22-85 ORDINANCE NO. 22-85 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AMENDING CHAPTER 26, "TRAFFIC", OF THE CODE OF ORDINANCES OF THE CITY OF DELRAY BEACH, FLORIDA, BY AMENDING SECTION 26-68, "PARKING PERMITS" TO ALLOW A PARKING PERMIT TO BE TRANSFERRED AND A SUBSTI- TUTE STICKER TO BE ISSUED TO A SUBSTITUTE VEHICLE ACQUIRED BY THE SAME PERMIT HOLDER SUBSEQUENT TO THE ISSUANCE OF THE ORIGINAL PARKING PERMIT; PROVIDING A SAVING CLAUSE; PROVIDING AN EFFECTIVE DATE. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That Section 26-68, "Parking permits" of the Code of Ordinances of the City of Deiray Beach, Florida, be and the same is hereby amended to read as follows: Sec. 26-68. Parking permits. A parking permit may be purchased from the city which shall authorize the parking of the vehicle for which the permit was acquired in any parking meter space located within the Anchor Park and Sandoway Park parking lots without requiring the payment of money into the space's parking meter. The cost of the parking permit shall be twenty-five dollars ($25.00) per year. Each permit shall cover the period from October first through September thirtieth, and there shall be no proration of the permit fee. The application procedure and the form of the permit shall be determined by the city administration. It shall be illegal to deface a parking permit or to transfer a parking permit from the vehicle for which it was acquired to any other vehicle; pro- vided, however, upon the parking permit sticker and other sufficient proof being Submitted to the city, and whe{~ a~'~r°Ved"i~ ad{~ance" by the city mahager, a parkin~ permit may be transferred (and a substitUt~ sticke{~ shall b~ is'sUed~ t~o a substltut~ vehicle acquired by the same permit holder subsequent to the issuance of lthe' Original parking permit. Section 2. That should any section or provision of this ordinance or any portion thereof, any paragraph, sentence, or word be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or part thereof other than the part declared to be invalid. Section 3. That this ordinance shall become effective ten (10) days after its passage on second and final reading.
