Nubin, MMC City Clerk City of Delray Beach, Florida SERVICE ' PERFORMANCE INTEGRITY - RE5PON5IBLE ' INNOVATIVE ' TEAMWORK I RESOLUTION NO. 05-16 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DT_LRAY BEACH, FLORIDA, SUPPORTING SENATE BILL 904 SPONSORED BY FLORIDA STATE SENATOR MARIA SACHS FOR DISTRICT 34 THAT AMENDS CHAPTER 335, SECTION 65, FLORIDA STATUTES TO REQUIRE INSTALLATION OF SOLAR. - POWERED, IN -ROAD LIGHTS IN ALL BICYCLE WAYS THAT ARE ESTABLISHED ON OR AFTER JULY 1, 2016, IN, OR WITHIN A ONE MILE RADIUS OF, AN URBAN AREA IN CONJUNCTION WITH THE CONSTRUCTION, RECONSTRUCTION, OR OTHER CHANGE OF ANY STATE TRANSPORTATION FACILITY; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, in 2013, most bicyclist fatalities in urban areas occurred between 4 p.m. and Midnight; and WHEREAS, many coastal roads in Florida do not utilize street lights during turtle nesting season (March -October) to prevent disorienting the hatchlings with artificial light. Solar -powered, in -toad lights will provide a bike lane lighting source during the turtle season and throughout the year; and WHEREAS, bicyclists accounted for 2.35 percent of all traffic fatalities, and approximately 48,000 bicyclists were injured in 2013; and WHEREAS, public agencies ate required to maintain minimum teflectivity of longitudinal pavement markings unless continuous lighting assures that the markings are clearly visible at night; and WHEREAS, solar-poweted, in -toad lights improve the nighttime visibility of bike lanes and bicyclists and reduce the risk of roadway departure crashes by making the bike lanes visible for drivers at a greater distance; and WHEREAS, solar -powered, in road lights ate economical and easy to install; and WHEREAS, the City Commission desires to support Senate Bill 904 in the 2016 Legislative Session. I NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That the City of Delray Beach supports Senate Bill 904 sponsored by Florida State Senator Maria Sachs for District 34 amending chapter 335, section 65 to require installation of solar-poweted, in -toad lights in all bicycle ways that are established on or after July 1, 2016, in, or within a one mile radius of, an urban area in conjunction with the construction, reconstruction, or other change of any state transportation facility.
