RULES FOR PUBLIC PARTICIPATION
PUBLIC COMMENT: City Commission meetings are business meetings and the right to limit discussion rests
with the Commission. Generally, remarks by an individual will be limited to three minutes or less. The
Mayor, presiding officer or a consensus of the City Commission has discretion to adjust the amount of time
allocated.
Public comment shall be allowed as follows:
A. Comments and Inquiries on Non -Agenda and Agenda Items (excluding public hearing or quasi-judicial
hearing items) from the Public: Any citizen is entitled to be heard concerning any matter within the
scope of jurisdiction of the Commission under this section. The Commission may withhold comment or
direct the City Manager to take action on requests or comments.
B. Public Hearings/Quasi-Judicial Hearings: Any citizen is entitled to speak on items under these sections
at the time these items are heard by the Commission.
C. All persons desiring to do a presentation on agenda or non -agenda items that are on a portable flash
drive device or a CD/DVD, must provide their media to the City Clerk no later than 12:00 p.m. one day
prior to the meeting where they wish to present.
SIGN IN SHEET: Prior to the start of the Commission Meeting, individuals wishing to address the Commission
should sign in on the sheet located on the right side of the dais. If you are not able to do so prior to the start of
the meeting, you may still address the Commission. The primary purpose of the sign -in sheet is to assist staff
with record keeping. Therefore, when you come up to the to speak, please complete the sign -in sheet if you
have not already done so.
ADDRESSING THE COMMISSION: At the appropriate time, please step up to the lectern and state your name
and address for the record. All comments must be addressed to the Commission as a body and not to
individuals. Any person making impertinent or slanderous remarks or who becomes boisterous while
addressing the Commission shall be barred by the presiding officer from speaking further, unless permission to

LEGAL Circuit Court Practice
EXPERIENCE Represented the City in a breach of contract case over former Chief of Police
termination. Case was dismissed based upon a Motion to Dismiss for failure to
state a cause of action. Represented the City in suit for injunctive relief
regarding City's bidding procedures under Florida Statutes, Chapter 255. The
request for injunctive relief was denied by the Circuit Court. Represented the
City in a breach of contract issue on a multi-million dollar road construction
project. The case settled based upon the construction engineers estimates.
Represented the Expressway Authority and Florida Department of
Transportation for an environmental challenge and request for injunctive relief
objecting to transportation funding for a bridge over the St. Lucie River. The
request for injunctive relief was denied. Represented the City in civil forfeiture
proceedings.
Appellate Practice
Represented the City in the appeal of the complaint for injunctive relief for
alleged violations of Florida Statutes, Chapter 255, for bidding procedures and
posting of a bond for a construction project. The lower court's decision was
affirmed on appeal, injunctive relief was denied.
Represented the City twice in a case of first impression, in appellate
practice before the Fourth District Court of Appeals regarding stormwater
litigation and notice requirements under Florida Statutes, Chapter 197. The first
case was brought on behalf of a large developer, the second case was brought
as a class action suit. The City had to refund stormwater fees due to improper
notice under Chapter 197.
Federal Court Practice
Worked with outside counsel representing the City in two federal court cases
regarding sober homes and/or community residential facilities locating within the
City and possible violations of the American's with Disabilities Act and the Fair
Housing Act based upon reasonable accommodations.
Represented the City in Federal Court on a complaint based upon several
constitutional claims violations in a zoning matter for alleged discrimination
against a church locating in a strip shopping center. The case was settled.
Represented the City in Federal Court on an alleged Federal
Telecommunications Act violation case. The case was dismissed in a Motion for
Summary Judgment based upon the record below, statutory interpretation and
case law analysis.

the City of Delray Beach. It is with excitement of starting a new chapter, that I submit my
application for the position, Most recently, I served as the City Attorney for the City of port St.
Ducie for the past two years. previously, I served as Senior Assistant City Attorney for the past
seventeen years. My mission has always bee to practice law with honesty, integrity, respect
and a great deal of professionalism.
During my tenure at the City of Port St. Lucie, the City experienced major growth and
development, which led to the City being named the fastest growing city in America. As a result
of such explosive growth, many interesting issues relating to land development ensued. There
were In excess of twenty annexations of property into the City's limits, several developments of
regional impact, and complex multi=party agreements with several developers, The City
created Its first Community Redevelopment Agency ("CRA"), for which, I served as the Attorney
for the CRA board. In an attempt to diversify the local economy, the City invested In a digital
animation facility and biotech facilities.
Unfortunately, as the economy took a major downturn during the recession, residential
development ceased and the City faced several major economic development failures. These
fallures created many complex legal challenges for the City. Several of the projects were
backed with the City's covenants to budget and appropriate funding for bond issues supporting
the projects. Some of these projects were resolved with positive results for the City.
The experiences practicing as a local government attorney over the past twenty years,
will be a great asset to the City of Delray Beach and its residents. I would like to thank you for

and school districts in the areas of civil rights, employment law, land use and zoning, torts,
eminent domain, contracts, adult entertainment, and fair housing. A few of the notable
cases are:
Konikov, v. Orange County, A challenge to the county's zoning code based upon the First
Amendment and the Religious Land Use and Institutionalized Person's Act.
Bell v. City of Winter Park, A challenge to the city's ordinance creating a "buffer zone"
prohibiting targeted picketing in a residential area based upon the First Amendment.
Morgran Co., Inc. v. Orange County, A claim by a developer that the county had breached
a developer's agreement based on contract zoning.
Atlantic Housing Partners LLLP v. City of Winter Springs, A claim by a developer that the
city's decision to deny a building application violated the state and federal Fair Housing
Acts.
Price v. School Board of Indian River County, An employment discrimination case
involving sexual harassment that was tried by a jury which returned a verdict in favor of
the school board.
Ruello v. City of Tampa, A claim of employment discrimination by a city employee that
was tried before a jury resulting in a verdict for the city.

