AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
DELRAY BEACH, FLORIDA, DECLARING AN EMERGENCY AND
ENACTING A MORATORIUM ON THE ISSUANCE OF ANY CITY
APPROVAL OR PERMITS WHICH APPROVE OF OR PERMIT THE
CONVERSION OF PROPERTIES FROM COMMERCIAL USES TO
RESIDENTIAL USES WHERE SUCH PROPERTIES ARE LOCATED
IN THE SC (SPECIALIZED COMMERCIAL), GC (GENERAL
COMMERCIAL), CBD (CENTRAL BUSINESS DISTRICT), LC
(LIMITED COMMERCIAL), ZONING DISTRICTS OF THE CITY;
PROVIDING THAT SUCH MORATORIUM SHALL BE EFFECTIVE
FOR NINETY (90) CALENDAR DAYS FROM NOVEMBER 18, 1986
AND SHALL BE APPLICABLE TO ALL PROPERTIES NOT HAVING
RECEIVED SUCH REQUIRED APPROVALS OR PERMITS AS OF
NOVEMBER 18, 1986.
WHEREAS, the City Council of the City of Delray Beach,
Florida, has determined that an emergency exist with regard to the
necessity providing for review and proper planning for the conversion to
residential uses within the commercial zoning districts of the City of
Delray Beach, Florida; and,
WHEREAS, the City Council of the City of Delray Beach,
Florida, desires to immediately enact a moratorium to allow such time
for adequate planning and review to potentially amend the zoning dis-
trict ordinances for the zoning districts SC (Specialized Commercial),
GC (General Commercial), CBD (Central Business District), and LC
(Limited Commercial) zoning districts to plan for such residential
conversions .
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF DELRAY BEACH, FLORIDA, AS FOLLOWS:
~_~. That the City Council of the City of Delray Beach,
Florida, does hereby declare an emergency and does enact a moratorium on
the issuance of any City approvals or permits which approve of or permit
the conversion of properties from commercial uses to residential uses
where such properties are located in the SC (Specialized Commercial), GC
(General Commercial), CBD (Central Business District), and LC (Limited
Commercial) zoning districts of the City of Delray Beach, Florida; and
that this ordinance shall ratify the declaration of such moratorium by
the City Council at the Special Meeting of November 18, 1986.
~9_~. That such moratorium shall be effective for ninety
(90) calendar days from November 18, 1986, and shall be applicable to
all properties located within the zoning districts as set forth in
Section 1, above, and to said owners/agents who have not received the
required permits or approvals for any residential conversions as of
November 18, 1986.

immediately following its passage on second and final reading.
PASSED AND ADOPTED immediately upon its passage on second and
