The ad-hoc committee developed a plan entitled Sharing for Excellence in Schools 1990 - The Delray Beach Plan, (herein after referred to as the "Plan"), which was adopted by the City Commission in April 1989 and in July by Palm Beach County School District. The goals of the Plan were to achieve racial balance, minimize bussing and overcrowding, lessen the number of school districts to which the students were assigned from anyone neighborhood, overcome negative public perceptions, and ensure that Delray was receiving proportionate levels of funding for the construction of new schools and renovations/expansion of existing schools. The Plan included recommendations and strategies for its implementation which included such items as construction of two new elementary schools (Orchard View and Morikami), a new middle school (Carver), implementation of magnet programs at Pine Grove and S.D. Spady, re-use of Old Carver Middle school, and building upgrades at Atlantic High School. The Plan also recommended the appointment of a special board to the City Commission to advise them in matters pertaining to education and school facilities. On August 22, 1989, the City Commission adopted a resolution, which established the Education Board as a permanent advisory body to the City Commission. The Education Board is comprised of 9 members - 7 regular members and 2 student members. They meet on the first and third Mondays of the month As originally established, the Education Board's duties and responsibilities include such items as: a) monitoring of School Board activities; b) serve as liaison between the School Board and the City Commission; c) information exchange with Principals via liaison assignments; d) preparation of an annual "State of the Schools" report; e) monitoring State legislation that may effect Delray Schools; f) continuous public relations effort to improve and maintain the public image of Delray Beach Schools; g) attracting State and Federal grants in support of Delray Schools; and h) review developments that may Impact racial balance of schools. In the time since the Board was originally established, many of the objectives of the Sharing for Excellence Plan have been achieved, and new local educational issues have surfaced. The Board feels that the time is right to revisit their composition and responsibilities. They want to share their ideas with the City Commission at thiS workshop, to get feedback from Commission members on the proposed changes, as well as any other Input the Commission would like to provide regarding the Board's direction. City Commission Workshop of June 13, 2000 Education Board Page 2 ';" .',3 /':";;h!< , Composition One of the main functions of the Board is that each regular (non-student) member is to serve as a liaison to one public school and one private school, primarily for the purpose of exchanging information and reporting to the Board on any needs or problems that the schools may be expenencing. This usually involves attendance at the school's SAC meetings. At the time that the Board was created, Delray Beach had 5 public school and 4 pnvate schools. That number has now grown to 10 public schools and 7 private schools. These numbers do not include the schools outside of the City limits that are attended by Delray students, nor does it account for new schools that will be coming on line in the near future. Consequently, several Board members serve as a liaison to 3 schools. It is almost impossible for Board members to keep up with all of the Ed Board and SAC meetings each month. In order to ensure that the relationships between the schools and the Board do not suffer, the Board is requesting that the City Commission consider increasing its membership from 7 to 9 regular members, which will help to decrease the number of liaison assignments to each member. The new members can also provide assistance with various Ed Board activities such as the annual School Showdown of the Arts, Principal Forum Breakfasts, and updating of the Education Brochure. Duties and Responsibilities The Code of Ordinance Sections 32.25-32.30 and the "Rules of the City of Delray Beach Education Board" are in need of updating to reflect changes that have occurred over the years. For instance, the annual School Showdown of the Arts (formerly the Education Expo) should be referenced in the section regarding public relations activities. Also, the manner in which the State of the Schools report is handled has changed over the years, and does not follow the format described in the ordinance The ordinance states that an annual report is to be filed with the City Commission during a worksession in May. However, in past practice, the Board would present a "State of the Schools" address at Old School Square. These meetings were not very well attended and were eventually discontinued. More recently, information regarding the status of the individual schools and progress on their School Improvement Plans has been provided by the school prinCipals at the Principal's Forum Breakfasts, which are hosted twice a year by the Chamber of Commerce and the Education Board. These events are reasonably well attended by school personnel, City Commission members and the business community, and appear to work well in terms of exchanging information. The Commissioners should discuss if this is an adequate means of obtaining a status report on the schools, or if a more formal report is desired. The Board has indicated that they wish to take