E. 22nd Street and Atlantic High School, subject to NC (Neighborhood Commercial) District. Recom~endation: Plannini Director recommends approval. Consider authorizing the City Attorney's office and special counsel to bring third party action against Vanguard Insurance Company or it's parent companies relative to Gary Werner vs City of Delray Beach. Consider retaining law firm of Carson & Linn, PA as ad- ditional outside legal consultant relative to labor law matters. Recommendation: City Attorney recommends approval. Consider offer of settlement. in the amount of $6,000 from the plaintiff rela- tive to Gregory Seaver vs City of Delray Beach. Recommendation: City Attorney and Insurance Service recommend denial. Centex Homes Nuisance Abatement. Recommendation: Centex Request. Action: Motion to stay enforcement of nuisance at Cent ex Homes property due to dirt stockpiles to April 15, 1983. * 21. Consider authorization for Russell & Axon to perform professional consulting services relative to test well program, amounting to $227,500, with funds to come from the 1982-83 budget and the Bond Issue. Recommendation: City Manager and Utilities Director recommend approval. Action: Motion to authorize performance of professional consulting services. 23. Desi~n of Two Additional Filters - Wastewater Treatment Plant Exoansion. Consider authorization for Russell & Axon to perform professional consulting services rela- tive to design of two additional filters to be added to the existing clearwell structure, amounting to $71,500 with funds to come from the 1982-83 budget and the Bond Issue. Recommendation: City Manager and Utilities Director recommend approval. Action: Motion to authorize performance of professional consulting services. * 24. Street Abandonment - A Portion of Homewood Boulevard. Reso- lution No. 16-83 vacates and abandons a portion of Homewood Boulevard,located south of Atlantic Avenue, between the Delray Beach Golf Course and the newly realigned section of Homewood Boulevard. Recommendation: Planning & Zoning Board approved unani- mously, subject to conditions stated in attached memorandum. Action: Motion to adopt the Resolution. * 25. Street Abandonment - N. E. ,rd Street. Resolution No. 17-83 vacates and abandons that portion of N. E. 3rd Street, between N. E. 9th Avenue and the Intracoastal Water- way. Recommendation: Planning & Zoning Board approved unani- mously. Action: Motion to adopt the Resolution. * 26. Street and Allev Abandonment - Block A. Rid~ewood Hei~hts. Resolution No. 18-83 vacates and abandons that portion of S. W. 6th Avenue lying adjacent to Block A, Ridgewood Heights and the 12 foot north-south and east-west alley lying within Block A, Ridgewood Heights. Recommendation: Planning & Zoning Board approved by a vote of 5 to 1 (Christensen dissenting). Action: Motion to adopt the Resolution. 27. Enablin~ A~reement. lQ82-8, - Caoital Imorovements Pr01ects. Consider approval and authorization to execute agreement be- tween the City and Palm Beach County for providing for the funding and administration of Community Development Block Grant projects. Recommendation: City Manager and Planning Director recom- mend approval. Action: Motion to approve and authorize execution of agreement. 28. Ratification of South Central Re~ional Wastewater Treatment and Disoosal Board Action of March 16. lQ8,. Consider rati- fication of SCRWTD Board action approving move of admini- stration offices to the Sewer Plant. Ordinance No. 14-8, - Amendin~ Code - Purchases. First Reading amending Chapter 2 "Administration" of the Code of Ordinances relative to purchasing procedures. Recommendation: City Manager and Finance Director recom- mend approval. Action: To pass the Ordinance on First Reading. Note: If passed, Public Hearing April 12th. * 31. Ordinance No. lQ-S, - Zonin~ Ordinance Amendment _ Parkin~ for CC (Communitv Commercial) District. First Reading amending Chapter 30 "Zoning" of the Code of Ordinances relative to the number of parking spaces required for shopping centers. Recommendation: Planning & Zoning Board approved unani- mously. Action: To pass the Ordinance on First Reading. Note: If passed, Public Hearing April 12th. * 32. Ordinance No. 20-8, - DeRubis Annexation. First Reading relative to annexing a 0.26-acre parcel, subject to R1AA (Single Family Dwelling) District, located north of N. W. 7th Street between N. W. 6th Avenue and N. W. 8th Avenue. Recommendation: Planning Director recommends approval. Action: To pass the Ordinance on First Reading. Note: If passed, Public Hearing April 26th. * 33. Ordinance No. 21-8, - PVlon Annexation. First Reading relative to annexing a 1.97-acre parcel, subject to SAD (Special Activities District), located east of Military Trail, between Lake Ida Road and Atlantic Avenue. Recommendation: Planning & Zoning Board approved unani- mously. Action: To pass the Ordinance on First Reading. Note: If passed, Public Hearing April 26th. * 34. Ordinance No. 22-8, - PVlon Rezonin~. First Reading relative to rezoning to SAD (Special Activities District), conditional use, site and development plan approval. First Reading re- pealing Ordinance No. 70-82 to readjust the 1982-83 fiscal budget. Recommendation: City Manager and Finance Director recom- mend approval. Consider authori- zing advertising for bids for computer telephone switch- board and approximately 150 telephones for City Hall.
