122-86 ORDINANCE NO. 122-86 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, CHANGING THE CITY'S LAND USE PLAN DESIGNATION IN THE COMPREHENSIVE PLAN FOR A PARCEL OF LAND LYING AND BEING IN SECTION 13, TOWNSHIP 46 SOUTH, RANGE 42 EAST, PALM BEACH COUNTY, FLORIDA, FROM MF-6 (MULTIPLE FAMILY 6 UNITS/ACRE) TO C (COMMERCIAL). THE SUBJECT PROPERTY IS LOCATED EAST OF MILITARY TRAIL, SOUTH OF ATLANTIC AVENUE AND NORTH OF THE L-34 CANAL; AMENDING THE LAND USE PLAN; PROVIDING AN EFFECTIVE DATE. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That the legal description of the subject property is as follows: That parcel lying east of Military Trail south of SR 806, north of Country Club Acres Plat 2, as recorded in Plat Book 24, Page 2 of the Public Records of Palm Beach County, Florida, and west of Country Club Acres, as recorded in Plat Book 24, Page 10 of the Public Records of Palm Beach County, Florida, excluding that parcel in the northwest corner measuring 220 feet, more or less, east to west and 210 feet, more or less, north to south, Section 13, Township 46 South, Range 42 East, Palm Beach County, Florida. The subject property is located east of Military Trail, south of Atlantic Avenue and north of the L-34 Canal. Section 2. That the Land Use Plan designation of the subject property in the Comprehensive Plan adopted by Ordinance No. 65-79 is hereby changed to C (Commercial). Section 3. That the Planning Director of said City shall, upon ~he effective date of this ordinance, change the Land use Plan of Delray Beach, Florida, to conform with the provisions hereof. Section 4. That this ordinance shall become effective immediately after passage on second and final reading.
