PUBLIC HEARINGS
6. Zoning Ordinance Amendment - Parks & Recreation Land Dedication -
Ordinance No. 5-82 on second reading - PUBLIC HEARING - amending zoning
ordinance relative to dedication of park and r~creation land or an in-
lieu payment by developers of multi-family planned residential develop-
ments, hotels, motels, resort dwelling units and single family units.
See Ex. "A"
Recommendation: Planning & Zoning Board approved 7-0.
Action: Motion to adopt the Ordinance on second reading.
7. Amend Code - Parks & Recreation Land Dedication - Ordinance No. 6-82 on
second reading - PUBLIC HEARING - amending Chapter 24 "Subdivisions"
relative to dedication of park and recreation land or an in-lieu payment
by developers of single family units, multiple family units, planned
residential units, hotels and motels and resort dwelling units and
reservation of land for school sites. See Ex. "B"
Recommendation: Planning & Zoning Board approved 7-0
Action: Motion to adopt the Ordinance on second reading.
8. Amend Code - Stem Wall Survey - Ordinance No. 11-82 on second reading -
PUBLIC HEARING - amending Chapter 9 "Buildings and Construction"in
order to require submission of the stem wall survey.
Recommendation: Acting Chief Building Official recommends approval.
Action: Motion to adopt the Ordinance on second reading.
9. Amend Code - Submission of Two Copies of Approved Site Plan - Ordinance
No. 12-82 on second reading - PUBLIC HEARING - amending Chapter 9
"Buildings and Construction" in order to require submission of two
copies of the approved site plan.
Recommendation: Acting Chief Building Official and Planning Director
recommend approval.
Action: Motion to adopt the Ordinance on second reading.
10. Amend Code - Docks, Dolphins, Finger Piers and Boat Lifts - Ordinance
No. 13-82 on second reading - PUBLIC HEARING - amending Chapter 9
"Buildings and Construction" to provide for modification of the stand-
ards for approval relative to docks, dolphins, finger piers and boat
lifts.
Recommendation: City Attorney recommends approval.
Action: Motion to adopt the Ordinance on second reading.
11. Amend Code - Newsrack Regulations - Ordinance No. 14-82 on second read-
ing - PUBLIC HEARING - amending Chapter 23 "Streets and Sidewalks"
relative to newsrack regulations.
Recommendation: City Attorney and City Engineer recommend ap-
proval.
Action: Motion to adopt the Ordinance on second reading.
12. Amend Code - Alarm Systems - Ordinance No. 15-82 on second reading -
PUBLIC HEARING - amending Chapter 2.5 "Alarm Systems" relative to serv-
ice charge for excessive alarms and suspension and revocation of permit.
See Ex. "c"
Recommendation: City Attorney, Police Chief and Fire Chief recommend
approval.
Action: Motion to adopt the Ordinance on second reading.
13. Zoning Ordinance Amendment - Limiting Extension of Screened Enclosures -
Ordinance No. 17-82 on second reading - PUBLIC HEARING - limiting the
extension of screened enclosures to the interior side setback areas.
Recommendation: Planning & Zoning Board approved 7-0.
Action: Motion to adopt the Ordinance on second .reading.
CONSENT AGENDA
14. Council Meeting - Setting date for first regular Council Meeting to be
held during the month of March for Wednesday, March 3rd, as the first
Tuesday is Election Day.
Recommendation: City Manager recommends approval.
Action: Motion to set date for first regular Council Meeting in
March for March 3rd.'
15. Intervention in Ongoing Litigation - Kreidler vs Smith (Sunshine Law) .
Recommendation: City Attorney recommends approval.
Action: Motion to authorize and direct the City Attorney to take
appropriate steps to participate as amicus curae in the
declaratory judgment action of Kreidler vs Smith in Circuit
Court for Palm Beach County relative to Sunshine Law.
16. Refund of Membership Dues - Delray Beach Country Club.
Recommendation: City Manager and PrO-Manager recommend approval.
Action: Amend membership policy to permit members who have prepaid
their greens fees and become incapacitated (as shown by a
doctor's certificate to that effect) to receive a pro-rated
refund of their membership dues provided a waiting list for
membership exists at the time; and that persons receiving
such refunds shall relinquish all membership rights and
seniority.
17. Lease Agreement for Bulk Storage Tanks.
Recommendation: Acting Public Utilities Director recommends approval.
Action: Motion to authorize execution of lease agreement with Davis
Process (the odophos suppliers) for three 3,000-gallon
storage tanks.
18. Performance Study of Previous Beach Projects.
Recommendation: City Engineer recowmends approval.
Action: Authorize a performance study of previous beach projects and
analysis of present needs of the City to be conducted by
Arthur V. Strock & Associates, Inc. at a total study cost of
$35,000 with funding to come from the beach restoration fund.

19. Plumosa Park Agreement - Addendum to agreement between the City and
the Palm Beach County School Board.
Recommendation: Parks & Recreation Director recommends approval.
Action: Authorize execution of addendum to agreement.
20. Request for Solicitation of Funds - Veterans of Foreign Wars, O'Neil
Priest Post 4141.
Recommendation: City Clerk recommends approval.
Action: Motion to approve solicitation of funds from March 26~~
through March 27, 1982.
21. Request for Solicitation of Funds - Trinity Council #4839, Knights of
Columbus.
Recommendation: City Clerk recommends approval.
Action: Motion to approve solicitation of funds from March 5th
through March 6, 1982.
22. Heat Pump and Air Handler - Community Center.
A. Transfer of Funds - Transfer $4,000 from the Tennis Center account
to the Community Center account. The $4,000, together with the
current balance of $2,059, will be used to replace the heat pump
and air handler.
B. Resolution No. 10-82 awarding the contract to the low bidder,
Russell W. Jennings in the amount of $5,575. See Ex. "D"
Recommendation: City Manager recommends approval.
Action: Motion to authorize the transfer of $4,000 from the Tennis
Center account to the Community Center account and adopt
the Resolution.
23. Sanitary Sewers and Water Utilities Acceptance - Resolution No. 11-82
accepting all the sanitary sewers and water utilities in Isles of
Delray, Section Two. See Ex. "E"

Action: Motion to adopt the Resolution.
24. Sanitary Sewers and Water Utilities Acceptance - Resolution No. 12-82
