NO. 86-86 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AMENDING CHAPTER 30, "ZONING", OF THE CODE OF ORDINANCES OF THE CITY OF DELRAY BEACH, FLORIDA, BY AMENDING SECTION 30-18 "OFF-STREET PARKING REGULA- TIONS", BY REPEALING SUBSECTION (D} "PARKING REQUIRE- MENTS" (4} "MISCELLANEOUS USES" AND ENACTING A NEW SUBSECTION (D) "PARKING REQUIREMENTS" (4) "MISCELLANEOUS USES"~ BY AMENDING SECTION 30-17 "SUPPLEMENTARY REGULA- TIONS" SUBSECTION (N) "HOSPITALS" BY REPEALING SUBSECTION (7) "PARKING" AND ENACTING A NEW SUBSECTION (7) "PARK- ING"~ PROVIDING A GENERAL REPEALER CLAUSE~ PROVIDING A SAVING CLAUSE~ PROVIDING AN EFFECTIVE DATE. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY O~ DELRAY BEACH, FLORIDA, ASFOLLOWS= Section 1. That Chapter 30, "Zoning", Section 30-18 "Off- Street Parking Regulations", Subsection (D} "Parking Requirements" (4) "Miscellaneous Uses" of the Code of Ordinances of the City of Delray Beach, Florida, is hereby repealed and a new Subsection (4) is hereby. enacted to read as follows= (4) Miscellaneous Uses (a) Abused Spouse Residence See Sec. 30-18(D) (1) (b) Adult Congregate Living I per every 4 beds Facility. (c) Alcohol & Drug Abuse Treatment I per every 4 beds Facility (d) Auditoriums, Assembly Halls, .3 per seat or 1 per 50 square feet Conference and Meeting Rooms, of total floor area, whichever is Theaters, Stadiums, Civic greater Centers, Community Theaters, Cultural Facilities, Crafts Facilities, Arts and Crafts Centers (e} Automobile Paint, Body and 4.5 per 1,000 square feet of total Repair Shops floor area (f) Automotive Wrecking Salvage 1 per 10,000 square feet of lot Yards area (g) ~oarding and Rooming Houses 1.5 per room (h) Bowling Establishments 8 per lane (i} Broadcasting Facilities 4 per 1,000 square feet of total floor area (j) Bus and Taxi Terminals and 3 per 1,000 square feet of total Train Stations floor area (k) Business and Professional 4 per 1,000 square feet of total Offices floor area up to 3,000 square feet~ · · 3.5 per 1,000 square feet for the total floor area for buildings over 3,000 square feet .(1} Child Care, Adult Day Care & I per 300 square feet of total Family Day Care floor area' (m) Churches I per 3 seats (n) Clubs & Lodges 1 per every 4 seats or 1 per e%ery .. 50 square feet of total floor area, whichever is greater (o) Com~unication Facilities 4 per 1,000 square feet of total floor area (p) Continuing Care 1.5 per dwelling unit, plus I per every 4 beds in the nursing facility (q) Convalescent and Nursing Homes I per every 4 beds (r) Courts, Courthouses, and Related i space for each 150 net. square functions feet of courtroom space and i space for every 250 gross square feet of noncourtroom area, excluding exterior and interior walls, elevators, stairwells, mechanical equipment areas Compact car'parking for long term employee use may be allowed in accordance with the provisions of Section 30-18(B) (6) (s) Educational Facilities (1) Kindergartens and Nursery I per 300 square feet of total Schools floor area (2) Elementary and Middle 2 per classroom plus 50% of the Schools requirement herein for areas used for auditoriums and/or stadiums (3) Senior High Schools, I per every 5 students, with the Vocational & Trade Schools, number of students to be determined Colleges by maximum capacity (t) Fire Stations I per employee on the shift of greatest employment (u) Food Convenience Stores with 4.5 per 1,000 square feet of total Gasoline Sales floor area (v) Funeral Homes 4 per 1,000 square feet of total floor area, plus .3 per chapel seat (w) Gasoline Service Station 4 spaces plus 4 for each bay (x) Gasoline Station with or 5 per 1,000 square feet of enclosed without food sales building floor area (y) Golf Course 7 per