AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY
BEACH, FLORIDA, AMENDING CHAPTER 9, "BUILDINGS AND CON-
STRUCTION" , ARTICLE X, "LANDSCAPING" OF THE CODE OF
ORDINANCES OF THE CITY OF DELRAY BEACH, FLORIDA, BY
AMENDING SECTION 9-378, "REQUIREMENTS FOR CERTAIN YARD
AREAS, OFF-STREET PARKING, OTHER VEHICULAR USE AREAS ",
SUBSECTION (f), "PARKING AREA INTERIOR LANDSCAPING" (3),
TO PROVIDE THAT ONE COCONUT PALM HAVING A CLEAR TRUNK OF
TWO (2) FEET MAY SERVE AS A SUBSTITUTE FOR ONE TREE;
PROVIDING A SAVING CLAUSE; PROVIDING A GENERAL REPEALER;
PROVIDING AN EFFECTIVE DATE.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. That Chapter 9, "Buildings and Construction", Article
X, "Landscaping", Section 9- 378, "Requirements for certain yard areas,
off-street parking, other vehicular use areas", Subsection (f) "Parking
area interior landscaping", (3), of the Code of Ordinances of the City of
Delray Beach, Florida, is hereby amended to read as follows:
(3) There shall be a group of palms or a canopy tree for
each one hundred ( 100 ) square feet of required
interior landscaping. No more than twenty-five
percent ( 25 %) of these required trees shall be
palms. These trees shall have a minimum height of
twelve (12) feet and a spread of crown of six (6)
feet with at least six (6) feet of clear mature wood
at the time of planting. Trees with a smaller crown
can be grouped to meet the required six (6) foot
spread, and each group shall be considered as one
tree. However~ one coconut palm having a clear
trunk of two (2) feet may serve as a substitute for
one tree.
Section 2. That should any section or provision of this ordi-
nance or any portion thereof, any paragraph, sentence, or word be declared
by a Court of competent jurisdiction to be invalid, such decision shall
not affect the validity of the remainder hereof as a whole or part thereof
other than the part declared to be invalid.
Section 3. That all ordinances or parts of ordinances in con-
flict herewith be and the same are hereby repealed.
Section 4. That this ordinance shall become effective ten days
after passage on second and final reading.
