DELRAY BEACH CITY COUNCIL
Pursuant to Section 3.07 of the City Charter of the City
of Delray Beach, Florida, Mayor Leon M. Weekes has instructed me to
advise you of a Special Meeting of Council to be held in the Council
Chambers at 4:30 P.M., Thursday, October 1, 1981.
This meeting has been called for the purpose of:
1. Considering Resolution No. 79-81 regarding the County's
dual taxation for Delray Beach residents.

WHEREAS, Section 125.01(6) (a), Florida Statutes, establishes the
rrethod and procedure by which the governing body of a rmmicipality may
petition the Board of County Ccmnissioners to develop an appropriate
rrechanism to finance services and activities rendered specially for the .
benefit of the property or residents in unincorporated areas and financed
from county-wide revenues; and
WHEREAS, the City of Boynton Beach has, and does hereby fiIrl and
determine that the follow:ing services rDW financed fran county-wide revenues
are rendered specially for the benefit of the property or residents in the
unincorporated areas and the property owners in the City of Boynton Beach
receive no real or substantial benefits fran said services, to-wit:
1. Law enforcement rendered through the Sheriff I s
Road Patrol including the overhead, camnunications
and administration related thereto.
2. Erection and maintenance of traffic signs and signals.
3. Erection and maintenance of street identification signs.
4. Operation of the County Planning, Zoning and
Building DeparOnent.
5. Construction and maintenance of neighborhood parks
and recreation areas.
6. Construction and maintenance of suJ::xii vision street
system.
7. Construction and maintenance of the Cotmty Road
and Bridge System.
8. M3.intenance of shellroc:k roads.
9. Installation and maintenance of street lighting systems.
10. Construction and maintenance of stom drainage systems.
11. Administration of solid waste collection systems.
12. Administration of fire control tax districts.
13 . Administration of land develof(l1eI1t programs.
14. PlaIJrl.ing, acquisition, construction, maintenance and
operation of water and sanitary sewer utility systems.
15. General administration for the Cotmty Ccmnission including,
but not limited to, the County. Ccmnission, County Attorney,
County Mrninistrator, Radio Cormnmications System, and
Finance Office.
16. Rural lot cleaning program.
NCW, ~uRE, BE MID IT IS HEREBY RESOLVED BY THE CITY OJMrlISSICN OF
THE CITY OF BOYNl'CN BEAa1, FLO..'RIDA:
Section 1. The City of Boynton Beach, Palm Beach Cotmty, Florida,
. does hereby petition the Board of Cotmty Cattnissioners of Palm Beach Cotmty,
Florida, to develop an appropriate rrechanism to finance the activities and
services above set forth either by taxes, special assessrrents, or service
charges levied solely upon residents of property in the t.mincorporated areas,
by the establishment of a rmmicipal service taxing or benefit unit pursuant
to paragraph (q) of subsection (1) of said Section 125.01, Florida Statutes,
or by remitting the identified cost of services paid by the taxes levied
upon property situate within the City of Boynton Beach.
Section 2. That the City Clerk is hereby directed to file a
certified copy of this Resolution with the Palm Beach Cotmty Clerk and
deliver a copy tmto each of the County Cattnissioners of Palm Beach COtmty
and the County Administrator.
section 3. That this Resolution shall become effective i.r:mediately
upon its passage.
