AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF
DELRAY BEACH, FLORIDA, AMENDING CHAPTER 35, "EMPLOYEE
POLICIES AND BENEFITS", GENERAL EMPLOYEES' RETIREMENT
PLAN; AMENDING SECTION 35.090, "PARTICIPATION", TO
PROVIDE FOR THE REEMPLOYMENT OF RETIRED PARTICIPANTS
UNDER CERTAIN CIRCUMSTANCES; PROVIDING FOR
SEVERABILITY; PROVIDING FOR INCLUSION IN THE CODE; AND
PROVIDING AN EFFECTIVE DATE.
IT IS HEREBY ORDAINED BY THE CITY COMMISSION OF THE CITY OF DELRAY
BEACH, FLORIDA, AS FOLLOWS:
Section 1. That a new subsection (G) is added to Section 35.090, "Participation", of the
Code of Ordinances of the City of Delray Beach, to read as follows:
Sec. 35.090. - PARTICIPATION.
(G) An employee who retires and begins to receive retirement income may, following cessation
of all City employment for a period of at least thirtT(30) days, return to City employment in a
part-time capacity or in a full-time positon not covered by this plan and continue receiving
retirement income from the plan. In no event shall such reemployment be arranged or agreed to
prior to the employee's retirement.
Section 2. Severability. The provisions of this Ordinance are declared to be severable and if
any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be invalid or
unconstitutional, such decision shall not affect the validity of the remaining sections, sentences, clauses, and
phrases of this Ordinance but they shall remain in effect, it being the legislative intent that this Ordinance
shall stand notwithstanding the invalidity of any part
Section 3. Inclusion in the Code. It is the intention of the City Commission, and it is hereby
ordained that this Ordinance shall become and be made a part of the City of Delray Beach City Code; that
the sections of this Ordinance may be renumbered or relettered to accomplish such intention; and that the
word "Ordinance" shall be changed to "Section" or other appropriate word.
Section 4. Effective Date. That this Ordinance shall be effective immediately upon its passage
on second and final reading.

PLAN WITH REGARD TO REHIRE OF RETIRED EMPLOYEES

Background:
TheCityCommission,byconsensus,requestedthattheCitydevelopapolicythatwouldallowforthe
rehiring,inlimitedcircumstances,ofretiredCityemployeesreceivingCitypensiondistributions.This
issuerecentlycametolightwithrespecttoadesiretorehire,onaparttimebasis,retiredpolice
officers with specialized skills and experience based on their long service record.
ThisissueisnotuniquetoDelrayBeachandaffectsalllocalgovernments.In2011,theIRSreleased
aPrivateLetterRulinginresponsetothecommonpracticeofgovernmentsimmediatelyrehiringits
retiredemployeeswhoarealsoreceivingpensiondistributions.TheIRSrulingheldthatifboththe
employerandemployeeknowatthetimeofretirementthattheemployeewill,withreasonable
certainty,continuetoperformservicesfortheemployer,aseparationfromemploymenthasnot
occurredandtheemployeehasnotlegitimatelyretired.Thisrulingcausedgreatconcernamong
localgovernmentsbecauseviolationofIRSrulescouldresultinthedisqualificationofthepension
plan.
InresponsetothisIRSruling,localgovernmentshaveadoptedpoliciesthatrequireaminimumbreak
inservicefollowingabonafideretirementandterminationofservices.ACitymayrehireitsretired
employeesandprovidearetirementdistributiontotherehiredretireeifabonafideretirementhas
occurred.Forexample,theFloridaRetirementServiceestablishedaonemonthbreakinservice
followingterminationofemploymentbeforereemploymentwithaFRSagency(FRSnowrequiresa6
month break in service).
Accordingly,theCityAttorney’sofficetogetherwiththeCity’sspecialpensioncounselhaveprepared
anordinanceaddressingthisissuebyamendingtheGeneralEmployeespensionplan.The
ordinanceprovidesthataretiredCityemployeereceivingretirementincomemustceaseallCity
employmentforaperiodofatleast30days.Also,theremustbenoagreementforreemployment

prior to the member’s retirement.
Itshouldalsobenotedthattheordinancepreventsanemployeefromvestingasecondpensionwith
thesameplan.Forthisreason,anemployeemayonlyberehiredonaparttimebasisifheorshewill
becoveredbythesameplanfromwhichheorsheretired.Forexample,aretiredpoliceorfire
rescueemployeemayonlyworkparttimeinapositioncoveredbythepoliceandfirerescueplan,but
mayworkfulltimeinapositioncoveredbythegeneralemployeeplan.Theconverseappliesto
retired members of the General Employee pension plan.
