73-86 ORDINANCE NO. 73-86 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AMENDING CHAPTER 30, "ZONING", OF THE CODE OF ORDINANCES OF THE CITY OF DELRAY BEACH, FLORIDA, BY AMENDING SECTION 30-6.5 "RM (MEDIUM TO MEDIUM HIGH DENSITY DWELLING) DISTRICT", (E) "AGGREGATE FLOOR AREA" TO REDUCE THE MINIMUM FLOOR AREA REQUIREMENTS FOR MULTIPLE FAMILY DWELLING UNITS; AMENDING SECTION 30-7 "RM-10 (MULTIPLE FAMILY DWELLING) DISTRICT", (E) "AGGREGATE FLOOR AREA" TO REDUCE THE MiNI~.KIM FLOOR AREA REQUIREMENTS FOR MULTIPLE FAMILY DWELLING UNITS; AMENDING SECTION 30-7.5 "RH (MEDIUM HIGH TO HIGH DENSITY DWELLING) DISTRICT", (E) "AGGREGATE FLOOR AREA" TO REDUCE THE MINIMUM FLOOR AREA REQUIREMENTS FOR MULTIPLE FAMILY DWELLING UNITS; AMENDING SECTION 30-8 "RM-15 (MULTIPLE FAMILY DWELLING) DISTRICT", (E) "AGGREGATE FLOOR AREA" TO REDUCE THE MINIMUM FLOOR AREA REQUIREMENTS FOR MULTIPLE FAMILY DWELLING UNITS; PROVIDING A SAVING CLAUSE; PROVIDING A GENERAL REPEALER CLAUSE; PROVIDING AN EFFECTIVE DATE. .NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That Chapter 30, "Zoning", Section 30-6.5 "RM (Medium to Medium High Density Dwelling) District", (E) "Aggregate Floor Area" of the Code of Ordinances of the City of Delray Beach, Florida, is hereby amended to read as follows: (E) AGGREGATE FLOOR AREA The following shall be the minimum floor areas for all multiple family dwelling units, expressed as net living area, exclusive of balconies, decks, porches, and common areas such as corridors: (1) Efficiency 400 sq. ft. (2) One (1) bedroom 6~8-~-~ 550 sq. ft. (3) Two (2) bedrooms 9~8-~r-~ 850 sq. ft. (4) Three (3) bedrooms ~7-1~-~-f{=- 1,000 sq. ft. (5) Four (4) or more bedrooms fT-3~-~-f~-~ 1,000 sq. ft. + 150 sq. ft. for each bed- room over three Section 2. That Chapter 30, "Zoning", Section 30-7 "RM-10 (Multiple Family Dwelling) District", (E) "Aggregate Floor Area" of the Code of Ordinances of the City of Delray Beach, Florida, is hereby amended to read as follows: (E) AGGREGATE FLOOR AREA The following shall be the minimum floor areas for all multiple family dwelling units, expressed as net living area, exclusive of balconies, decks, porches, and common areas such as corridors: (1) Efficiency 400 sq. ft. (2) One (1) bedroom 68~-~v-~r 550 sq. ft. (3) Two (2) bedrooms 9Q~-~/f-~-t-. 850 sq. ft. (4) Three (3) bedrooms ~-r~-~-~r 1,000 sq. ft. (5) Four (4) or more bedrooms ~-F~-~q~-~ 1,000 sq. ft. + 150 sq. ft. for each bed- room over three Section 3. That Chapter 30, "Zoning", Section 30-7.5 "RH (Medium High to High Density Dwelling) District", (E) "Aggregate Floor Area" of the Code of Ordinances of the City of Delray Beach, Florida, is hereby amended to read as follows: (E) AGGREGATE FLOOR AREA The following shall be the minimum floor areas for all multiple family dwelling units, expressed as net living area, exclusive of balconies, decks, porches, and common areas such as corridors: (1) Efficiency 400 sq. ft. (5) Four (4) or more bedrooms ~-3~8-~cfr-f-t-r 1,000 sq. ft. + 150 sq. ~t. for each bed- room over three Section 4. That chapter 30, "Zoning", Section 30-8 "RM-15 (Multiple Family Dwelling) District", (E) "Aggregate Floor Area" of the Code of Ordinances of the City of Delray Beach, Florida, is hereby amended to read as follows: (E) AGGREGATE FLOOR AREA The following shall be the minimum floor areas for all multiple family dwelling units, expressed as net living area, exclusive of balconies, decks, porches, and common areas such as corridors: (1) Efficiency 400 sq. ft. (2) One (1) bedroom 6~~--~4~ 550 sq. ft. (3) Two (2) bedrooms 9~q~-~-~ 850 s~. ft. (4) Three (3) bedrooms -1-r~-sq.-~f-~ 1,000 sq. ft. (5) Four (4) or more bedrooms -1-r~§~sq~-~-~ 1,000 sq. ft. + 150 sq. ft. for each bed- room over three Ord. No. 73-86 -- 2 -- Section-5. That should any section or provision of this ordinance or any portion thereof, any paragraph, sentence, or word be declared by a Court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or part thereof other than the part declared to be invalid. Section 6. That all ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed. Section 7. That this ordinance shall become effective immediately upon passage on second and final reading.
