Second Reading and continuation of PUBLIC HEARING relative to rezoning to PRD-4 (Planned Residential District) approval. The property is located at the northeast corner of Lake Ida Road and 1-95. Recommendation: Planning & Zoning Board approved 4-3 (Horenburger, Sumrall and Simon dissent- ing) . Action: To adopt the Ordinance on Second Reading. 8. Ordinance No. 74-83 - Chanaing the City's Land Use Plan Designation. Second Reading and continuation of PUBLIC HEARING relative to changing the City's Land Use Plan Designation in the Comprehensive Plan for a parcel of land located at the northeast corner of Lake Ida Road and 1-95 from SF (Single Family) to PRD-4 (Planned Residential District) . Recommendation: Planning & Zoning Board approved 4-3 (Horenburger, Sumrall and Simon dissent- ing) . Action: To adopt the Ordinance on Second Reading. 9. Ordinance No. 76-83 - Amending Code - Increasin9 Sewage Rates. Second Reading and PUBLIC HEARING amending Chapter 29 RWater and SewersR of the Code of Ordinances relative to increasing sewage rates for residential and non- residential customers. ~commendation: City Manager recommends approval. Action: To adopt the Ordinance on Second Reading 10. Ordinance No. 79-83 - Zonina Ordinance Amendment - Automo- bile Sales and Displav. Second Reading and PUBLIC HEARING amending Chapter 30 RZoningR of the Code of Ordinances to allow automobile sales and display as a conditional use in the GC (General Commercial) District. ~1mmendation: Planning & Zoning Board approved 4-0. Act Lon: To adopt the Ordinance on Second Reading. CONSENT AGENDA 11. Site and Development Plan Approval - Isles of Delrav. Con- sider request for site and development plan approval for Isles of Delray, located at the northeast corner of Lake Ida Road and 1-95. Recommendation: Planning & Zoning Board approved 4-3 (Horenburger, Sumrall and Simon dissent- ing) . Action: Motion to approve site and development plan. 12. Request for Solicitation of Funds - Community Chest Services. Recommendation: City Clerk recommends approval. Action: Motion to approve solicitation of funds from February 6th to February 20, 1984. 13. Request for Solicitation of Funds - Delray Beach Public Library Association. Inc. Recommendation: City Clerk recommends approval. Action: Motion to approve solicitation of funds from March 4th to March 17, 1984. * 14. Ratification of Sale of Sur?lus Property. An auction was held on October 18th at 10 a.m. for the sale of surplus City property. $7,473.13 was realized from the sale. Recommendation: City Manager recommends approval. Action: Motion to ratify sale of surplus property. 15. Tent Ap?lication. Consider request from Craig Steinhart, Happy Holiday Christmas Trees to erect a tent at the north- west corner of Linton Boulevard and U. S. No. 1 for the sale of Christmas trees from November 16th through December 31, 1983. Recommendation: City Manager recommends approval. Action: Motion to approve request. * 16. Final Plat Approval - Conaress Park South. Consider request for final plat approval for Congress Park South, an approved planned commerce center. The property is located south of Atlantic Avenue, between the E-4 Canal and Congress Avenue. Recommendation: Planning & Zoning Board approved 7-0, subject to the conditions stated in the attached memorandum. Action: Motion to approve final plat. 17. Pump Repairs - Master Lift Station. Consider award of a contract to Sanders, Aspinwall & Associates, sole source, for pump repairs to the Master Lift Station at a cost of $11,148.71. Funds are to come from Public Utilities 1983-84 Operating Expenses. Recommendation: City Manager and Public Utilities Di- rector recommend approval. Action: Motion to award contract. 18. Authorize Advertisin9 for Filters - Water Treatment Plant Expansion. Consider authorizing advertisement for two ad- ditional water filters for the Water Treatment Plant Expan- sion at an estimated cost of $680,000, with funds to come from the $4 million 1983 Water & Sewer Revenue Bonds. Recommendation: City Manager and Public utilities Di- rector recommend approval. Action: Motion to authorize advertisement. AGENDA 10-25-83 Page 2 19. Anhvdrous Ammonia - Water Treatment Plant. Consider award of a contract to the low bidder, Bower Ammonia & Chemical Company for anhydrous ammonia, a chemical which will be fed at the Water Treatment Plant to control THM formation. The results of this cooperative bid with Boca Raton and Boynton Beach will mean an estimated savings to the City of $3,832.50 for 1983-84. Estimated yearly cost for this chemi- cal is $12,000, with funds to come from the Water Treatment Plant. 