Second Reading and PUBLIC HEARING amending Chapter 29 "Water and Sewers" of the Code of Ordinances relative to increasing sewer rate charges. Recommendation: Council action. Action: To adopt the Ordinance on Second Reading. --:~- . CONSENT AGENDA 11. Water and Sewer Service Maintenance and Operations for Hiah Point. Recommendation: Council action. Action: Motion to confirm City policy to continue mainte- nance and operation of water and sewer systems with- in High Point Subdivision and instruct the City Manager and City Attorney to obtain the necessary easements. 12. Acknowledgement of Donation. Consider acknowledgement of receipt by the City of a donation from Mrs. Myra Doherty, 7 Driftwood Lane of 140 seagrapes valued at $3.00 per plant. Recommendation: Council action. Action: Motion to acknowledge donation. 13. Reauest for Water Service - Enterprise Leasing Company. Recommendation: Council action. Action: Motion to ratify letter sent by City Planner and con- firm Council's intention to provide water service for Enterprise Leasing Company, located at the north- east corner of Avenue H and South Federal Highway. 14. Reauest for Water Service - Points West. Recommendation: Council action. Action: Motion to ratify letter sent by City Planner and con- firm Council's intention to provide water service for Points West, located on the south side of West Atlantic Avenue between Military Trail and the E-3 Canal. *15. Surolus Prooertv. Recommendation: City Manager recommends approval. Action: Motion to authorize advertising surplus property for sale and retaining Jim Graham to conduct the auction. 16. Reauest for Solicitation of Funds - Delray Beach Firefighters Benevolent Association. Recommendation: Action: Motion 1984. City Clerk recommends approval. to approve solicitation of funds on July 28, 17. Tent Permit Request - Delray Post Office. Consider request for a 20 x 30 foot tent erected in the rear parking lot and maneuvering area of the Post Office at 382 N. E. 2nd Avenue for a per iod of one year or until the U. S. Postal Service can obtain an additional temporary carrier annex building. Recommendation: Director of Development and Inspection/CBO recommends approval. Action: Motion to approve. 18. Tent Permit Request - Revival Crusades. Consider request for a 40 x 80 foot tent to be erected at the corner of N. W. lOth Street and Atlantic Avenue from June 28th through July 28, 1984. Consider request for a Ofte~year extension of the conditional use and site plan approval for Pelican Harbor Shoppes, an approved 14,600 square foot shopping center until June 23, 1985. The property is located at the northeast corner of South Federal Highway and Tropic Isle Drive. Recommendation: Planning & Zoning Board approved 6-0, sub- ject to the conditions set forth in the at- tached memorandum. Action: Motion to approve. *20. Extension ^pproval - Waterway North II (aka Inlet Cove). Con- sider request for a one-year extension of the time period within which the site plan approval for Waterway North II (aka Inlet Cove) remains valid or until July 26, 1985. The property is located at the northeast corner of the Intracoastal Waterway and N. E. 8th Street. Recommendation: Planning & Zoning Board approved 5-0, sub- ject to the condition stated in the attached memorandum. Action: Motion to approve. *21. Final Plat Approval - Pelican Harbor (Phase Four). Consider request for final plat approval for Pelican Harbor (Phase Four), an approved 255 unit planned residential development located east of South Federal Highway between the C-15 Canal and Tropic Isle Drive. Recommendation: Planning & Zoning Board approved 5-0. Action: Motion to approve. * 22. Site Plan Approval - Ocean Cay. Consider approval for Ocean Cay, a proposed 13 project, located on the west side of AlA Drive and Atlantic Avenue. request for site plan unit multiple family between Vista Del Mar Recommendation: Planning & Zoning Board approved 6-0, sub- ject to the conditions stated in the attached memorandum. Action: Motion to approve. *23. Site Plan Aooroval - Delray Beach Motors. Consider request for site plan approval for Delray Beach Motors, a proposed auto- mobile dealership, located south of Tropic Boulevard between South Federal Highway and Florida Boulevard. Recommendation: Planning & Zoning Board approved 5-0, sub- ject to the conditions stated in the attached memorandum. Action: Motion to approve. * 24. Si te Plan Approval - Swinton Station. Consider request for site plan approval for Swinton Station, a proposed 20 unit multiple family project, located south of S. E. 4th Street between Swinton Avenue and the F.E.C. Railroad. Recommendation: Planning & Zoning Board approved 6-0, sub- ject to the conditions stated in the attached memorandum. Action: Motion to approve. 