragraph, sentence, or word be declared by a Court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or part thereof other than the part declared to be invalid. Section 5. That all ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed. Section 6. That this ordinance shall become effective ten days after passage on second and final reading. PASSED AND ADOPTED in regular session on second and final reading on this the 26th day of August , 1986.
