Consider execution of a water service agreement with Military Trail Investors, Ltd., a Florida Limited Partnership, for a parcel of land located on the east side of Military Trail, south of Linton Boulevard. The property is zoned Commercial- and the proposed use is for an office complex and racketball facility. The property is not contiguous. Recommendation: Public Utilities Director approval. Action: Motion to approve. recommends * 12. Water Service Outside City William A. Chamberlain. Consider execution of water service agreement with William A. Chamberlain for a parcel of land located on the south side of Avenue G, west of South Federal Highway and east of Dixie Boulevard. Present use of the property is duplexes and proposed use is for an automobile dealership. The property is zoned CG (General Commercial) and is not contiguous. Consider final plat approval for Seagate Arms, an approved eight unit multiple family project, located at the northwest corner of Seagate Drive and Bucida Road. Consider granting a l2-foot easement deed to High Point of Delray Condominium Sections 5 and 6 for the purpose of drainage pipeline. Recommendation: City Attorney recommends approval. Consider approval of execution of Amendment No. 3 to the Refuse Contract between the City and Waste Management, Inc. of Florida to provide roll-out cart service-to The Palms of Delray. Recommendation: City Attorney recommends approval. Action: Motion to approve. * 16. Revised Lago Del Rey Signed Agreement. Consider approval of execution of Revised Lago Del Rey Agreement for the continued location of the sign on the right-of-way at the northwest corner of Homewood Boulevard and Casita Way. Recommendation: City Attorney recommends approval. Action: Motion to approve. * 17. Revised Aareement Between the City and Library Association. Consider approval of execution of Revised Agreement between the City and the Delray Beach Public Library Association, Inc. to administer a grant of $150,000 from Florida Department of Sta~e, Division of Library Services for library construction funds. Action: Motion to adopt the Resolution. approved * 21. Rezoning Request - North of Atlantic Avenue between Bigh Point Boulevard and Hamlet Drive (The Commonsl. Resolution No. 12-84 requests permission from the Palm Beach County Board of Commissioners to rezone land annexed from AR (Agricultural Residential) (County) to SAD (Special Activities District) (City) . Recommendation: Planning & Zoning Board approved 6-1 (Sumrall dissenting), subject to conditions stated in attached memorandum. Action: Motion to adopt the Resolution. *22. Rezoning Request South of Germantown Road. between Conaress Avenue and S. W. 22nd Avenue (Lakesidel. Resolution No. 13-84 requests permission from the Palm Beach County Board of Commissioners to rezone land annexed from AR (Agricultural Residential) (County) to SAD (Special Activities District) (City). Recommendation: Planning & Zoning Board approved 4-2 (Carey and Simon dissenting) . Action: Motion to adopt the Resolution. *23. Aoolication for a Borrow Area Easement over State Lands. Resolution No. 14-84 authorizes the submittal of an application to the State Department of Natural Resources requesting the need for a borrow area easement over State lands in connection with a maintenance renourishment project. Consider appointment of two Regular members to terms ending March 15, 1987, one Alternate member to a term ending March 15, 1985 and two Alternate members to terms ending March 15, 1987. Recommendation: Council action. Action: Motion to appoint Board members. *25. City Second Non-Partisan Election - pollworkers. Recommendation: Council action. Action: Motion that in the event a second non-partisan election is necessary, the City Clerk be author- ized to select from the list of pollworkers used by the County for this election (and discuss the preelection procedure) . * 26. Florida East Coast Railroad Crossina at S. E. lst Street. Consider authorizing the expenditure of $17,500 for the railroad crossing replacement at S. E. 1st Street, including pavement restoration, traffic control, etc. to be accomplished by FEC Railroad. Funds are to come from the 1983/84 budget for the downtown by-pass project of which S. E. 1st Street is a part. Recommendation: Director of Public Works/City Engineer recommends approval. Action: Motion to approve. *27. Ordinance No. 9-84 - Changing the City's Land Use Plan Desianation. First Reading relative to changing the City's Land Use Plan Designation in the Comprehensive Plan for a parcel of land located east of I-95, between Carver Middle School and Carver Estates (Delray Beach Housing Authority, Applicant) . Recommendation: Planning & Zoning Board approved 6-1 (Carey dissenting) . Action: To pass the Ordinance on First Reading. Note: If passed, Public Hearing March 13th. * 28. Ordinance No. 10-84 Delray Beach Housina Authority Rezoning. First Reading relative to rezoning of a 10.51- acre parcel of land, subject to RM-10 (Multiple Family Dwelling) District, located east of I-95, between Carver Middle School and Carver Estates. Recommendation: Planning & Zoning Board approved 6-1 (Carey dissenting) . Action: To pass the Ordinance on First Reading. Note: If passed, Public Hearing March 13th. * 29. Ordinance No. II-B4 The Commons Annexation. First Reading relative to annexing a 4.67-acre parcel subject to SAD (Special Activities District) to allow an office development. The property is located on West Atlantic Avenue, west of High Point Boulevard, east of Hamlet Drive, if extended north.