hole (z) Government Offices, Government 5 per 1,000 square feet of total Public Health and Rehabilitative floor area Facilities (aa) Hospitals 1.5 per bed, plus one per-100 sq.ft, of floor area in rooms for · out-patient, emergency, and other special services to the public -2- Ord. No. 86-86 (bb) Hotels and-Motels .7 per guest room plus 10 spaces ~ . per 1,000 square feet of total floor area devoted to ballrooms, meeting rooms, restaurants, lounges ~ and shops (cc) Libraries 4 per 1,000 square feet of total floor area (dd) Marinas 5 per 1,000 square feet of total floor area for any building or structure devoted to marina use, plus I per boat slip (ee) Medical, Dental, and Mental 5 per 1,000 square feet of total Health Treatment Facilities floor area (fl) Miniature Golf Course 1.5 per hole (gg) Museums 5 per 1,000 square feet of total floor area open to the public (hh) Natural Resource Facility 3 per 1,000 square feet of total floor area (ii) Parks Parking requirements will be determined by the Technical Advisory Committee according to intended use of the park and its location (jj) Police 'Stations 4 per 1,000 square feet of total floor area (kk) Post Office 5 per 1,000 square feet of total floor area (11) Public Utilities 4 per 1,000 square feet of total floor area (mm} Public Works Complexes, 4 per 1,000 square feet of total including vehicle servicing floor area (nh) Refuse Transfer Stations 4 per 1,000 square feet of total building floor area (oo) Restaurants, including drive- 12 per 1,000 square feet of total in, snack shops, night clubs floor area up to 6,000 square feet; lounges 15 per 1,000 square feet for each additional 1,000 sq.ft, over 6,000 square feet' (pp) Shopping Centers 4 spaces per 1,000 square feet gross leasable area between 25,000 and 400,000 square feet 4.5 spaces per 1,000 square feet gross leasable area between 400,000 and 600,000 square feet 5.0 spaces per 1,000 square feet gross leasable area over 600,000 square feet. The following uses to any shopping center will increase the require- mentf above: -3- Ord. No. 86-86 (1) .Theaters 3 additional spaces per every 100 - seats in centers having total gross leasable area between 25,000 and 100,000 square feet 3 additional spaces per every 100 seats over 450 seats in centers having total gross leasable area between 100,000 and 200,000 sq.ft. 3 additional spaces per every 100 seats over 750 seats in centers having total gross leasable area over 200,000 sq. ft. (2) Food Service 8 spaces per 1,000 square feet food service tenant area in centers having gross leasable area between 25,000 and 100,000 sq.ft. 6 spaces per 1,000 square feet food service tenant area in centers having gross leasable area between 100,000 and 200,000 sq. ft. No additional spaces in centers having gross leasable area between 200,000 and 600,000 sq. ft. (qq) Swim Clubs I per every 30 square feet of total water area (rr} Tennis Clubs 4 per court Section 2. That Chapter 30, "Zoning", Section 30-17 "Supple- mentary Regulations", Subsection (N) "Hospitals", Subsection (7) "Park- lng" of the Code of Ordinances of the City of Delray Beach, Florida, is hereby repealed and a new Subsection (7) "Parking" is hereby enacted to 'read as follows: (7) PARKING. See Section 30-18 (D) (4) (Y) Section 3. That all ordinances or parts of ordinances in conflict ~r'ewith be and the same are hereby repealed. Section 4.. That should any section or provision of this ordinance or any portion thereof, any paragraph, sentence, or. word be declared by a Court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or part thereof other than the part declared to be invalid. Section 5. That this ordinance shall become effective ten days after passage on second and final reading.
