68-86 ORDINANCE NO. 67-86 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AMENDING CHAPTER 26, "TRAFFIC", ARTICLE II, "STOPPING, STANDING AND PARKING", DIVISION 3.5, "PARKING METER ZONES", OF THE CODE OF ORDINANCES OF THE CITY OF DELRAY BEACH, FLORIDA, BY AMENDING SECTION 26-68, "PARKING PERMITS", TO ADD A NEW SUBPARAGRAPH TO ESTABLISH THE INGRAHAM AVENUE PARKING LOT AS A CITY RESIDENT ONLY PARKING LOT WHICH REQUIRES OBTAINING AN ANNUAL PARKING PERMIT IN ADVANCE AT A YEARLY COST OF $25.00 AND RELETTERING THE REMAINDER OF SECTION 26-68 APPROPRIATELY; PROVIDING A SAVING CLAUSE; PROVIDING A GENERAL REPEALER; PROVIDING AN EFFECTIVE DATE. WHEREAS, it is the desire of the City Council of the City of Delray Beach, Florida, to provide for additional parking east of the Intracoastal Waterway at Ingraham Avenue; and, WHEREAS, the City Council of the City of Delray Beach, Florida, does also deem it appropriate, and in the best interests of the welfare of the residents of the City of Delray Beach, Florida, to restrict parking in this Ingraham Avenue parking lot to residents only, utilizing an annual parking permit. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That Chapter 26, "Traffic", Article II, "Stopping, Standing, and Parking", Division 3.5, "Parking Meter Zones", of the Code of Ordinances of the City of Delray Beach, Florida, be, and the same is hereby amended by amending Section 26-68, "Parking Permits", to read as follows: Section 26-68. Parking Permits. (a) A "parking meter permit" may be purchased from the City by all persons which shall aut-'~rize the parking of the vehicle for which the permit was acquired in any parking meter space except those otherwise restricted located within the Anchor Park and Sandoway Park parking lots only ~ without requiring the payment of money into the space's parking meter. (c) The cost-of the parking permits shall be twenty-five dollars ($25.00) per year. Each permit shall cover the period from October first through September thirtieth, and there shall be no proration of the permit fee. The application procedure and the form of the permits shall be determined by the City administration. It shall be illegal to deface a parking permit or to transfer a parking permit from the vehicle for which it was acquired, to any other vehicle; provided, however, upon the parking permit sticker, and other sufficient proof being submitted to the City, and when approved in advance by the City Manager, a parking permit may be transferred (and a substitute sticker shall be issued) to a substitute vehicle acquired by the same permit holder subsequent to the issuance of the original parking permit. Section 2. That should any section or provision of this ordinance or any portion thereof, any paragraph, sentence, or word be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof ~s a whole or part thereof other than the part declared to be invalid. Section 3. That all Ordinances or parts of Ordinances in conflict herewith be and the same are hereby repealed. Section 4. That this Ordinance shall become effective immediately, and applicable to all permits issued on or after October 1, 1986. MAYOR ATTEST: First Reading October 28. 1986 Second Reading November 11, 1986 2 ORD NO. 67-86 ORDINANCE NO. 68-86 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AMENDING CHAPTER 30, "ZONING", OF THE CODE OF ORDINANCES OF THE CITY OF DELRAY BEACH, FLORIDA, BY AMENDING SECTION 30-17.5, "SATELLITE DISHES", BY AMENDING SUBSECTION (A), "DEFINITION" TO PROVIDE FOR THE DEFINITION OF ROOF LINE AND TO NUMBER THE SUB-SUBSECTIONS ACCORDINGLY; PROVIDING A SAVING CLAUSE; PROVIDING AN EFFECTIVE DATE. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That Chapter 30, "Zoning", Section 30-17.5, "Satellite Dishes", Subsection (A), "Definition", of the Code of Ordinances of the City of Delray Beach, Florida, be and the same is hereby amended to read as follows: A. Definitions. (1) Roof line shall mean the level of the surface used to weather proof the buildings. It shall not include projections'above the basic' rbo~ planes such as parapet walls, mechanical equipment rooms or enclosures, elevator etluipment rooms, etc. (2) The term satellite dish or satellite television antenna is interchangeable and refers to any apparatus designed to receive television or radio signals from orbiting satellites. Section 2. That should any section or provision of this ordinance or any portion thereof, any paragraph, sentence, or word be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or part thereof other than the part declared to be invalid. Section 3. That this ordinance shall become effective ten (10) days after its passage on second and final reading.