on several major projects in the upcoming school year including: the facilitation of a new visioning process and ultimate plan which outlines where the City needs to go from here, researching the possibility of establishing a Municipal Charter school in the City, and setting up a business outreach program that the Chamber of Commerce is willing to help implement The Board would appreciate any input the Commission might have regarding these proposals or any other ideas for improving the state of education in the City. ,"l' 3 ," , 3 l;, ,~ Discuss and provide direction. The Education Board of the City of Delray Beach is hereby established as a permanent advisory body to the City Commission. (Ord. No. 24-90, passed 7/24/90) Section 32.26 COMPOSITION: APPOINTMENT: TERMS. The Education Board shall be composed of nine (9) regular members, two of which shall be student members. Seven (7) regular members shall be appointed by the City Commission for terms of two (2) years, except that the members of the first Board to serve shall be appointed so that three (3) members shall serve one (1) year terms, and four (4) members shall serve two (2) year terms. Their successors shall be appointed to two (2) year terms. It is further provided that no member may serve more than two successive terms on this Board. Two (2) student members shall be appointed by the City Commission for a one (1) year term and a two (2) year term, respectively, except that the first student members appointed shall serve as follows: One (1) year term ending July 31, 1995; two (2) year term ending July 31, 1996. Their successors shall be appointed thereafter to full one and two year terms. No student member may serve more than one term. (Ord. No. 24-90, passed 7/24/90; Am. Ord. No. 98-94, passed 1/3/95) ... . Sect10n 32.27 ORGANIZATION. (A) The Education Board shall elect a Chairperson and Vice-Chairperson to preside at its meetings and any other officers as the Board may deem necessary. The Chairperson shall be the official spokesperson for the Board and the formal liaison between the Education Board and the School Board. (B) The Education Board shall formulate rules and regulations for the conduct of its business. (C) The Education Board shall have technical and logistical support provided as designated by the City Manager. A staff person shall be designated as the official City contact with the School District Administration. (Ord. No. 24-90, passed 7/24/90) III.13 - -------------- . Section 32.28 Section 32.28 OUALIFICATIONS OF MEMBERS. It is the intent, if possible, that the membership of the Education Board shall include members who have a background in business, real estate, and/or education. The members of the Education Board shall be residents of the City of Delray Beach or shall be a person with a child or children attending Delray Beach public schools, or shall own property in the city and/or own or operate a business within the city. Should r a member of the Education Board not be a resident of the City of Delray Beach, or a property owner and/or the owner/operator of a business within the city, and should that member's child or children cease attending Delray Beach public schools, then such member shall no longer be qualified to serve on the board. The student members shall be residents of the City of Delray Beach or attend Delray Beach public schools. (Ord. No. 24-90, passed 7/24/90j Am. Ord. No. 41-93, passed 6/22/93j Am. Ord. No. 98-94, passed 1/3/95) Section 32.29 DUTIES AND RESPONSIBILITIES. The duties and responsibilities of the Education Board shall be as follows: (A) Monitoring of School Board activities. - (B) Serve as liaison between the School Board of Palm Beach County and the City Commission. , (C) Participate in an information exchange via school newsletters and principal's office with the administration of each Delray Beach school as well as those attended by Delray Beach students elsewhere. (D) Preparation of an annual "State of Schools" report with respect to Delray Beach schools. (E) Development of recommendations to the City Commission for forwarding to the School Board of Palm Beach County regarding actions which may be taken in support of schools in Delray Beach and with respect to proposed legislation at the State level. (F) Maintenance of a continuous public relations effort to improve and maintain the public image of Delray Beach schools. This effort should include, but not be limited to, the following: (1) Placement of favorable material in local mediaj (2) Development of brochures and other materials to be utilized in "marketing" the Delray Beach schools. III.14 . Section 32.29(G) -- (G) Identifying and attracting State and Federal programs and grants in direct support of Delray Beach schools. (H) Provide comments to the City Commission regarding proposed developments and their impacts upon the racial balance of schools. (Ord. No. 24-90, passed 7/24/90) Section 32.30 MEETINGS: REPORTS. (A) The Education Board shall meet at least once monthly on a regular basis, with a regular meeting date of the first Monday of each month, except for when that date falls on a holiday under which circumstance the Board shall establish another regular meeting date for that month. The Education Board may hold special meetings at the direction of its Chairperson upon twenty-four (24) hour notice. (B) All meetings shall be open to the public and the order of business and procedure to be followed shall be as prescribed within the rules and