1983-84 Operating Supplies. Recommendation: Public Utilities Director recommends ap- proval. Action: Motion to award contract. 20. Fire Hydrants. Meters. Valves and Fittin9s - Public Utili- ties Department. Consider awarding contracts to six vendors, B&H Sales, Southeastern Municipal, Sunstate, Trans- Florida Supply, Neptune Meter and Hughes Supply for fire hydrants, meters, valves and fittings at an estimated yearly cost of $176,381.75. Funds are to come from Public Utilities 1983-84 budget. Recommendation: Public Utilities Director recommends ap- proval. Action: Motion to award contracts. * 21. Wilkes Nuisance Abatement Charge. Consider acceptance of reduction in nuisance abatement charge from $640 to $320 for Mr. Marvin Wilkes, who alleges he did not receive a notice relative to his property being cleared by the City. Recommendation: City Manager and City Attorney recom- mend approval. Action: Motion to accept a 50% reduction in the charge. 22. Riaht-of-Wav - Sherwood Park Entrances on Militarv Trail. Consider granting a right-Of-way to Palm Beach County at Sherwood Park entrances on Military Trail. Recommendation: Director of Public Works/City Engineer recommends approval. Action: Motion to authorize execution of deed 23. Final Payment - Public Works Com?lex. Consider authorizing final payment for the Public Works Complex in the amount of $1,344,274.75 to Sessoms-Grice Construction Company, Inc., with funds to come from Public Works Construction Account, 1978 Utility Tax Bond Issue. Recommendation: Director of Public Works/City Engineer recommends approval. Action: Motion to authorize final payment. 24. Floodina - N. W. 1st Street and N. W. 18th Avenue (Snow Concretel . Recommendation: Council action Action: Motion to approve the City Manager's recom- mendation to install a temporary solution for the flooding condition. 25. Ammonia Feed Devices - Water Treatment Plant. Consider award of a contract to Wallace & Tiernan Division, Penwalt Corporation, the lowest responsive bidder, for three ammonia feed devices for the Water Treatment Plant at a cost of $27,962 for equipment and $400 for start-up services. Funds are to come from Public utilities 1982-83 budget. Recommendation: Public Utilities Director recommends ap- proval. Action: Motion to award contract. AGENDA 10-25-83 Page 3 * 26. Nuisance Abatement. Resolution No. 96-83 assesses cost for abating nuisances on 15 properties in accordance with Section 13-13. These are delinquent accounts and this places a lien on the properties. Recommendation: City Clerk recommends approval. Action: Motion to adopt the Resolution. * 27. Easement Abandonment - Rainberrv Bay. Resolution No. 97-83 vacates and abandons a 6 foot utility eastment located on the north line of Lot 5, Block 11, Rainberry Bay, Section 5. Recommendation: Planning & Zoning Board approved 7-0. Action: Motion to adopt the Resolution. * 28. Easement Abandonment - Rainberry Bay. Resolution No. 98-83 vacates and abandons two 5 foot utility easements located on the north lines of Lot 4, Block 12 and Lot 6, Block 13 of Rainberry Bay, Section 7. Recommendation: Planning & Zoning Board approved 7-0. Action: Motion to adopt the Resolution. 29. Replacement of Roof for Club House at Delrav Beach Country ~. Consider award of a contract for replacement of roof at the DBCC to the low bidder, Divessified Roofing Systems, at an approximate cost of $14,500, with funds to come from the Fire Insurance proceeds. Recommendation: City Manager recommends approval. Action: Motion to award contract. REGULAR AGENDA 30. Appointments - Internal Audit Committee. Consider appoint- ments of John E. Tranter, James L. Bowen and Paul Friedman as regular members of the IAC to terms ending April 27, 1985. Recommendation: Council action. Action: Motion to appoint Committee members. 31. Appointment - PERC. Consider appointment of ~oel Smith as a member of PERC to a term ending March 13, 1987. Recommendation: Council action. Action: Motion to appoint Commission member. 32. Appointment - Code Enforcement of one alternate member to the term ending January 14, 1986. were suggested. Board. Recommendation: Council action. Action: Motion to appoint Board members. * 34. Nuisance Abatement List - William and Claire Ward. Consider acceptance of $40 from William and Claire Ward as payment for tree removal. A lien was placed inappropriately against the Ward property for non-payment. Ordinance No. 8l-83 - Zoning Ordinance Amendment - Condition- al Uses. First Reading, amending Chapter 30 RZoningR of the Code of Ordinances relative to modification of approved con- ditional use.
