41-85 ORDINANCE NO. 41-85 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AMENDING CHAPTER 17, "PARKS, BEACHES AND RECREATION", OF THE CODE OF ORDINANCES OF THE CITY OF DELRAY BEACH, FLORIDA, BY AMENDING ARTICLE II, "MUNICIPAL BEACH", BY AMENDING SECTION 17-30, "SURFING", TO ADD LANGUAGE V/HICH PROHIBITS THE USE OF ANY SURFBOARDS OR OTHER SIMILAR ARTICLES IN A MANNER V/HICH CONSTITUTES A HAZARD TO ANY OTHER PERSON; PROVIDING A GENERAL REPEALER; PROVIDING A SAVING CLAUSE; PROVIDING AN EFFECTIVE DATE. NOV,', THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, A5 FOLLOV/5: Section 1. That Article II, "Municipal Beach", Section 17-30, "5urfing", of the Code of Ordinances of the City of Defray Beach, Florida, be, and the same is hereby amended to read as follows: 5ec. 17-33. 5urfing. No surfboarding shall be permitted except in areas designated by the city manager. It shall be the duty of the chief lifeguard to see that proper markers are maintained to indicate the location of any area so designated. No person shall use any surfboard~ paddleboard~ skimmer~ belly board~ rubber life raft~ canoe~ boat~ or other similar obiect made entirely or partially of w. ood~ metal~ glass~ hard p!astic~ or any other hard substance at any timer on the beach or in the Atlantic Ocean in a manner that constitutes a hazard to any other person. Section 2. That all ordinances or parts of ordinances which are in conflict herewith are hereby repealed. Section 3. That should any section or provision of this ordinance or any portion thereof, any paragraph, sentence, or word be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or part thereof other than the part declared to be invalid. Section ~. That this ordinance shall become effective ten (10) days after its passage on second and final reading.
