Ordinance No. 41-82 - McCulloch Annexation. Second Reading and PUBLIC HEARING relative to annexing a parcel of land located on the south side of Lake Ida Road, between Davis Road and Congress Avenue, subject to RM-IO (Multiple Family Dwelling) District (Jack S. and Robert L. McCulloch, applicants). Recommendation: Planning & Zoning Board approved 7-0. Action: Motion to adopt the_ Ordinance on Second Reading. CONSENT AGENDA * 9. InfiltrationInvestigation - Phase 2 - Russell & Axon. Consider in- crease in fee for infiltration investigation from $40,000 to $45,000 because of additional field work. Council authorized the investi- gation at the October 27, 1981 meeting. Recommendation: Acting Public Utilities Director recommends ap- proval. Action: Motion to authorize Russell & Axon to proceed witp the project. 10. Notice of Class Action Regarding Camden I Condominium Association, Inc. et al vs John B. Dunkle and Palm Beach County. Consider rati- fying cancellation of purchase of 1978 30-foot Scarab Wellcraft boat to Euardo P. Portillo and authorizing refund of money paid in the amount of $25,000 and further authorizing readvertising and sale of boat. Recommendation: Action: Motion refund City Attorney recommends approval. to ratify cancellation of purchase, authorize of $25,000 and readvertise sale of boat. * 12. Delray Public Works Complex. Change Order No. 3 from Sessoms- Grice Construction Company, Inc. decreases the contract price by $1,600 for a total of $1,317,741. This change order eliminates the drywall sub-ceiling at the steel joists in buildings number 2 and 6 where there is a fire sprinkler system. Recommendation: City Manager and City Engineer recommend ap- proval. Action: Motion to approve change order. * 13. Delray Public Works Complex. Change Order No. 4 from Sessoms- Grice Construction Company, Inc. increases the contract price by $22,006.37 for a total of $1,339,747.57. This change order involves remodeling of the garage area of building number 6 to provide offices for the Parks & Recreation Department. Recommendation: Action: Motion City Manager and City Engineer recommend ap- proval. to approve change order. * 14. Conditional Use Approval - Delray Shores Professional :laza. . Consider request for conditional use in an RM-IO (Mult~ple Fam~ly Dwelling) District to allow a professional office plaza on 1.~4 acres, located on the south side of Lake Ida Road between Dav~s Road and Congress Avenue, subject to listed conditions. Recommendation: Action: Motion Planning & Zoning Board approved 7-0. to approve conditional use request. * 15. Street Abandonment - Avenue "J". Resolution No. 58-82 abandons part of Avenue "J" and Frederick Boulevard. The connecting road rights-of-way within the near and/or adjacent property have been abandoned. Recommendation: Planning & Zoning Board approved 7-0. Action: Motion to adopt the Resolution. * 16. Vacating and Abandoning an Alley - North of N. E. 8th Street, Between U. S. Highway 1 and N. E. 7th Avenue. Resolution No. 59-82 vacates and abandons a 16-foot alley between Lots 8-9 and 17-18, Block 2, Sophia Frey Subdivision. Recommendation: Planning & Zoning Board approved 5-1 (Campbell dissenting). Action: Motion to adopt the Resolution. * 17. Rezoning Request - West side of Germantown Road Between S. W. 10th Street and S. W. 11th Street, if Extended Westward. Resolution No. 60-82 requests permission from the Palm Beach County Board of Commissioners to rezone land to be annexed from CN (Neighborhood Commercial) (County) to LI (Light Industrial) (City) . Consider approval of traffic signal agreements between the City and Palm Beach County regarding the intersections located at: a. Lake Ida Road and Barwick Road. b. Linton Boulevard and AlA. c. East Atlantic Avenue and 7th Avenue. d. Linton Boulevard and Homewood Boulevard. Recommendation: Council action. Action: Motion to authorize execution of agreements. 20. Neighborhood Strategy Area Improvements Committee. Recommendation: Council action. Action: Motion to appoint members to the committee. Claim by City for Accident Occurring May 6, 1981. Consider settle- ment of 75% of all claims by the City regarding Russakis Motors, Inc. in the amount of $7,036.81 for accident occurring on May 6, 1981. Recommendation: City Attorney recommends approval. Action: Motion to accept settlement offer and authorization to enter into or execute any documentation or releases. 22. Appointments - Delray Beach Housing Authority. Consider reappoint- ments of Edward Egan and Donald M. Mackay as members of the Delray Beach Housing Authority to four-year terms ending July 14, 1986. Purchase and Installation of 16" Cut-In Valve. Resolution No. 61-82 authorizes awarding the contract for a 16" cut-in valve to be installed on N. W. 4th Avenue near 3rd Street to Lauderdale Services, Inc., the only bidder, in the amount of $13,855, with funds approved in the 1981-82 budget (revised). Recommendation: Action: Motion Acting Public Utilities approval. to adopt the Resolution. Director recommends Demolition of Building - 148 South Ocean Boulevard. Resolution No. 63-82 authorizes the award of a contract for the demolition of a building located at 148 South Ocean Boulevard to the low bidder, Cushing Demolition in the amount of $1,735, with funds from the beach restoration fund.
