AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY
BEACH, FLORIDA, CHANGING THE ~CITY ' S LAND USE PLAN
DESIGNATION IN THE COMPREHENSIVE PLAN FOR PARCELS OF LAND
LYING AND BEING IN SECTION 9, TOWNSHIP 46 SOUTH, RANGE 43
EAST, PALM BEACH COUNTY, FLORIDA, FROM MF-10 (MULTIPLE
FAMILY 10 UNITS/ACRE) TO MF-M (MULTI-FAMILY-MODERATE
DENSITY). THE SUBJECT PROPERTY IS LOCATED SOUTH OF BOND
WAY, WEST OF PALM TRAIL AND EAST OF N.E. 8TH AVENUE;
AMENDING THE LAND USE PLAN; PROVIDING AN EFFECTIVE DATE.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF DELRAY BEACH, FLORIDA, AS FOLLOWS=
Section 1. That the legal description of the subject property
is as follows=
Beginning at the northwest corner of Lot 19, Block 2,
Kenmont, as recorded in Plat Book 20, Page 65, of the
Public Records of Palm Beach County, Florida, then
proceed eastward along the south right-of-way of Bond Way
to the northeast corner of Lot 28, Block 2 of Kenmont,
then proceed southward along the west right-of-way of
Palm Trail (N.E. 10th Avenue) to the north right-of-way
line of Witherspoon Lane then westward along said north
right-of-way line to the southwest corner of Lot 13,
Block 2 of Kenmont, then proceed northward along the west
lot iine of Lot 13 to the southeast corner of Lot 22,
Block 2 of Kenmont; then proceed westward along the south
line of Lot 22 and westerly projection thereof to the
southeast corner of Lot 17, Block 2 of Kenmont, then
proceed west along said lot line to the southwest corner
of Lot 17, Block 2,of Kenmont, then northward along the
west lot line of Lot 17, Block 2, Kenmont and the
northerly projection thereof, to the Point of Beginning,
Section 9, Township 46 South, Range 43 East, Palm Beach
County, Florida.
along with
Lots 6,7,8,9,18 and 19 of Kenmont 1st Addition, as
recorded in Plat Book 25, Page 27, and that portion of
McKee Lane lying north of and contiguous to said Lot 7.
along with
Lots 4,5,13,14,17 and 18, Block 4, Sophia Frey
Subdivision, as recorded in Plat Book 24, Page 37, of the
Public Records of Palm Beach County, Florida, and that
.portion of the alley in Block 4 contiguous to Lots 4 and
5 of Sophia Frey Subdivision.-
The subject property is located south of Bond Way, west
of Palm Trail and east of N.E. 8th Avenue.
Section 2. That the Land Use Plan designation of the 'subject
property in the Comprehensive Plan adopted by Ordinance No. 65-79 is
hereby changed to MF-M ~Multi-Family Moderate Density).
Section 3. That the Planning Director of said City shall, upon
the effec'~ive date of this ordinance, change the Land use Plan of Delray
Beach, Florida, to conform with the provisions hereof.
.section 4. That this ordinance shall become effective
immediately after passage on second and final reading.
PASSED AND ADOPTED in regular session on second and final
reading on this the 30~h day of December , 1986.
