DISCUSSION REGARDING THE SIDEWALK CAFÉ ORDINANCE
Recommended Action:
Discussion of Sidewalk Cafe' Ordinance.
Background:
The item before the City Commission is a discussion on the Sidewalk Café Ordinance. In February of
this year, the Sidewalk Café regulations were changed via Ordinance No. 03-15. In July, as part of
the permit renewal process, the Code Enforcement Division notified the Sidewalk Café operators that
they would need to come into compliance with the new regulations that mainly affected setback
dimensions. However, it was found in the field that there were other areas of the regulations that
were not being adhered to and if brought into compliance, a large percentage of the sidewalk café
area (tables and chairs) would be eliminated and result in the loss of revenue to the restaurants.
Therefore, the reason the Community Improvement Department currently has 9 waiver requests to
the Sidewalk Café Ordinance. However, Staff is concerned about maintaining the safety of
pedestrians and maintaining ADA standards within the public rights-of-way and there is conflicting
and confusing language in the Ordinance. Based on these issues, staff is looking for clarification and
direction from the City Commission.
