AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY
BEACH, FLORIDA, AMENDING CHAPTER 30 "ZONING", OF THE CODE
OF ORDINANCES OF THE CITY OF DELRAY BEACH, FLORIDA, BY
AMENDING SECTION 30-2 "ESTABLISHMENT OF ZONING DISTRICTS,
PROVISION FOR OFFICIAL ZONING MAP" (C) "ESTABLISHMENT OF
ZONING DISTRICTS" TO CREATE A NEW ZONING CLASSIFICATION
OF R-1A-C (SINGLE FAMILY/DUPLEX DWELLING ) DISTRICT;
AMENDING SECTION 30-5 TO PROVIDE FOR AN R-1A-C (SINGLE
FAMILY/DUPLEX DWELLING) DISTRICT; AMENDING SECTION 30-5
(B) "PERMITTED USES" BY ADDING A NEW SUBSECTION (3) TO
PERMIT DUPLEX STRUCTURES IN THE R-1A-C DISTRICT; AMENDING
SECTION 30-5 (D) "LOT DIMENSIONS AND SITE AREA" BY ADDING
A NEW SUBSECTION (7) TO PROVIDE FOR LOT DIMENSIONS IN THE
R-1A-C DISTRICT OF 8,000 SQUARE FEET, AND PROVIDING FOR
WIDTH, FRONTAGE AND DEPTH REQUIREMENTS; AMENDING SECTION
30-5 (E) "AGGREGATE FLOOR AREA REQUIREMENTS" TO PROVIDE
FOR MINIMUM IN THE R-1A-C DISTRICT OF 1,000 SQUARE FEET;
AMENDING SECTION 30-5 (F) "BUILDING SETBACKS" (1) "MINI-
MUM SETBACKS" BY ADDING SUBSECTION (7) TO PROVIDE FOR AN
R-1A-C DISTRICT AND PROVIDING FRONT, SIDE (INTERIOR) ,
SIDE (STREET) AND REAR SETBACKS; AMENDING SECTION 30-5
(N) "SPECIAL REGULATIONS" BY ADDING A NEW SUBSECTION (7)
TO PROVIDE FOR AN R-1A-C DISTRICT AND TO PERMIT DUPLEX
STRUCTURES WITHIN THE R-1A-C DISTRICT WITH CERTAIN CONDI-
TIONS; FURTHER AMENDING SUBSECTION (N), "SPECIAL REGU-
LATIONS", BY ADDING A NEW SUBSECTION (8) TO PROVIDE FOR
CONVEYANCE OF ONE-HALF OF THE LOT UNDER CERTAIN CONDI-
TIONS; PROVIDING A SAVING CLAUSE; PROVIDING FOR REPEAL OF
ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HERE-
WITH; PROVIDING AN EFFECTIVE DATE.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. That Chapter 30 "Zoning", Section 30-2 "Establishment
of Zoning Districts, Provision For Official Zoning Map" (C) "Establishment
Of Zoning Districts" of the Code of Ordinances of the City of Delray
Beach, Florida, is hereby amended by adding the following:
R-1A-C Single Family/Duplex Dwellin~ District
Section 2. That Chapter 30 "Zoning", Section 30-5 "R-iAAA,
R-iAAA-B, R-1AA, R-1AA-B, R-iA, R-1A-B Single Family Dwelling Districts"
of the Code of Ordinances of the City of Delray Beach, Florida, is hereby
amended to read as follows:
Sec. 30-5 R-1AAA, R-IAAA-B, R-1AA, R-1AA-B, R-lA,
R-1A-B Single Family and R-1A-C Single Family
Duplex Dwelling Districts
Section 3. That Chapter 30 "Zoning", Section 30-5 "R-1AAA,
R-iAAA-B, R-1AA, R-1AA-B, R-lA, R-1A-B Single Family Dwelling Districts"
(B) "Permitted Uses" of the Code of Ordinances of the City of Delray
Beach, Florida, be amended by adding the following:
(3) Duplex structures are permitted in the R-1A-C zoning
district
Section 4. That Chapter 30 "Zoning", Sectin 30-5 "R-IAAA,
R-iAAA-B, R-1AA, R-1AA-B, R-iA, R-1A-B Single Family Dwelling Districts"
(D) "Lot Dimensions And Site Area" of the Code of Ordinances of the City
of Delray Beach, Florida, be amended by adding the following:

