A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
DELRAY BEACH, FLORIDA, ADOPTING THE SECOND AMENDMENT
TO THE WEST ATLANTIC AVENUE REDEVELOPMENT PLAN;
FINDING THAT THE MODIFICATIONS CONFORM TO THE
COMMUNITY REDEVELOPMENT ACT OF 1969, AS AMENDED;
FINDING THAT THE MODIFICATIONS ARE CONSISTENT WITH THE
CITY OF DELRAY BEACH'S COMPREHENSIVE PLAN, AND MAKING
FURTHER ,FINDINGS PURSUANT TO THE APPLICABLE
REQUIREMENTS OF FLORIDA STATUTES SECTION 163.360(6)(7);
PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Commission of the City of Delray Beach, Florida, by Ordinance
No. 46-85, adopted June 18, 1985, did create a Community Redevelopment Agency as provided in
Florida Statutes Section 163.356; and
WHEREAS, on December 23, 1986, the Board of County Commissioners of Palm Beach
County passed and adopted Resolution No. R-86-2003 delegating the exercise of the powers conferred
upon the County by Chapter 163, Part 3, Florida Statutes, within the boundaries of the City of Delray
Beach to the governing body of the City of Delray Beach completely and without limitation; and
WHEREAS, the City Commission of the City of Delray Beach, Florida, has heretofore
approved a Community Redevelopment Plan on September 9, 1986, by Resolution No. 49-86 as
subsequently amended on November 24, 1987, by Resolution No. 47-87, and as further ratified and
amended on February 14, 1989, by Resolution No. 6-89, and as further ratified and amended on
September 25, 1990, by Resolution No. 86-90; and as further ratified and amended on April 9, 1991, by
Resolution No. 28-91; and as further ratified and amended on November 26, 1991, by Resolution No.
93-91; and as further ratified and amended on May 26, 1992, by Ordinance No. 17-92; and as further
ratified and amended on December 1, 1992, by Ordinance No. 60-92; and as further ratified and
amended on February 22, 1994, by Ordinance No. 5-94; and as further ratified and amended on
September 5, 1995, by Ordinance No. 48-95; and as further ratified and amended on March 5, 1996, by
Ordinance No. 8-96; and as further ratified and amended on February 3, 1998, by Ordinance No. 2-98;
and
WHEREAS, on July 11, 1995, the City Commission of the City of Delray Beach did
adopt, by motion, the West Atlantic Avenue Redevelopment Plan as a part of the Community
Redevelopment Plan; and
WHEREAS, on February 3, 1998, the City Commission adopted Resolution No. 11-98
adopting the West Atlantic Avenue Redevelopment Plan, as amended; and
WHEREAS, the City Commission is desirous of further modifying said West Atlantic
Avenue Redevelopment Plan to account for certain changes which have occurred since the prior
adoption and amendment of the Plan; and
WHEREAS, the Community Redevelopment Agency of the City of Delray Beach has
recommended to the City Commission of the City of Delray Beach, Florida, that the West Atlantic
Avenue Redevelopment Plan be modified, amended and ratified in the form attached hereto as Exhibit
"A"; and
WHEREAS, the City Commission of the City of Delray Beach, Florida, finds that the
modifications conform to the Community Redevelopment Act of 1969, as amended; and
WHEREAS, the City Commission of the City of Delray Beach, Florida, finds that the
modifications are consistent with the City of Delray Beach's Comprehensive Plan; and
WHEREAS, the City Commission of the City of Delray Beach, Florida, fmds that the
modifications meet the applicable requirements of Section 163.360(6)(7), Florida Statutes.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. That the preamble stated above is hereby incorporated by reference herein, as
findings of fact upon which this resolution is based.
Section 2. That the West Atlantic Avenue Redevelopment Plan for the City of Delray
Beach be, and the same is hereby modified, amended and ratified in the form attached hereto as Exhibit
"A" and made a part hereof.
Section 3. That this resolution shall become effective immediately upon adoption.

The West Atlantic Avenue Redevelopment Plan covers the West Atlantic Avenue Corridor
including the area one block north and south of West Atlantic Avenue, between 1-95 and
Swinton Avenue; and the 100 Block of NW 5th Avenue (between NW 1st Street and Martin
Luther King Boulevard). The Plan was adopted by the City in 1995, and amended once, in
1998. Since that time, certain conditions have changed that necessitate additional
amendments to the plan.

The draft amended plan proposes the following changes:
Amendments to the "Existing Conditions" section to clarify the date that the existing
conditions reflect.
Amendments to the "Opportunities and Constraints" section to correct errors, update
information, and add new opportunities. Most new opportunities refer to participation in
various grants programs.
Amendments to the "Redevelopment Plan" section to update information, note the
completion of earlier recommendations, and add new recommendations. These
recommendations include the proposed land use and zoning changes necessary for the
redevelopment of the North 300 and 400 Blocks (Blocks 28 and 36), for which the CRA has
recently completed the RFP process and selected a developer.
Updates to property acquisition tables and redevelopment block diagrams which reflect
changed conditions and new redevelopment strategies. New diagrams have been added for
the 100 block of NW 5th Avenue (between NW 1st Street and Martin Luther King Boulevard),
which were not included in the earlier plan.
For specific information and details of the proposed changes, please refer to the attached plan.
Please note that the Table of Contents has not been updated. This will occur after adoption
when the strikeouts and highlighting are removed and the document is repaginated.

WARC (West Atlantic Redevelopment Coalition): The amendments were discussed at both
the August 9t" and September 13t~ meetings of the WARC Board. On September 13, 2000,
WARC voted unanimously to recommend that the amendments be approved as proposed.
Community Redevelopment Aaencv: The CRA reviewed the proposed amendment at its
meeting of September 28, 2000. The CRA Board recommended that the amendment be
approved as proposed.
Historic Preservation Board: The HPB reviewed the proposed amendment at its meeting of
October 4, 2000. The Board voted unanimously to recommend that the amendments be
approved as proposed with the following changes:
· That the redevelopment block diagram for the North 000 Block of West At/antic Avenue
(between N. Swinton Avenue and NW 1st Avenue) be amended to maintain Doc's
restaurant as it currently exists.
· That historic structures that are to be removed or replaced be shown in dashed lines on the
block diagrams.
These changes have been incorporated into the final draft.

The Planning and Zoning Board reviewed the proposed plan amendment at its October 16,
2000 meeting. Diane Dominguez, interim CRA Director, spoke in favor of the plan. Several
neighborhood residents expressed concern over the proposed amendment due to confusion
with the map included in the notice. The map indicated the boundaries of the redevelopment
area which is governed by the plan and the residents thought that the entire area was to be
changed to commercial. This was explained at the meeting and the residents were encouraged
to call the CRA for specific impacts on their individual properties. The Board supported the
amendment and recommended adoption by a vote of 5/0 (Peltzie and Hasner absent).
