AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY
BEACH, FLORIDA, AMENDING CHAPTER 30 "ZONING", OF THE CODE
OF ORDINANCES OF THE CITY OF DELRAY BEACH, FLORIDA, BY
AMENDING SECTION 30-2 "ESTABLISHMENT OF ZONING DISTRICTS,
PROVISIONS FOR OFFICIAL ZONING MAP" (C) "ESTABLISHMENT OF
ZONING DISTRICT" TO PROVIDE FOR THE ESTABLISHMENT OF A
MIC (MIXED INDUSTRIAL AND COMMERCIAL) DISTRICT; ENACTING
A NEW SECTION 30 -15.4 "MIC (MIXED INDUSTRIAL AND COM-
~RCIAL) DISTRICT"; PROVIDING FOR THE PURPOSE OF SAID MIC
(MIXED INDUSTRIAL AND COMMERCIAL) DISTRICT; PROVIDING FOR
THE PERMITTED AND CONDITIONAL USES IN SAID MIC (MIXED
INDUSTRIAL AND COMMERCIAL) DISTRICT; PROVIDING FOR NO
REQUIREMENTS FOR LOT DIMENSIONS AND SITE AREA WITHIN SAID
MIC (MIXED INDUSTRIAL AND COMMERCIAL) DISTRICT; PROVIDING
FOR BUILDING SETBACKS, GROUND FLOOR BUILDING AREA, TOTAL
FLOOR AREA, BUILDING HEIGHT, PARKING AND LOADING REGULA-
TIONS, %~%LLS AND FENCES, LANDSCAPING, SIGNS; PROVIDING
FOR SPECIAL REGULATIONS; PROVIDING A SAVING CLAUSE;
PROVIDING FOR REPEAL OF ALL ORDINANCES OR PARTS OF ORDI-
NANCES IN CONFLICT HEREWITH; PROVIDING AN EFFECTIVE DATE.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. That Chapter 30 "Zoning", Section 30-2 "Establishment
of Zoning Districts, Provisions for Official Zoning Map" (C)"Establishment
of Zoning District" of the Code of Ordinances of the City of Delray Beach,
Florida, is hereby amended to read as follows:
MIC Mixed Industrial and Commercial
Section 2. That Chapter 30 "Zoning", of the Code of Ordinances
of the City of Delray Beach, Florida, is hereby amended by enacting a new
Section 30-15.4, "MIC (Mixed Industrial and Commercial) District" to read
as follows:
Section 30-15.4. MIC MIXED INDUSTRIAL AND COMMERCIAL DISTRICT
(A) PURPOSE
The MIC zoning district is intended to encourage small and medium
users in a mixture of non-residential uses, including light
manufacturing, wholesale distribution, storage, business ser-
vices, commercial and professional uses, and limited retail
activity. Retail uses shall be permitted only when such uses are
secondary to the primary use such as light manufacturing or
wholesale distribution. Retail use shall be limited to no more
than twenty-five percent (25%) of the total floor area as defined
in the City code, except as defined under conditional uses.
(B) PERMITTED USES
All developments shall be subject to Section 30 -22 Site and
Development Plan Approval.

(C) CONDITIONAL USES
As prescribed in Sec. 30-21, and after the review of the
application and plans appurtenant thereto, and hearing
thereon, the Planning and Zoning Board finds as a fact that
the proposed use or uses are consistent with good zoning
practice, not contrary to the Master Plan, and not
detrimental to the promotion of public appearance, comfort,
convenience, general welfare, good order, health, morals,
prosperity, and safety of the City, the following uses may
be recommended to the City Council as Conditional Uses:
(1) Communication and transmission facilities
(2) Hotels and Motels
(3) Laundry and dry cleaning plants
(4) Public utilities
(5) Restaurants and cafes
(6) Retail uses as accessory uses to other uses, not to exceed
thirty-five percent (35%) of the total floor area
(7) Upholstery shops, furniture repair
(D) LOT DIMENSIONS AND SITE AREA
No requirements
(E) BUILDING SETBACKS
(1) Front 25 ft.
(2) Side (Interior) 10 ft.
(3) Side (Street) 25 ft.
(4) Rear 10 ft.
Exception:
%fnen a parcel of land zoned MIC Mixed Industrial and
Commercial District directly abuts a parcel of land zoned
residential without any division or separator between them,
such as a street, railway, waterway, park, or other public
open space, but excluding an alley, the following shall be
the minimum setbacks on the abutting property line of the
parcel of land zoned MIC Mixed Industrial and Commercial:
(1) Front - 30 feet, with a minimum landscaped buffer of 15 feet
(2) Side - 50 feet, with a minimum landscaped buffer of 15 feet
(3) Rear - 50 feet, with a minimum landscaped buffer of 15 feet
(F) GROUND FLOOR BUILDING AREA
The total ground floor building area of all buildings and
structures shall not exceed fifty percent (50%) of the total
lot area.
(G) TOTAL FLOOR AREA
No requirements
(H) BUILDING HEIGHT
No building or structure shall be constructed to a height
exceeding sixty (60) feet.

(L) LANDSCAPING
A landscaping plan in conformance with Chapter 9, Art. X
showing location, type, and size of all plantings shall be
submitted for review and approval by the Community
Appearance Board.
(M) SIGNS

(N) SPECIAL REGULATIONS
(1) All operations shall be conducted wholly within a
completely enclosed building, except for off-street
loading, automobile and truck parking, and storage,
when screened from view in conformance with Sec.
30-17 (I)(2).
(2) Loading and unloading shall be restricted to the rear
and side yards and shall be prohibited within the front
yard setbacks.
(3) Artificial lighting used to illuminate the premises
shall be directed away from adjacent properties.
(4) Within the twenty-five (25) ft. front setback, the
first ten (10) feet abutting the street right-of-way
shall be used as a landscaped area. Within this
landscaped area, no paving shall be allowed except for
driveways and walkways leading to a structure on the
premises. Such driveways and walkways shall be allowed
only when points of ingress and egress are generally
perpendicular to the property line.
(5) Where a parcel of land zoned MIC Mixed Industrial and
Commercial abuts a residential district with or without
an intervening alley, a landscaped buffer shall be
provided along rear or side lot lines, said buffer to
be at least fifteen (15) feet wide at right angles to
the lot line and established along the entire length
and contiguous to lot lines.
(6) Overhead and garage doors shall be prohibited from
facing a public right-of-way.
Section 3. That should any section or provision of this ordi-
nance or any portion thereof, any paragraph, sentence, or word be declared
by a Court of competent jurisdiction to be invalid, such decision shall
not affect the validity of the remainder hereof as a whole or part thereof
other than the part declared to be invalid.
Section 4. That all ordinances or parts of ordinances in con-
flict herewith be and the same are hereby repealed.

Section 5. That this ordinance shall become effective ten days
after passage on second and final reading.