Section 5. That Chapter 30 "Zoning", Section 30-5 "R-iAAA,
R-iAAA-B, R-1AA, R-1AA-B, R-lA, R-1A-B Single Family Dwelling Districts"
(E) "Aggregate Floor Area Requirements" of the Code Of Ordinances of the
City of Del ray Beach, Florida, is hereby amended to read as follows:
The following shall be the minimum floor area for all
single family dwellings, and individual units within du-
plex structures ~ exclusive of terraces and unroofed
areas, including fifty (50) percent of attached carports,
garages, and screened patios:
(1) R-iAAA 2,200 sq. ft.
(2) R-1AAA-B 1,500 sq. ft.
(3) R-1AA 1,500 sq. ft.
(4) R-1AA-B 1,500 sq. ft.
(5) R-iA 1,000 sq. ft.
(6) R-1A-B 1,500 sq. ft.
(7) R-1A-C 1,000 sq. ft.
Section 6. That Chapter 30 "Zoning" Section 30-5 "R-iAAA,
R-iAAA-B, R-1AA, R-1AA-B, R-iA, R-1A-B Single Family Dwelling Districts"
(F) "Building Setbacks" (1) "Minimum Setbacks" of the Code of Ordinances
of the City of Delray Beach, Florida, be amended by adding the following:

Section 7. That Chapter 30 "Zoning", Section 30-5 "R-iAAA,
R-iAAA-B, R-1AA, R-1AA-B, R-lA, R-1A-B Single Family Dwelling Districts"
(N) "Special Regulations" of the Code of Ordinances of the City of Delray
Beach, Florida, be amended by adding a new Subsection (7) and Subsection
(8) to read as follows::
(7) Duplex structures are permitted within the R-iA-C zoning
district provided that the lot meets the minimum lot
dimensions as stated at Sec. 30-5(D) "Lot Dimensions and
Site Area" and contains a minimum lot area of 8,000
square feet. Duplex structures shall comply with the
setback standards of the R-iA-C District, Sec. 30-5(F)
"Building Setbacks."
Exception: Lots or parcels of record whose width or
frontages do not meet the required minimum of 60 feet if
an interior lot or 80 feet if a corner lot, but are not
less than 50 feet if an interior lot or 70 feet if a
corner lot, and which contain a minimum lot area of 6,000
square feet and have a minimum lot depth of 100 feet,
then a duplex structure shall be permitted, and the
setbacks shall be as stated at Sec. 30-5(F) "Building
Setbacks."

(8} On lots or parcels of record where duplexes are per-
mitted, and where said lots or parcels are at least 8,000
square feet, and where there is a party wall separating
the two (2) duplex units, each unit together with ap-
proximately one-half (%) of the lot may be conveyed,
providing each portion of the lot contains not less than
4,000 square feet, and the dividing line runs through the
party wall. The conveyance as set forth in this para-
graph shall not constitute subdivision requiring addi-
tional platting.
(a) Conditions
(1) The common wall separating the two duplex units
must be a fire rated wall, as required for
residential separations in the Standard Build-
ing Code, as adopted by the City. Whenever a
screen porch enclosure attached to said duplex
units is set back from the dividing line be-
tween the two units in such duplex by three (3)
feet or more, then a screening wall located on
the common property line between the duplex
units shall be extended the same distance as
the screen porch enclosure. Whenever the side
of a screen porch enclosure is closer tha.
three (3) feet to the dividing line between the
two units in such duplex, then a fire rated
wall shall be extended the same distance as the
screen porch enclosure.
(2) Each individual duplex unit and its portion of
the lot or parcel it is located on, must be
adjacent to a public or private street, and
have direct access thereto.
Section 8. That should any section or provision of this ordi-
nance or any portion thereof, any paragraph, sentence, or word be declared
by a Court of competent jurisdiction to be invalid, such decision shall
not affect the validity of the remainder hereof as a whole or part thereof
other than the part declared to be invalid.
Section 9. That all ordinances or parts of ordinances in con-
flict herewith be and the same are hereby repealed.
Section 10. That this ordinance shall become effective ten days
after passage on second and final reading.
