42-85 ORDINANCE NO. 42- 85 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AMENDING CHAPTER 17, "PARKS, BEACHES AND RECREATION", OF THE CODE OF ORDINANCES OF THE CITY OF DELRAY BEACH, FLORIDA, BY AMENDING ARTICLE II, "MUNICIPAL BEACH", BY ENACTING A NEW SECTION 17-33, "DANGEROUS OB3ECTS PROHIBITED ON THE MUNICIPAL BEACH", PROVIDING THAT NO PERSON SHALL DEPOSIT OR CAUSE TO BE DEPOSITED ON THE BEACH ANY DANGEROUS ARTICLES~ PROVIDING A GENERAL REPEALER CLAUSE~ PROVIDING A SAVING CLAUSE; PROVIDING AN EFFECTIVE DATE. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That Article II, "Municipal Beach", of the Code of Ordinances of the City of Delray Beach, Florida, be amended by enacting a new Section 17-33, "Dangerous objects prohibited on the municipal beach", to read as follows: Sec. 17-33. Dangerous objects prohibited on the municipal beach. No person shall throw, cast, deposit or cause to be thrown, on the municipal beach any glass, bottles, tin cans, nails, rubbish, trash or any article whatsoever that is or may become a menace to life or limb to any person or bather in said ocean or on said municipal beach. Section 2. That all ordinances or parts of ordinances which are in conflict herewith are hereby repealed. Section 3. That should any section or provision of this ordinance or any portion thereof, any paragraph, sentence, or word be declared by a court of competent jurisdiction to be invalid, such decision shah not affect the validity of the remainder hereof as a whole or part thereof other than the part declared to be invalid. Section ~. That this ordinance shall become effective ten (I0) days after its passage on second and final reading.