25. Roots Cultural Festival Tournament. Consider request from Roots Cultural Festival to use the Delray Beach Municipal Golf Course for a golf tournament on July 29th. The tournament was arranged by the Course Manager prior to establishment of Council's policy. Recommendation: City Manager recommends approval. Action: Motion to approve. AGENDA 6-12-84 Page 3 26. Position of Planner. Consider request for the position of Planner -~e-be created and added to the Planning Department. Recommendation: Council action. Action: Motion to approve. 27. Water Treatment Plant Chemicals. Consider award of a contract to Nalco Chemical Company for polymers and chemicals for the Water Treatment Plant for fiscal 1984-85 in the amount of $194,400, with funds to come from the 1984-85 budget. Recommendation: City Manager recommends approval Action: Motion to approve. 28. Tires and Service for Tires. Consider award of a contract to Elpex, Inc. for tires and service for tires for City vehicles for 1984-85 in the amount of approximately $23,700. This award was based on the State contract for Goodyear tires. Funds are to come from the 1984-85 departmental budgets. Recommendation: City Manager recommends approval. Action: Motion to approve. *29. Nuisance Abatement. Resolution No. 44-84 assesses costs for abating nuisances in accordance with Sections 13-12 and 13-13 on six parcels. Recommendation: City Clerk recommends approval. Action: Motion to adopt the Resolution. REGULAR AGENDA *30. Handicap Facilities - Catherine strong Center. Council ap- proved handicap facilities improvements at the Catherine Strong Center at the September 27, 1983 meeting. The City Manager recommended the contingency as a funding source, but this was not included in the motion. Recommendation: City Manager recommends approval. Action: Motion that funding for the handicap facilities at . Catherine Strong Center in the amount of $2631.79 come from the General Fund Contingency Account. * 31. Proposed Boat Dock - 305 N. W. 22nd Street. Consider request for a modification of the standards for approval as set forth in Section 9-534 of the Code of Ordinances to allow the dock to extend 17 feet from the property line. Recommendation: Director of Public Works/City Engineer recom- mends denial. Action: Council action. * 32. Modification of Site Plan ^pproval - Le Village De Provence. Consider mod if ication to the conditions of site plan approval for Le Village De Provence. Recommendation: Council action. * 33. Booster Device on Police Radio Transmission Tower. Consider authorizing execution of agreement between the Cities of Delray Beach and Deerf ield Beach to install a booster device on our Police radio transmission tower. Recommendation: Assistant City Attorney recommends approval. Action: Motion to authorize execution of agreement. * 34. Agreement relative to Temporary Certificate of Occupancy for Marina Delray. Consider addendum to Temporary Certificate of Occupancy for Marina Delray. Recommendation: Council action. AGENDA 6-12-84 Page 4 *35. Ordinanee- -No. 41-84 - Amending Code - Junk Vehicles. First Reading amending Chapter 14 "Junk, Junkyards and Automotive Repairs" of the Code of Ordinances relative to abandoned, wrecked, junked vehicles on private or public property. Recommendation: Council action. Action: To pass the Ordinance on First Reading. Note: If passed, Public Hearing June 26th. * 36. Ordinance No. 44-84 - Amendina Code - Alarm Systems. First Reading amending Chapter 2 "Administration" of the Code of Ordinances relative to the Code Enforcement Board's juris- diction to hear and decide cases involving alarm systems. Recommendation: Council action. Action: To pass the Ordinance on First Reading. Note: If passed, Public Hearing June 26th. * 37. Ordinance No. 45-84 - Amending Code - Cable Television. First Reading amending Chapter 10 "Cable Television Franchise" of the Code of Ordinances relative to adding a second franchise holder, changing the bond requirements and providing liquidated damages clause. Recommendation: Council action. h&1iQn: To pass the Ordinance on First Reading. Note: If passed, Public Hearing June 26th. * 38. Authorizing Issuance of $28.000.000 Water and Sewer Revenue Bonds. Resolution No. 45-84 authorizes issuance of $28,000,000 Water and Sewer Revenue Bonds to refinance existing issues and provide funds for improvements to water and sewer facilities. Recommendation: Council action. Action: Motion to adopt the Resolution. * 39. Job Bill Enabling Agreement. Consider authorizing execution of Job Bill Enabling Agreement between the City and Palm Beach County Community Development for the N. W. 5th Avenue improve- ments. The $218,000 will come from a grant from the Palm Beach County Community Development.