Smith v. City of Tampa, A claim against the city for inverse condemnation and other
damages that was tried before a jury resulting in a favorable verdict for the city.
Lorenzo v. City of Tampa, A challenge to the city's ban on distributing commercial
pamphlets during certain events in Ybor City based upon the First Amendment. The
ordinance was upheld by the l lth Circuit Court of Appeals.
Soliman v. City of Tampa, A claim of religious employment discrimination against the city
that was dismissed by the district court on a motion for summary judgment.
Vilbrun v. School Board of Osceola County, A claim of employment discrimination against
the school district that was fried before an administrative judge resulting in a verdict for
the district.
Gifford v. Pam lorio, Mayor, A claim of inverse condemnation against the city and
numerous employees including the mayor for money damages. The mayor and other
employees were dismissed from the case under the defense of qualified immunity.

of city attorney for the City of Delray Beach, Florida.
As you can see from resume, I have represented municipalities, counties, and
school districts for the last fifteen years. My approach has always been to provide the
best legal services to my client while being mindful of the costs and time associated with
the work. I enjoy working with elected officials and government employees, and
supporting them in the work they do for their community. As legal counsel, I view my role
as providing direct and clear answers to questions and issues before the commission or

I would like to express my interest in the position of City Attorney for Delray Beach, Florida_ I consider myself a
strong candidate having a diverse legal background with 15 plus years in-house local government experience.
In addition to being Board Certified in City, County and Local Government Law, I spent the 11 plus years as a
senior assistant attorney in the Polk County Attorney's Office. The progressive responsibility I acquired
throughout my career, in-house government experience and mentoring of younger, less experienced attorneys
provides me with the experience and versatility necessary to handle and manage the operations of the Delray
Beach City Attorney's Office. As one of the cornerstones and workhorses of the office, I was called upon to
trouble shoot some of the most difficult legal problems and challenges facing the office. Having been assigned
to jump start the Procurement Division, my responsibilities included reviewing, revising and/or drafting 90% of
the County's contracts during a period of time when the County was procuring $100 million dollars' worth of
goods and services a year. When assigned to the Utilities Division (water and wastewater), I provided the
requisite legal advice and assistance to take it from a struggling entity under multiple consent orders issued by
the regulatory agencies SWFWMD and DEP, and transformed it into a well -organized, strategically focused
utility. I represented almost every major division within Polk County, including Procurement, Utilities, Solid
Waste, Parks and Natural Resources, Information Technology, Human Resources, and Fire Rescue. I was also
the substitute Planning & Zoning Commission Attorney for a period of 6 years and reviewed subdivision plats for
the County's Land Development Division to ensure their legal sufficiency. I have a strong background in
litigation and helped coordinate and manage the County's lawsuits with our outside counsel in complex legal
matters. Since 1992, 1 have been certified as a circuit court civil mediator and am intimately familiar with the
mediation process. I am also very accustomed to interacting and working closely with county boards,
management, and staff at all levels of local government.
Earlier in my career, I was the first full-time Assistant City Attorney for the City of Cape Coral, Florida and
working together with the City Attorney, handled the vast majority of litigation in-house which included among
other matters, constitutional challenges to ordinances, challenges to connection fees, land use issues,

I am pleased to provide my resume, a copy of which is enclosed, inclusive of my
references, in conjunction with this cover letter relative to the position of City Attorney.
know that Delray Beach it is a full service municipality. I consider it a municipality with a
clear sense of its own history and a unique identity. From visiting the City I also feel it is
a special Village by the Sea that offers a fine quality of life for its residents and visitors,
and which must address various important and day to day legal issues.
I more than meet all the general qualification set forth in your announcement. For
example I have been Board Certified in Local Government Law since 1996. 1 am very
conversant with the vast majority of legal specialties listed.
I have been devoted to the practice of municipal law since 1982, which is virtually my
entire career. I think there is no higher calling for an attorney than to be involved in
representing the local governments that most directly play a vital role as the most active
and accessible governmental agencies for their residents and communities.
I have served as a City Attorney for the City of Miramar, Assistant County and City
Attorney, and Senior Assistant City Attorney. I have additionally served as a hearing
officer for various local governments. I have represented Planning, Zoning, Historic
Preservation, and Urban Development Review Boards. I have served as general
counsel to the Broward County Performing Arts Center Authority, the Miami Parking
Authority, and the Southeast Overtown/Park West Community Redevelopment Agency.
The departments whose matters I have worked on include building, capital
improvements, community development, historic preservation, planning, zoning, public
works, purchasing, public facilities, human resources, grants and sustainable initiatives,
fire/rescue, solid waste/recycling, and risk management. I have also worked with and
supervised outside counsel. I consider myself a seasoned and well-rounded municipal
attorney who is conversant with the most important areas of the law. I am admitted to
practice in all Florida State Courts and in the Federal Court, Southern District of Florida.