regulations to be adopted by the Education Board. (C) An annual "State of Schools" report shall be filed with the City Commission so that it will be reviewed during a work session in the month of May, thus affording time to address the ~ , work program and budget of the School Board of Palm Beach County for the following fiscal year. GENERAL GOVERNING RULES: The Education Board (hereinafter the -Board.) shall be govemed by Resolution 54-89 of the City of Delray Beach, Rorida (hereinafter the -City") , as and if amended, and the Rules of Procedure hereinafter set forth (hereinafter the "Rules.), as adopted by the Board and approved by the City Commission. ARTICLE (( . OFFICERS, COMMIITEES: 1. The Board shall elect a Chair, Vice Chair, and Second Vice Chair, annually at its first regular meeting in the month of September, from among its members, by a majority vote of its .- members present and voting. 2. The Chair (or in his/her absence, the Vice Chair or Second Vice Chair) shall preside at all meetings of the Board and rule on all points of order and procedure. 3. The Chair shall appoint any committees which may be deemed necessary. 4. The Staff Uaison shall act as Recording Secretary. The Recording Secretary shall take I and transcribe the minutes of each meeting of the Board, conduct all correspondence of the Board, keep a minute book recording attendance and the vote of each member upon each question (or, if a member is absent or fails to vote, indicating such fact), maintain records of examinations and hearings and other official actions, and carry out such other official duties as may be assigned by the Board. ARTICLE III. MEETINGS, QUORUM, CONFUCTS: 1. REGULAR MEETINGS: The Board shall conduct its regular meetings every first and third Monday of each month at 5:30 p.m., unless there is no cause to hold such a meeting, unless such regular meeting date falls on a holiday as designated by the City of Delray Beach or with the option of not holding the second meeting of any month as detennined by the Chairman. The Recording Secretary of the Board shall notify each Board member, not less than one (1) day prior to any regularly scheduled meeting, of the time and place of each meeting. , 2. SPECIAL MEETING: A special meeting may be called by the Chair subject to compliance with statutory notice provisions. ,. 3. QUORUM: A quorum is required in order to hold a meeting. A quorum shall consist of 50% + 1 of filled positions of the Board. All findings and orders of the Board require a \ vote of the majority of its members present and voting; provided, however, that not less than 50% + 1 members of the Board must vote in favor of an action for the action to be official. 4. No member of the Board shall hear or vote upon any matter before the Board in which she or he is directly affected in a financial way. Whenever a member or alternate member of the Board has a direct personal, private or personal interest in any matter which comes before the Board, which interest creates a conflict of interest, that member or alternate member shall disclose said conflict before discussion and vote and shall, within fifteen (15) days after the vote occurs, file the proper form with the Board Secretary pursuant to the provisions of Chapter 112, Rorida Statutes. 5. CONDUCT OF MEETINGS: All meetings shall be open to the public, and the fonnal agenda posted in the Lobby of City Hall three (3) days prior to each regularly scheduled meeting. The Chair may, at his or her discretion, change the order of business at any meeting. 6. ADJOURNED MEETINGS: The Board may adjourn a regular meeting, if all business cannot be disposed of on the day set, to a time and date certain; however, notice of the time and date of postponement shall be given at the time of adjournment and shall not be changed prior to resumption of the postponed meeting. ARTICLE IV. SCHOOL LIAISON ASSIGNMENTS: 1. DELRAY BEACH PUBLIC SCHOOLS: Each Education Board member shall serve as a liaison to a public school located in Delray Beach. Responsibilities of the liaison include: 1) meet or talk once per month with Principal and/or SAC Chair, 2) discuss needs/priorities and bring back information to Board for any action, 3) coordinate Education Expo, 4) obtain positive information for public relations, Le., news releases, and 5) attend school meetings, as may be required. 2. DELRAY BEACH PRIVATE SCHOOLS: Each Education Board member shall serve as a liaison to a private school located in Delray Beach. Responsibilities of the liaison include: 1) coordinating Education Expo and, 2) meet periodically or call to determine if there are any needs or problems. ARTICLE V . ABSENCES, RESIGNATION, VACANCIES: 1. ABSENCES: If any regular Board member fails to attend three (3) consecutive regular meetings, the member's office shall be deemed vacant and the City Commission shall promptly fill such vacancy. The Board member may appeal the decision and reapply in writing to the City Commission. 2. RESIGNATION: Except as otherwise provided in Paragraph 1, above, of this Article V, a Board member may resign from the Board by filing a written statement of resignation with the Clerk of the City. 3. VACANCY: Vacancies on the Board shall be filled pursuant to Section 32.10 of the City Code of Ordinances, as amended. " " ARTICLE VI . Prior to any such amendment becoming effective, it must first be approved by the City Commission. 3. These Rules shall be reviewed by the Board not less than every two (2) years. 4.
